독일 법무부의 형사정책 - 최근의 형법 및 형사소송법의 개정을 중심으로 - = Criminal Policy of Ministry of Justice in Germany

국문 초록 (Abstract)

‘독일 법무부의 형사정책’이라는 주제는 상당히 넓은 범위를 포괄할 수 있기 때문에 논의를 위해서 추가적인 설명 또는 범위의 한정이 필요하며 이때 고려할 요소는 장소로서의 유럽연합과의 관계, 주와 연방과의 관계이다. 시기와 관련하여, 논의는 최근 또는 현재의 형사정책으로 한정할 필요가 있다.
형사정책과 정치와의 관계와 관련하여, 안전을 강조하는 것은 어느 정권이든 마찬가지이나. 형사정책적인 중점을 어디에 둘 것인지에서 정당 간의 차이가 드러난다. 이 글에서는 최근 독일 법무부의 형사정책적 경향을 형법과 형사소송법의 개정에 기반하여 살펴본 결과로 다음의 견해를 제시하였다.
형사정책의 수단이 형법에 한정되지는 않지만 형법 및 형사소송법이 그를 위하여 법무부가 활용할 수 있는 가장 확실한 수단임은 분명하다. 어떠한 형법을 목표로 하는지는 수단으로서뿐만 아니라 목표가 되는 사회가 무엇인지와도 연관되는데, 우리는 ‘보다 나은 형법’을 지향하여야 하며 그를 위한 방향은 보충성과 인도주의의 강화, 책임원칙의 철저화, 보안(예방)적 형사정책의 강화이다. 보다 나은 형법 및 올바른 형사정책을 위해서는 외국의 논의를 참고할 필요가 있는데, 독일의 상황은 우리에게아래의 시사점을 준다. 첫째, 형사정책은 정치와 밀접한 관계를 갖는다는 점은 분명한데, 독일의 대연정과 신호등 연정과 같이 형사분야의 구체적 쟁점에 대하여 우리의 정당들이 분명한 정책 차이를 드러내는지 의문이다. 둘째, 정책의 핵심은 신뢰성과 투명성인데 특히 형사정책에서는 투명성이 중요하다. 정책내용은 일반에게 널리 알려져야 하고 예측가능해야 하며, 그 의미 또한 분명해야 하는데, 그렇지 않은 형사정책은 시민의 자유를 심각하게 침해할 수 있고 시민 또한 자신의 정당한 권리를 누리지 못할 가능성이 있다. 그를 위해서는 어떠한 입법을 하기 위한 준비를 철저히 해야 하는 것은 물론, 그 입법의 효과가 어떠한지에 대한 평가도 할 필요가 있다. 충분한 논의와 평가가 이루어지지 않은 입법은 당사자를 설득할 수 없다. 셋째, 실체법과 관련하여 입법자가 법정형의 상향을 추구하는 것만이 ‘규범적’이라고 이해할 수는 없다. 형법이 새로운 처벌조문의 도입 및 법정형의 상향 등을 통해 스스로 과도한 부담을 지고 그로 인해서 형사사법에게도 과도한 부담이 지워지는 상황은 피해야 한다.

The topic of “criminal policy of the German Ministry of Justice” can cover a wide range, so additional explanations or limits are needed for discussion: place and time.
This article examined the recent criminal policy trends of the German Ministry of Justice based on the revision of the Criminal Law and Criminal Procedure Law and presented the following conclusions: For better criminal law and correct criminal policy, foreign discussions need to be referred to, and the situation in Germany gives us the following implications.
First, it is clear that criminal policy is closely related to politics, and it is questionable whether our parties (and Ministry of Justice) reveal clear differences of Policy on specific issues in the criminal field, such as the German Grand Coalition and the Traffic Light Coalition.
Second, the core of policy is reliability and transparency, especially in criminal policy. Content of policy should be widely known and predictable to the public, and its meaning should also be clear, otherwise criminal policies may seriously violate civil liberties and citizens may not enjoy their legitimate rights. For that, it is necessary not only to thoroughly prepare for legislation, but also to evaluate the effectiveness of that legislation. Legislation without sufficient discussion and evaluation cannot persuade the parties.
Third, in relation to substantial criminal law, it cannot be understood that only the legislator's pursuit of an upward statutory sentence is 'normative'. It should be avoided that the criminal law imposes an excessive burden on itself through the introduction of new punishment provisions and the increase of the statutory sentence, thereby placing an excessive burden on criminal justice.
