지방자치단체 자치고권 보장과 국정참여 = Guaranteeing the Autonomy of Local Governments and Participation of Local Governments in State Affairs

다국어 초록 (Multilingual Abstract)

The current global historical trend is moving toward the expansion and strengthening of democracy, the expansion of local decentralization for this purpose, and the strengthening of the self-determination rights of local governments and residents. The expansion and strengthening of local autonomy are inevitable to practically implement democracy and popular sovereignty stipulated in our Constitution and to achieve the ultimate ideal and purpose of the Constitution, which is the realization of the basic rights of the people (residents). The participation of citizens and local governments in state affairs can be explained by the same logic.
Since the 1990s, decentralization, which transfers state authority to local governments, has been emphasized, mainly in OECD advanced countries, and the affairs, manpower, and financial resources concentrated in the state have been transferred to local governments. However, the institutional mechanism for the state and local governments to negotiate on an equal footing on issues of local decentralization where mutual interests conflict is insufficient. In this situation, local decentralization cannot help but be influenced by the policy will of the state, and its progress has not reached the expected level.
In particular, today, due to the defects of representative (parliamentary) democracy, the most essential and fundamental principles of the Constitution, such as popular sovereignty and democratic principles, are not properly implemented in the political and administrative areas of the state or local governments, and the realization of human dignity and happiness, which these basic principles of the Constitution ultimately aim for, is threatened. Therefore, efforts to fundamentally overcome this are actively being made not only at the national level but also at the local government level. In other words, the movement to replace or at least supplement the representative principle in the political and administrative areas of the state or local governments can be said to be a representative example.
Therefore, it is urgent to establish an institutional device that increases the opportunity for local governments to reflect their opinions in the process of promoting local decentralization or in the process of national policy decision-making that has a significant impact on local autonomy. The active participation of local governments in state affairs is considered natural in terms of their right to self-determination to decide on their own issues.
