아시아 지역인권협약 체결가능성과 한국의 역할 = Possibility of Contracting an Asian Regional Convention on Human Rights and the Role of Korea

다국어 초록 (Multilingual Abstract)

It has been proved that Regional Human Rights System is more effective to promote and protect human Rights. Regional System is able to regional particu-larities like as necessities, the priority order and regional circumstances as well as United Nations Human Rights System. Asia is the only region that there is no regional human rights protection mechanism compared to the other Continents. But now the fact that universality of human rights has been accepted world-wide reflect a affirmative sign to establish Asia regional system on human rights. Today according to the trends, similar to those cases to United Nations human rights protection mechanism and Europe`s mechanism, it is expected to go on three similar steps such as forming norms(Charter and Declaration level), promotion(Convention level) and protection(remedy legal system) in establishing Regional Human Rights Convention in Asia. Insufficiently, Asia has now begin to accept universality of human rights, and went on conceptualized, researched and advised process regionally and sub-regionally. As seen in United Nations and other Regional Conventions contracting procedures, Asia has arrive at the first level namely conceptualization, besides the second, giving a restriction, the last final binding. Asia region that there is no homogeneity in various cultures, races, regions, ethnics, ideologies and economic levels, human rights now begin common culture, is making Conventions and institutionalization as well as human rights charters and declarations, and resolutions in national and sub-regional level. On the other hand, there are some obstacles that exist in Asia region as a condition to establish regional system on human rights. Nevertheless, hindrance elements are now getting week. From now on, it is necessary to develop Asia model. Asia Human Rights Convention should cover particular aspects of human rights violations occurring in Asian region in the spirits of freedom and equality, as well as fundamental rights proclaimed in Universal Declaration of Human Rights. Asia Human Rights Charter has been drafted by Asia non-governmental Organizations. Based on this Charter, establishment Asia Human Rights Convention and implementation arrangement between government organizations are issues, It depends on our own good will, executive faculty and credibilities between Asia governments.
