인간대상연구 동의 면제 제도의 개선 = Waiver of Informed Consent in Human Subjects Research Under Korean Law

국문 초록 (Abstract)

연구대상자의 사전 동의는 인간대상연구에서 필수적으로 요구되나, 일정한 조건 하에서는 기관위원회가 동의 면제를 승인할 수 있다. 동의 면제의 정당성은 예를 들어 응급 상황에서 연구 참여 동의가 어려운 경우, 연구의 타당성을 보장하기 위한 경우, 연구대상자의 불필요한 고통을 줄이기 위한 경우 등에서 인정되고 있다. 하지만 이 제도에 대한 비판도 존재하며, 연구 참여 거부 가능성이 전무한 것이 아님을 고려할 때 연구대상자의 자율성 침해 우려도 제기된다. 이 연구는 헬싱키 선언, CIOMS 가이드라인, 미국의 Common Rule, 호주의 인간대상연구 규범 등 국제적 규범과 각국의 법령에 포함된 동의 면제의 요건을 분석하고, 국내외 논의를 바탕으로 우리나라의 생명윤리 및 안전에 관한 법률 내 동의 면제 제도를 개선하기 위한 방안을 제안한다. 개선안에는 동의 면제 제도의 명확한 목적 설정, 실무 현장에서의 활용에 관한 경험적 연구의 수행 및 각 요건의 입법론적·해석론적 제안이 포함된다.

This paper explores the waiver of informed consent in human subjects research under Korean law and proposes improvements. The participant’s informed consent is required before the start of a study, but under certain conditions, the institutional review board may waive consent. Waiving consent is justified in various situations – e.g., in emergen- cies where consent to participate in the study is difficult, to ensure the study’s validity, or to reduce unnecessary suffering for the research subjects. However, there are also criticisms of the waiver, and concerns are raised about the possible infringement of the autonomy of research subjects. This paper analyzes international norms regulating the waiver of consent and proposes ways to improve the waiver mechanism under Korea’s Bioethics and Safety Act. The proposed reforms include establishing a clear purpose for waiver, conducting empirical research on its use in the field, and amending the law to remove a controversial requirement.
