회복적 사법을 위한 형사조정제도 개선 방향 연구 = A study on the Improvement of Criminal Mediation System of Restorative Justice

국문 초록 (Abstract)

확장·발전시킬 것인지 그 방향을 정하여 기존 시스템을 재검토할 시기라고 생각된다. 이에 본 논문에 서는 민·형사 판결과 형사조정 우수사례 등에서 확인되는 조정사례들을 살펴보고 형사조정제도 개선 과 관련한 시사점이 있는지 검토하였다. 그동안 회복적 사법 실현을 위한 형사조정의 실질화 방안으로 형사조정위원 전문화와 교육이 자 주 논의되어 왔으나, 이보다 주요한 조치는 결국 형사조정절차와 관련한 제도적 개선이다. 특히 형사 조정조건의 다각화 노력이나 2회 이상의 조정 필요사건 지정은 조정절차 실질화를 위하여 필요한 조 치라고 할 수 있을 것이다. 다만, 이러한 조치들에 앞서 독립적인 예산 확보 및 조직 구성을 위한 노력 이 있어야 할 것으로 보인다. 단기적으로는 2회 이상의 조정 필요사건이나 복잡한 형사조정 사건을 담당할 수 있는 전문 상임 형사조정위원을 위촉하고 이들이 주도하는 상설 형사조정위원회를 구성할 필요가 있다. 중장기적으 로는 각 지역과 중앙을 아우르는 독립기구인 ‘(가칭)형사조정센터’를 설치하여 형사조정 사례들과 피 드백을 체계적으로 관리·공유하며, 형사조정 관련 정책과 제도를 개발하고, 형사조정위원의 관리와 교육을 담당할 부서나 인력을 마련하는 방안을 검토할 필요가 있다. 또한 형사조정법 등 특별법 제정 을 통하여 조정절차 규정 외에 형사조정센터 등 독립조직 설립과 예산 관련 규정을 둘 필요가 있다. 나 아가 상임 형사조정위원에게 상설 형사조정위원회 구성원으로서의 지위와 형사조정사례를 수집·관 리할 수 있는 권한을 부여하고, 그에 따른 겸직금지·비밀유지 의무 부과·뇌물죄 적용에 있어 공무원 의 제 조항까지 아울러 규정하는 것이 필요하다고 생각된다. 현행 형사조정제도 관련 개선방안 논의에 도움이 되고자 우리 형사조정제도의 문제점을 살펴보 고 몇 가지 제안을 더하여 보았다. 우리 형사조정제도가 그 실질적 취지를 살리는 방향으로 발전하고, 확장됨으로써 기존 형사사법 시스템을 보완하고 종국적 분쟁 해결에 효과적으로 기여할 수 있는 제 도가 되기를 바란다.

This paper reviewed civil and criminal cases related to criminal mediation and considered whether there were any implications for the improvement of the criminal mediation system.
Until now, specialization and education of criminal mediation committee members have been frequently discussed as a way to actualize criminal mediation for the realization of restorative justice, but a more important measure is, after all, system improvement in relation to the progress of criminal mediation.
In order to improve the system, it seems that securing an independent budget and organizing an independent organization should be premised first. In the short term, it is necessary to appoint a professional criminal mediation committee member who can handle the case requiring more than two procedures of criminal mediation or complex cases and form a permanent criminal mediation committee led by them. It is also worth considering establishing a criminal mediation center and enacting a special law on criminal mediation I hope that our criminal mediation system will develop and expand in the direction of making use of its fundamental purpose and become a conflictsolving system that complements the problems of our criminal justice system.
