일본의 우주거버넌스와 우주기본법 = Japan’s Space Governance and the Basic Space Act

국문 초록 (Abstract)

본 논문은 2008년 제정된 일본의 ‘우주기본법’을 중심으로 일본 우주거버넌스 체계의 형성과 제도적 특성을 분석하고, 이를 토대로 우리나라 우주정책 및 우주입법에 대한 시사점을 도출하고자 한다. 일본은 「우주기본법」의 제정을 통해 우주정책의 기획, 조정, 집행이 유기적으로 연계되는 종합적 거버넌스 체계를 확립하였으며, 내각부 산하 우주개발전략본부를 중심으로 정책의 일관성과 실행력을 제도적으로 뒷받침해 왔다. 이러한 체계를 기반으로 후속 입법과 예산 지원 구조가 강화되었고, 궁극적으로는 민간 주도의 우주산업을 전략적으로 육성할 수 있는 제도적 기반이 마련되었다.
뉴스페이스의 부상과 새로운 우주경제의 도래라는 전환기적 상황에서, 정책의 일관성과 제도적 체계를 조기에 구축한 일본의 사례는 향후 우리나라 우주정책의 방향 설정과 법제 설계에 있어 유의미한 비교 연구 대상으로 평가될 수 있다. 이에 본 연구는 일본 우주정책의 제도적 기반으로서 「우주기본법」에 주목하여, 그 제정 배경과 법적 구조, 나아가 후속 입법 및 거버넌스 체계의 전개 양상을 종합적으로 고찰하였다.
이러한 취지하에 본 논문은 일본 우주정책의 역사적 전개 과정을 검토한 후, ‘우주기본법’의 제정 배경과 구조 및 주요 내용을 분석하고, 이를 통해 일본의 우주입법 체계가 어떠한 방식으로 정비되어 왔는지를 살펴보았다. 마지막으로 이러한 분석을 바탕으로 우리나라 우주거버넌스 및 우주입법의 발전을 위한 정책적ㆍ입법적 함의를 제시하였다.

This paper seeks to analyze the formation and institutional characteristics of Japan’s space governance system, with a particular focus on the Basic Space Law enacted in 2008, and to derive implications for the future development of space policy and legislation in the Republic of Korea. The enactment of the Basic Space Law enabled Japan to establish a comprehensive governance framework that integrates the planning, coordination, and implementation of space policy in an organic and coherent manner. Under the leadership of the Strategic Headquarters for Space Policy, situated within the Cabinet Office, Japan has institutionalized policy consistency and administrative effectiveness. Building upon this governance structure, Japan has expanded its legislative framework and funding mechanisms, thereby laying a strategic institutional foundation for the development of a private-led space industry.
Against the backdrop of a paradigmatic shift marked by the rise of NewSpace and the emergence of a new space economy, Japan’s early establishment of a coherent policy direction and institutional architecture serves as a valuable comparative reference for shaping South Korea’s space policy and legal framework. In this context, the present study undertakes a comprehensive examination of the Basic Space Law as the institutional foundation of Japan’s space policy, analyzing the historical background of its enactment, its legal structure, and the subsequent evolution of related legislation and governance mechanisms.
To this end, the article first traces the historical trajectory of Japan’s space policy, then provides an in-depth analysis of the background, structure, and key provisions of the Basic Space Law. Through this analysis, the study elucidates how Japan’s legislative framework for space activities has been systematically developed. Finally, the article identifies key policy and legislative implications for the advancement of South Korea’s space governance and space legislation.
