원활한 국제물류를 위한 복합운송인의 책임체계 고찰 = Study a Thesis : A Study on the Liability System of Multi modal Transport Operator for Smooth International Logistics

국문 초록 (Abstract)

최근 물류의 원활화를 통한 제품원가의 절감 및 그를 통한 기업의 이윤창출이 강조되고 있는 시점에서 물류에 있어 핵심적인 역할을 담당하고 있는 복합운송인의 책임에 대한 이해가 무엇보다도 중요하다고 생각한다. 특히 복합운송인의 책임체계에 대한 이해가 가장 기본이 될 것인데 이 책임체계에 대하여는 크게 이종책임체계, 단일책임체계, 절충식 책임체계 등으로 구분해서 살펴볼 수 있다. 실무적으로는 이종책임체계가 대부분 적용되고 있으나 일반적인 운송방식을 탈피한 독자적인 유형으로서의 복합운송의 정립이 필요한 시점에서 이에 걸맞은 보다 적절한 책임체계에 대한 재검토가 필요하다고 여겨진다. 그러한 의미에서 절충식 책임체계를 채택하고 있는 기존의 UN 조약에 대한관심이 필요하다고 생각하며 각국이 적극적으로 이 UN 조약을 채택함으로써 복합운송의 획기적인 발전이 가능하리라고 믿는다. 이러한 복합운송의 발전은 물류부문의 혁신을 가져옴으로써 국제상거래의 신장에도 큰 도움을 제공하게 될 것이다.

As the interest about smooth logistics increases lately, the importance of multimodal transport, which performs the key role of logistics emerges. Though there are many issues respecting multimodal transport, the issue of the liability of multimodal transport operator seems to be the most important. This paper examines as to the system of the liability of multimodal transport operator. The system of the liability of multimodal transport operator is divided into network liability system, uniform liability system, and modified uniform liability system. Among these systems modified uniform liability system which UN convention on international multimodal transport of goods adopts, is the most desirable because this , system reveals the identity of multimodal transport. I wish each country will adopt UN convention and this study will assist in the development of logistics and the enlargement of international commercial transaction.
