국제환경법 분야에서 사전주의원칙에 대한 관심이 높아지고 있다. 인간의 노력이 이루어낸 과학적 성과들은 완전하지 못하고, 이러한 결과들 간에는 상호 모순이 발생할 수 있음에도 불구하고, 환경을 위한 여러 조치에 과학적 입증을 요구하는 경우가 많다. 특히 과학적 인과관계의 입증이 일방의 조치에만 요구되는 예가 많다는 점에서 과학의 규범화 문제는 그렇게 논리적이지도, 또 그렇게 정당한 것이라 말할 수도 없다. 예를 들어 국제통상규범과 환경보호를 위한 국내적 조치가 충돌할 경우에 전자는 후자에 대해 과학적 근거의 제시를 요구한다. 하지만 환경을 위한 조치가 갖는 실효성을 과학적으로 입증할 수 없다고 하더라도 해당 조치가 환경보호에 있어 실효성이 없다고 과학적으로 입증된 것은 아니다. 이러한 사실로부터 우리는 과학이 가지는 한계를 명확하게 인식할 수 있고, 규범들에서 과학을 요구하는 것이 가지는 한계를 인식할 수 있다.
사전주의원칙(precautionary principle)이란 이러한 과학적 한계에 대한 인식에서 출발한 것이다. 즉, 과학적으로 입증이 곤란한 경우라도 환경에 가해지는 리스크의 정도가 크다면, 위험에 대한 입증이 완전하지 않거나 입증이 아예 곤란한 경우에도 해당 환경조치를 취할 수 있도록 하는 원칙이다. 이는 현재 국제환경법의 여러 영역에서 성문화되어 있지만, 애초에 독일법에서 기원한 것이라고 알려져 있다.
이 논문은 독일법에서 발전한 사전주의에 대해 살펴보고, 이를 국제환경법상의 사전주의원칙과 비교하기 위한 것이다. 또 독일법상의 사전주의원칙에 관한 논의에서 국제환경법의 발전에 있어 참고할 수 있는 내용들에 대해 검토해보고자 한다. 특히 환경문제는 가치와 이해관계 상호 간의 갈등을 해소하기 위한 것인데, 독일법에서 이러한 상황에서 이익형량이나 비례성 심사라는 방법을 적극 원용하고 있다는 점은 주목할 만하다. 하지만 국제(환경)법에 있어 이러한 형량적 접근이 가능한지, 또 얼마나 실효성이 있는지에 대해서는 보다 많은 연구가 필요하다고 할 것이다.

The precautionary principle in international environmental law has gained attention among policy makers and ecologists. Although it is well recognized that the scientific evidence cannot be perfect and suitable for all kinds of proof procedures and that there are sometimes conflicts between the outcomes of scientists’ argumentations, the law and regulation request the science-oriented explanation in order to justify a certain measure inteded for the protection and preservation of the environment. However, we have observed that the scientific evidence is required mostly only account of the one party who claims that a measure in question is or will be environmentally sound. Such a legal requirement of science is neither logical, nor rational. For example, where a conflict between international trade law and national measures for the environmental protection is concerned, the former seems to request the latter to prove their rationality by providing the scientific evidence. However, if a measure for the environment could not be scientifically proven practical and effective, this does not mean yet that scientists can prove the measure to be not justified any more in the ecologist’s perspective. From this viewpoint, we can clearly realize the limit of science and the problems of requiring science as a sole credible ground.
The precautionary principle begins from the recognition of science’s limited usefulness. According to this, if a measure is not based perfectly on the scientific proof and the risk to be harmful for the environment would be high, the proof of risk should not be undertaken completely. Sometimes it could be rationalized to take measures where effects on the environment could not be proven at all. The principle has been recognized in some areas of international environmental law, which has been, however, originally developed in German (environmental) law.
This Article is to analyse the precautionary principe (Vorsorgeprinzip) in the German law context and to compare it to the principle with the same name developed under international environmental law. Above all, it examines whether and to what extent the German style precautionary principle could contribute to the discussions on the status and development of the principle in international environmental law.
Environmental law certainly aims to solve the disputes arising from the conflicting interests. For such cases, German law utilizes the proportionality test and the balancing of interests. It is, however, doubtful whether this approach is possible and practicable also in international (environmental) law and it could play a decisive role in dealing with actual conflicts among the States.
