롤즈 정의론의 고찰과 교육현실에 대한 적용 = A study of Rawls’ Theory of Justice and Its Application to Current Educational System

국문 초록 (Abstract)

오늘날 우리나라를 비롯한 세계 대부분의 국가들은 자본주의를 경제체제의 모델로 채택하고 있다. 자본주의는 전통 사회에서 근대 산업사회로 이행하는 과정을 거치며 많은 발전을 하여, 오늘날까지 영향력을 공고히 하고 있다. 이러한 자본주의 사회에서는 이윤의 창출을 위해 최소비용으로 최대의 효과를 내는 방법이 우선시되었고, 이는 개인들로 하여금 효율성을 판단의 기준으로 삼는 공리주의적 사고방식을 부추기게 하였다.
그러나 자본주의 사회가 고도로 발달되면서 인간은 자본을 기준으로 양극화되었고, 이러한 불균형이 세대 간에 대물림되면서 도저히 극복할 수 없는 격차를 만들어내게 되었다. 1970년 당시 자본주의의 선봉에 있었던 미국에서는 이러한 자본주의의 병폐가 가장 심각하게 드러났다.
존 롤즈(John Rawls, 1921­2002)는 인간보다 자본이 우위에 서는 자본주의의 폐단에 문제의식을 품었다. 그는 경제적 불평등이 이를 용납하는 사회 제도로부터 도출된다는 것을 파악하고, 이를 극복하기 위해서 공정한 원칙에 입각하여 사회 제도를 재구성하려 하였다. 그는 이것을 정의의 원칙이라고 이름 짓고, 공정한 결과를 보장해 줄 수 있는 절차 속에서 합의를 통해 이러한 원칙을 도출하려 하였다. 공정한 합의를 보장하기 위해서 사회의 각 구성원들은 자신에게만 유리한 합의를 이끌어 낼 수 있는 모든 조건들을 망각하도록 하는 장치 즉, 무지의 베일을 쓰게 된다. 이러한 합의는 불공정이 개입할 여지가 없기에, 공정한 정의의 원칙이 도출되게 된다. 도출된 정의의 원칙에 입각하여 사회 제도를 새롭게 구성하고, 각 개인들은 무지의 베일을 벗은 후 정의로운 원칙에 입각한 사회에서 살게 되는 것이다.
롤즈가 우리에게 주는 가르침은 실제로 존재하는 방식이 마땅히 존재해야 하는 방식은 아니라는 것이다. 롤즈의 가르침을 오늘날 우리의 삶에 적용해 보자. 우리 각자는 서로 다른 재능, 가정환경, 사회적 배경 등의 조건에서 공평하지 않은 삶을 살고 있다. 롤즈의 가르침에 따르면, 공평하지 않은 삶이 우리에게 ‘실제로 그렇게 처해 있다’고 해서 ‘마땅히 공평하지 않은 삶을 살아야 한다’고 말할 수 없다고 지적하는 것이다. 우리의 삶을 공평하거나 불공평하게 만드는 것은 각자가 서로 다르게 타고나게 만드는 자연의 분배 방식 때문이 아니다. 오히려 사회 제도가 이러한 차이를 다루는 방식에 의해 생겨나는 것이다.
필자는 이러한 롤즈의 입장이 오늘날 우리 사회를 보다 정의롭게 만들 수 있도록 하는 데 커다란 기여를 할 것이라고 생각한다. 롤즈의 정의론은 소외된 개인들을 동시대에 함께하는 운명 공동체로 포용하고, 모두가 보다 공평한 삶을 살 수 있도록 하는 복지국가로서의 방향을 제시해 주기 때문이다. 본 연구에서는 롤즈의 정의론에 대해 고찰하고, 이것을 현실적으로 적용하려는 시도를 담고 있다. 필자는 사회 제도의 근간이 되는 교육을 주제로 하여 롤즈의 입장을 적용해 본 후, 이를 통해 우리나라의 교육현실에 의미 있는 시사점을 도출해 보고자 하였다.
롤즈의 정의론을 통해 우리나라의 교육현실을 살펴본 결과, 우리사회에서 나타나고 있는 문제점이 교육에서도 비슷한 형태로 드러나고 있다는 것을 알 수 있었다. 교육에서 드러나는 문제점들 또한 근본적으로 보았을 때, 불평등에서 기인한 문제이기 때문에 이를 해결하기 위해 정의의 원칙을 직접 적용해보고 정의로운 교육의 모델을 간략히 제시하였다.
정의로운 교육이 바로 설 수 있으려면, 우리가 불평등한 교육여건에 현재 처해 있다고 해서 아무런 문제의식 없이 마땅히 이러한 불평등을 받아들이려고 하는 사고에서 벗어나야 한다. 우리 모두에게는 교육 제도가 만들어내는 불평등을 인식하고 심각한 문제의식을 바탕으로 이를 시정하려는 노력이 촉구된다.

다국어 초록 (Multilingual Abstract)

Nowadays, most of countries, including Korea, have chosen capitalism as a model for an economic system. Capitalism has developed from traditional society to modern industrial society and even today, establishing it's influence on the solid ground. Under the capitalist economy, a method which makes maximum efficiency at minimal cost got it's priority, and encouraged individuals to think utilitarianism as a way of life.
However, as capitalism society became highly developed, we were polarized based on capital. It made insurmountable gap between rich and poor since the bequest of fortune and poverty between generations continued. In 1970's, United States, which was the forefront of capitalism, turned out to have the most serious illness.
John Rawls(1921­2002) thought the capitalism was wrong when the money got it's priority on people. He understood economical inequality was from the social system and tried to reconstruct social system over the fair principles. He named it the Principles of Justice and worked hard to draw them by the mutual agreement in the process which could assure fair result. To assure fair agreement, each member of society should wear the Veil of Ignorance which makes them to forget all the condition that can lead to pursue their own interest. As the agreement has no room for the injustice, the fair Principles of Justice will be deduced. From those deduced principles, they can reform the social system and every individual can take the Veil off and live in a society based on justice.
The lesson that Rawls gives to us is that the way how we are now is not the way how we should be. Let's put this lesson to our lives. Each of us live in a inequal life since our talent, family background and social background are all different from each other. Which means, from the view of his lesson, we cannot say that ‘one should live unfair life, because he is actually living an unfair life.’ What makes our life equal or inequal is not from the natural background. But it is from the way of social system handling those differences between the two.
I believe Rawls' viewpoint can give a contribution to make our society more just. It is because his theory of justice can steer people into the direction to the a welfare state, which accepts neglected individuals as a national communities of fate living in contemporary and makes all people live a fair life. In this paper, I examined Rawls' theory of justice and tried to apply this into the actual practice. I applied it mainly to education for it is the foundation of society system, to see the meaningful point of view on Korean education system.
As the result, problems we are having in our society was also shown in the education system too. Fundamentally, those problems in education are the problems from the inequality, I applied principle of justice and briefly suggested a correct educational model.
To make education to be just, we have to ditch the idea of accepting those inequality without any critical mind because we are already in it. We all have to realize the inequality made by the educational system and should try to make this right based on an earnest will.
