미국 디자인특허를 이용한 제품디자인의 형상 관리방안 기초연구 = 애플사의 스마트폰 사례를 중심으로

국문 초록 (Abstract)

디자인특허는 시각적 대상에 대하여 독점배타적인 권리를 부여하는 제도로, 제품디자인의 외관형상에서 특정 부분을 강조하거나 지속적으로 응용하여 디자인 정체성을 구축하고자 하는 기업에게 매우 효과적인 수단으로 쓰일 수 있다. 제품디자인 형상의 재료라 할 수 있는 요소들이 선별되고 조합되는 과정에 디자인 특허적 권리가 더해질 경우 시장에서 차별성 있는 정체성 구축에 유리해 질 것이고 구체성 있는 특허로서의 권리는 형상요소 그 자체를 관리하는 것에 비하여 가치의 측정과 계획 설정이 용이할 것이기 때문이다.
본 연구는 디자인특허를 통한 제품디자인의 형상요소 관리 방안을 도출하기 위한 선행 연구로서 기업의 디자인특허 포트폴리오 운영 사례를 분석하고자 애플사의 스마트폰 디자인특허를 대상으로 디자인특허와 형상요소의 관계를 이해하고 형상요소를 분석할 방안을 제시하였다.
연구의 구성은 분석 대상인 디자인특허건의 선별과 해당 디자인 특허건에서의 디자인요소 추출 및 분석단계로 이루어졌다. 우선 분석 대상 선정을 위해서 애플사의 등록 완료된 디자인특허 중 스마트폰 형상의 전체 또는 일부를 권리의 범위로 특정한 건을 선별하였고 그 중에서도 디자인특허 내의 도면에서 형상요소를 선택하거나 생략하는 편집이 이루어진 건만을 따로 구분해 냈다. 그 후 형상요소의 추출 단계에서는 대상 도면에서 형상에 관련된 권리 부분만을 남긴 후 형상을 구성하는 최소 단위 즉, 원이나 사각형과 같은 기본도형이나 하나의 완결된 외곽선을 낱개로 분리해 제품외관에 사용된 모든 요소를 추출했다. 그 결과 분석 대상 디자인 특허건에서 다루어진 모든 형상 요소의 도출이 이루어 졌고 각 요소가 서로 결합한 상태를 확인 할 수 있었다. 특히 일부 형상요소는 다른 형상요소들 보다 더 자주 그리고 더 다양하게 디자인특허권으로 운영되었음이 확인되었는데 이는 애플사가 디자인정체성을 구축하기 위해서 핵심적인 형상요소를 관리한 패턴으로도 볼 수 있을 것이다.
애플사는 2011년 삼성사와의 디자인특허 분쟁 이전부터 특허에 대한 집중적 투자와 관리를 해온 기업으로 디자인특허가 가진 제도적 특징과 장점이 충분히 활용된 포트폴리오를 구축해 왔다고 할 수 있다. 이러한 애플사의 디자인 특허건에서 형상요소의 분석을 시도하고 분석방법을 제시한 본 연구는 후속연구에서 애플사가 최초의 스마트폰을 선보인 이후 십여 년간 핵심적 형상요소를 어떻게 관리해 왔는지를 분석할 토대가 될 것이며 더 나아가서는 디자인특허를 통한 제품형상의 효과적인 관리방안을 도출하는데 기여할 것으로 기대된다.

다국어 초록 (Multilingual Abstract)

Design patenting is a system that grants exclusive rights to the visual aspect of objects, which can be used as a very effective tool for companies that seek to establish a design identity by emphasizing or continually applying certain aspects of a product’s design. This is because, if the design patent right is added to the process of selecting and combining shape elements, which can be considered the materials of the product design shape, it will be beneficial to establish the identity through market differentiation and it would be relatively easier to measure the value and set a plan concerning the rights as a concrete patent than to manage the shape elements themselves.
This study is preliminary research for developing a management method for the shape elements of product design through design patents. This study aims to understand the relationship between design patent and shape elements to analyze a company’s operating case of a design patent portfolio, and propose a way of analyzing shape elements through the specific case of Apple’s smartphone design patent.
This study consists of selecting the design patent cases for analysis and extracting and analyzing the design elements in the corresponding design patent case. First, to specify the analysis target among Apple’s registered design patents, the cases that included the whole or part of the shape of the smartphone within the scope of the rights were sorted. Among them, only the cases in which the shape elements were selected or omitted in the plan included in the design patent were selected. Subsequently, in the stage of extracting the shape elements, only the parts of the rights in the target plan related to the shape were left, and all elements used in the product shape were extracted by separating them into the minimum unit that constitutes the shape—including basic figures such as a circle, rectangle, or complete outline. Thus, all shape elements covered in the analyzed design patent cases were obtained and the way each element was combined with the others was identified. In particular, it was found that some shape elements were managed more frequently under the patent rights and more diversely than other shape elements, which can be considered as the pattern through which Apple managed the key shape elements to establish its design identity.
Apple has been extensively investing in and managing patents since before its design patent dispute with Samsung in 2011. This means that Apple is a corporation that has established a portfolio that sufficiently utilizes the institutional characteristics and advantages of design patents. This study, which attempts to analyze the shape elements in Apple’s design patent cases and thus proposes an analysis method, will be the foundation for the follow-up studies to analyze how Apple has managed key shape elements in the ten years since it introduced the first smartphone. Furthermore, it is expected to contribute to the development of an effective management plan for product shapes through design patents.
