『관자(管子)』에서의 법률사상 검토 -“존군(尊君)”관과 “중법(重法)”관을 중심으로 = 『管子』中的法律思想探微 -以“尊君”觀與“重法”觀爲核心

국문 초록 (Abstract)

“존군(尊君)”과 “중법(重法)”은 중국 고대 법가 법률사상의 양대 특색임과 동시에 중점이 두어진 부분이다. 법가 사상 가운데서 한결같이“존군”은 최고의 정치적 목표였으며, “중법”은 이러한 목표에 도달하는 유일한 효과적인 수단인 것으로 천명되고 있다.
“존군”과 “중법”은 법가 학설을 판단하는 주요 표준이다. 이러한 표준에 근거하여 볼 때, 『관자(管子)』는 분명하게 법가의 색채를 띄고있다.
그러나 그 가운데서도 유가 등 기타 학파의 학설도 융합하고 있다. 곧 『관자』는 “존군”을 견지하고 있지만, 백성의 가치와 이익도 중시하고 있다. 법치를 견고히 유지하고 있으면서도 또한 도덕 교화의 기능도 부정하지 않고 있다. 군주와 법의 관계에 있어서도 『관자』는 “군주에 대한 저항, 법에 대한 군주의 복종” 등도 강조함으로써 상앙(商鞅)이나 한비자(韓非子) 등 다른 법가 사상가들과는 차별적인 의식을 갖고 있다는 특징을 보여주고 있다.

다국어 초록 (Multilingual Abstract)

Monarchy and legalism are two main characteristics of Legalists' theories, always playing important roles in Legalists' legal thoughts. Maintaining the monarchy is the primary political target of Legalist, while a rule by law is the only effective means that attains this target. We can find that Guan Tzu contains typical Legalists' thoughts, and it is deeply affected by Confucianism. Guan Tzu advocates absolute monarchy, but it also have concern to the people's value and benefits. Guan Tzu insist a rule by law, but it values the function of moralization. As for the conflict of monarch's will and law, Guan Tzu usually insists that monarch obey the law, which is different from the opinions in Shang-chun Shu and Han-fei Tzu.
