자율성과 인권 : 칸트의 이론을 중심으로 = Autonomy and Human Rights in Kant's Theory

국문 초록 (Abstract)

오늘날 세계는 자유권이 사회권에 앞서는 경향을 보이면서 점차 사회적 소수자들의 삶이 더 더욱 위기로 몰리고 있다. 그러나 사회권이 무시된 지반 위에서 자유권이 제대로 마련되기는 어렵다. 이 글은 이와 같은 문제의식 아래서 근대 자유권에 자리하고 있는 문제점을 진단하고, 이 문제점을 극복하고자 한 칸트의 인권 이론을 분석하는 데 목적을 두고 있다. 그의 인권 이론은 이론적으로는 한계적 사유에, 실천적으로는 자율성 이론에 근거를 두고 있다. 그의 인권 이론은 자유권과 사회권을 포섭 관계로 보기보다는 상호 긴장과 조화의 관계로 바라보고 있으며, 또한 주권과 인권 사이에도 동일한 접근을 시도하고 있다. 그럼에도 불구하고 그의 인권 이론은 현대의 인권 이론에 비추어볼 때 일정 정도 한계를 지니고 있다. 이 글은 그의 인권 이론의 의의와 한계를 조명하는 데 목적을 두고 있다.

다국어 초록 (Multilingual Abstract)

Liberal rights are taking precedence over social rights in our world these days. And so, minority groups of society are being driven out of our neighbour world. But liberal rights cannot play a role correctly without basing on social rights. I will deal with problems which modern liberal rights have, and analyze the human rights theory of Kant who endeavors to overcome these problems. His human rights theory is based on “limited(Grenze) thinking” in theoretical dimension, and on autonomy theory in practical one. Kant makes an effort to harmonize liberal rights with social rights, and sovereignty with human rights. Nevertheless, His human rights theory has its limits in comparison with contemporary human rights theory. I will consider the significance and limit of his human rights theory.
