장애여성 성폭력 범죄심리에 대한 수사상 개선방안 = Improvements in the Investigation of Sexual Violence Criminal Psychology against Disabled Women

국문 초록 (Abstract)

  장애인의 인권문제가 대두되면서 최근 장애여성의 성폭력문제에 대한 심각성이 커지고 있다. 장애여성을 대상으로 한 성폭력범죄에 있어 더욱 심각한 문제는 장애여성의 성폭력피해에 대한 수사상에서나 법적 절차상에서 보호 장치가 제대로 마련되어 있지 않아 가해자의 처벌이 매우 힘들다는 것이다. 따라서 이 연구에서는 장애여성의 성폭력피해에 대한 올바른 시각과 확실한 처벌을 위한 수사상 개선방안에 대해 논의하고자 한다.<BR>  장애여성 성폭력범죄의 수사상 문제점을 살펴보면 첫째, 성폭력범죄에 대한 수사기관의 편견 및 장애여성의 특수성을 충분히 고려하지 않은 수사방법 등으로 어려움을 겪고 있다. 둘째, 장애인에 대한 인식이 부족한 경찰에 의해 수사과정상 피해 장애여성들의 이차적 피해가 우려된다. 셋째, 법적 대처능력이 현저히 떨어지는 장애여성을 위한 성폭력범죄의 수사과정상 제도적 장치가 부족한 실정이다. 넷째, 성폭력피해 장애여성에 대한 사전적·사후적 지원체계가 절대적으로 부족하다.<BR>  따라서 장애여성에 대한 인권침해가 우려되는 성폭력범죄의 수사과정에 있어 개선방안이 모색되어야 한다. 그 대책으로 제시한 것은 첫째, 장애여성 성폭력범죄에 대한 수사요원의 인식 전환을 강조할 수 있다. 둘째, 장애여성의 특성을 고려한 수사제도가 마련되어야 한다. 피해 장애여성의 입장에서 수사과정이 이루어져야 하며, 그 절차가 최소화 되어야 할 것이다. 셋째, 전담수사기관이 설치되어야 하며 장애여성에 대한 인권침해방지를 위해 전문 인력을 배치하고, 그들에 대한 인권침해의 실태가 정확히 파악되어져야 할 것이다. 넷째, 성폭력사건과 관련된 상담기관과 수사기관 및 법적 지원기관, 그리고 의료기관간의 연계망을 형성하여 성폭력피해 장애여성을 위한 지원체계가 구축되어야 할 것이다.

다국어 초록 (Multilingual Abstract)

  With the rise of disabled people"s human rights as social issues, the seriousness of sexual violence against disabled women is being spotlighted. The most serious problem, however, is that it is extremely intricate to punish the offenders because there is no adequate safeguard for the victims of sexual violence in investigation and legal process. Thus, the present study purposed to form a right view to disabled women who are left unprotected from sexual violence and to discuss improvements in the investigation of sexual violence against disabled women for sure punishment.<BR>  Problems in the investigation of sexual violence crimes against disabled women are as follows. First, the investigation has difficulties coming from the investigation agency"s prejudice against sexual violence crimes and the investigation method with no consideration of the peculiarity of disabled women. Second, secondary damage is likely to be inflicted upon the victims in the process of investigation by the police and the prosecution who lack understanding of disabled women. Third, there is no adequate institutional device for disabled women, whose abilities to cope with legal affairs are extremely poor, in the investigation process of sexual violence crimes. Fourth, there are not sufficient preventive and ex post supports to disabled women victimized by sexual violence.<BR>  Thus, we need to improve the process of sexual violence investigation that is likely to violate disabled women’s human rights. For the improvement, first, the investigation agency must switch its attitude toward sexual violence crimes against disabled women and education should be executed for this necessary. Second, the investigation system should be adjusted in consideration of the characteristics of sexually violated disabled women. It should be in the position of victimized women and the process should be simplified as much as possible. Third, there should be an investigation agency exclusive for sexual violence crimes against disabled women. Fourth, specialists should be deployed to prevent the violation of disabled women"s human rights and the current state of human right violation should be surveyed accurately. Fourth, organizations related to sexual violence including counseling organizations, investigation agencies, legal support institutions and medical institutions should establish a network to support disabled women victimized by sexual violence.
