兒童虐待의 類型別 實態에 관한 硏究

국문 초록 (Abstract)

우리 나라에서는 아동학대의 예방과 개입의 모든 노력이 민간단체의 주도로 이루어져 왔다. 정부는 유기-방임된 아동에 관한 보호적인 차원에서만 최소한의 개입을 해 왔을 뿐이며, 학대 아동의 발견, 치료, 예방의 차원에서는 전혀 아무런 활동을 하지 못했던 것이 현실이다. 이는 아동학대에 대한 구체적인 규정이 명시되지 못한 점과 예방이나 치료를 위한 제도적, 전문적인 서비스 개입을 위한 법적 장치가 부재한 점, 그리고 아동학대의 심각성에 대한 사회적 인식의 부족 등에서 비롯한 것이다.
이에 본 연구는 실제 우리 나라에서 발생하는 아동학대와 관련된 실태를 보다 체계적으로 분석하고 검토함으로써 아동학대를 예방하고, 아동학대로부터 야기되는 문제를 해결하는데 기여할 수 있는 대책수립의 함의를 찾아보는데 목적을 두고 있다.
이를 위해 이 연구에서는 첫째, 아동학대를 다룬 문헌 검토를 통해서 아동학대의 개념을 재구성해 보게 되며, 이를 기반으로 아동학대가 주로 어떠한 유형으로 일어나고 있는지 여부를 알아본다. 둘째, 동시에 아동학대와 관련된 연구의 접근방법을 검토함으로써 각 유형별로 아동학대가 주로 어떠한 요인과 결부되고 있는지 여부를 알아보게 된다. 셋째, 실제로 우리 나라에서 수행된 아동학대 문제를 다룬 연구결과를 분석함으로써 우리 나라에서 아동학대는 주로 어떠한 요인으로 인해 일어나고 있는지 여부를 확인해 보게 된다. 넷째, 이와 같은 일련의 절차를 통해 확인된 지식과 정보를 기초로 우리 나라에서 아동학대 문제를 해소하는데 적절하다고 생각되는 대응방안을 마련하는데 필요한 정책적 함의를 찾아보게 된다.
따라서 본 연구자는 우리 나라 아동학대의 유형별 실태에 관한 연구를 통해 학대받는 아동이 학대하는 부모가 된다는 악순환을 막고 아동의 건전한 성장과 인간적 권리를 보호한다는 당위적 목표에 접근하기 위해 아래와 같은 대책을 모색해 보았다.
(1) 법 및 제도의 개선방안이다.
아동학대 방지대책을 위해서는 아동복지법령에 보다 구체적이고 포괄적인 학대규정이 첨가되어야 한다. 또한 제도적 측면에서 아동보호서비스(CPS)의 도입과 탁아사업, 의료서비스 체계, 보호시설의 확대가 필요하며 영구임대아파트 정책 및 교육제도의 개선도 요구된다.
(2) 사회 및 문화적인 개선방안이다.
사회는 학대받는 아동이나 학대를 가한 부모를 사회의 희생자로서 도와주고 지지해 주어야 할 책임이 있으며 나아가 아동학대를 발생케 하는 사회, 문화적 요인을 제거하는데 노력을 기울여야 한다. 그리고, 부모, 교사 및 사회대중에 대한 아동양육의 효과적인 방법과 학대발견에 관한 교육을 실시하여 사회전체의 인간존중, 아동의 권리, 아동복지에 대한 개념체계의 전환을 이룩해 나가야 한다. 이것은 지역사회 연결망을 통한 상담, 치료, 교육의 실시와 아울러 아동학대의 신고 등에 지역사회 협조체계를 구축하는 것이 바람직하다.
(3) 의료 사업적 개선방안이다.
심한 학대를 받는 아동이 일차적으로 찾아오는 곳이 병원임을 감안할 때 병원을 중심으로 의사와 직원의 아동학대의 발견과 치료, 개입에 관한 관심과 교육이 요구된다. 또한 아동학대를 담당하는 어떤 특징적, 보건적 진료집단을 창설하기 앞서 현존하는 의료체계 중 보건소 직원들의 교육을 통해 아동의 양육과 건강관리를 다룸에 있어서 아동학대를 발견할 뿐 아니라, 학대를 할만한 부모의 발견도 가능하게 될 것이다.
(4) 사회사업적 개선방안이다.
아동학대가 일단 발견되면 학대아동의 치료뿐 아니라 부모의 정신치료 및 상담과 교육을 통해 치료개입과 학대를 유발할 가능성이 많은 가족환경의 개선을 위한 노력을 해야 한다. 또한 아동양육에 어려움을 가진 부모의 짐을 덜어주고 정서적 안정이나 지지를 회복시켜 주기 위해 사회복지관을 중심으로 가정방문서비스, 탁아서비스, 상담, 치료서비스 등이 병행되어야 한다. 또, 사회복지사의 인력이 부족한 실정이므로 아동학대 예방업무를 전담할 수 있는 사회복지사의 복지관 배치가 필요하다.
이상의 아동학대 방지를 위한 사회적 개선방안이 계속적으로 연구되어지고, 폭넓은 아동학대 실태조사가 이루어지기 위해서는 정보사회의 다양한 대중매체를 활용하여 여론을 조성하고 사회적 관심을 불러일으켜 아동학대의 심각성과 대책에 대해 일반 국민들의 주의를 환기시켜 나가야 한다.

다국어 초록 (Multilingual Abstract)

In Korea, almost all efforts to prevent and intervene in child molestations have been led by non public organizations. Government has carried out minimum intervention policy in the matter of abandoned and neglected children just for protecting them, but has not performed any direct activities for detection, medical treatment and prevention of maltreated children. It is due to the fact that there are no specific regulations on child molestation, the absence of legal devices for the systematic prevention and medical treatment of the victims, and the lack of social recognition on the seriousness of child maltreatment.
So, this study aims at finding out the implications to devise countermeasures of problems caused by child molestations and prevent child molestations perpetrated in this country by analyzing and examining the relevant realities systematically.
For this purpose in the study, first of all, the concept of child molestation will be reconstructed through the examination of reference books dealing with it, and on the basis of the result, the patterns of child molestation will be rearranged. Then, the causes of child molestation in each pattern will be revealed by analyzing various approaches to the child molestation studies. Thirdly, by investigating the problems of child molestations committed in this country, the factors of child molestations in Korea will be confirmed. And finally, policy alternatives necessary for the enactment to solve child molestation will be suggested.
The following policy measures are presented in order to approach essential goals of protecting children’s healthy growth and human rights, and to stop the vicious circle of molested children becoming molesting parents.
First, Reformation measures in legal and institutional systems.
For the purpose of prevention against child molestation, more concrete and comprehensive maltreatment regulations should be added to the Child Welfare Act. And in the institutional aspect, the introduction of Child Protection Service(CPS), the expansion of nurseries, medical service system and child-care facilities and the reformation of the policy of permanent rental apartment and educational system are also needed.
Second, Social and cultural reformation measures.
The society is responsible for the assistance and support of molested children and their brutal parents and furthermore, makes every effort to remove socio-cultural factors causing child molestations to happen. And, education to the general public as well as parents and teachers for the effective child upbringing should be carried out, so the whole society will transform for the promotion of human dignity, juvenile rights and child welfare. Many community organization system construction will be desirable through social networks for counseling, medical treatment, education and child molestation reports.
Third, Medical reformation measures.
Considering hospitals are the very place to which child victims go first, doctors and officials in hospitals should pay much attention to the detection and medical care of child molestation and their education for the intervention is required. And, before founding an additional health care group for the treatment of child molestation, the detection of potential victims and offenders of child molestation will be possible when they work in the field through the education of existing healthcare officials in medical systems.
Fourth, Reformation measures as a way of social work.
Once a case of child molestation is detected, efforts should be made to improve potential family circumstances and intervene in the handling through counselling and education as well as to treat the child victim medically and to treat his or her parents mentally. Also, in order to lessen the burden of parents suffering child-care difficulties and restore emotional self-confidence, home visiting service, nursery, counselling and medical care through social welfare facilities should be accompanied. Now, as the social welfare workers are nor enough to solely take care of the child molestation prevention, it is also needed to fill up social welfare personnel in the welfare centers.
Finally, public attention on the seriousness and countermeasures of child molestation should be evoked by making public opinion on the matter and stirring social interest in it through a variety of mass media.
