여성차별철폐협약(CEDAW)과 한국 비정규직 여성노동자의 인권 : 제8차 정부보고서를 중심으로 = Convention on the Elimination of All Forms of Discrimination against Women and Korea’s Women Non-regular Workers’ Labor Rights

국문 초록 (Abstract)

전 세계 노동시장이 맞닥뜨리고 있는 비정규직 문제는 여성 노동인권에 영향을 미치고 있으며, 현재의 시대적 사안이라고 할 수 있다. 모든 양극화의 핵심원인이라고 평가할 수 있는 비정규직 문제는 빈곤의 고착화 및 새로운 신분제의 원인이라 불리기도 한다. 이러한 시대적 상황은 가장 취약한 여성 노동자들에게 심각한 인권 문제를 야기하고 있다. 이 글은 정부가 여성차별철폐위원회에 제출한 제8차 정부보고서에 대해 위원회의 최종 견해가 발표되기 전의 시점에서 여성 비정규직 문제에 중점을 두고 분석을 시도했다. 여성차별 철폐협약의 정부보고서 제출 의무는 협약 상의 가장 기본적인 의무이며, 작성 과정에서 NGO의 자문을 구하고 통계를 제시하는 등 많은 노력이 필요한 의무이기도 하다. 정부보고서는 그 정부의 여성인권에 대한 정책적 의지를 드러내는 바로미터라 할 수 있다. 제8차 정부보고서에서 정부는 자주 명시적 또는 묵시적으로 여성 비정규직 문제를 회피하고 있다. 이 글은 협약 제11조에 관한 답변 외에 비정규직과 여성노동인권에 관련된 내용을 찾아 비평한다. 이러한 분석을 토대로, 이 글은 비정규직 여성의 노동인권 개선을 위해서는 다방면의 정책이 필요하다는 점을 주장했다. 나아가 일터에서의 양성평등을 이루기 위해서는 젠더적 정책과 더불어 이중노동시장체제의 개혁이 이루어져야 일터에서의 양성평등을 이룰 수 있다고 주장한다. 그리고 이러한 양성평등 정책은 여성 비정규직 노동자들의 연대와 함께 이루어져야 한다. 노동시장의 유연화가 시대적인 흐름이 된 지금, 우리 정부에게는 코피 아난이 주장한 것처럼, “인권 없는 발전은 불가능하다”는 인식이 그 어느 때보다 시급하다. 향후 정부보고서는 이러한 점을 반영해야 할 것이다.

다국어 초록 (Multilingual Abstract)

The global labor market is facing a drastic rise of non-regular workers. This is an important current issue affecting women’s labor rights. The non-regular employment problem accounts for the social and economic bipolarization, and is also known as the main factor behind poverty fixation and shaping-up of a modern form of caste system, causing multiple human rights issues to the most vulnerable workers: women non-regular workers. CEDAW’s obligation to report is one of the convention’s core obligations. In the process of drafting up the report, the state has to consult with NGOs and provide detailed statistics, hence, requiring its full commitment. The state report serves as a barometer of the state’s willingness to protect and promote women workers’ human rights. This article analyzes Republic of Korea’s 8th state report, with a specific interest in women non-regular workers. In the 8th state report, the government explicitly and implicitly avoids the non-regular workers issue. This article also critically analyzes some items that are related to non-regular workers and women’s labor rights, besides those that have been already dealt in CEDAW’s concluding observations and the state report on CEDAW Article 11. Based on such analysis, this article argues that an omnidirectional policy is required in order to improve non-regular women’s labor rights. Gender-sensitive policies as well as reform of the dual labor market system are needed to achieve gender equality in the workplace. Gender equality policies are needed to be implemented along with those promoting solidarity among non-regular workers. Flexibilization of employment has become prevalent among the global labor market. However, the Korean government needs to be reminded of the famous quote by Kofi Annan: we will not enjoy development without human rights. The following state report should reflect this line of thought.
