법정사(法井寺) 항일운동(抗日運動)에 대한 법적(法的) 고찰(考察) = Legal Approach to Independence Movement of Beopjeong-Temple in 1918

국문 초록 (Abstract)

1918년 10월 제주도에서는 일본인을 축출하고 국권을 회복하기 위해 법정사에서 김연일을 중심으로 항일운동을 전개하였지만 실패하였다. 법정사 항일운동에 대해 조선총독부는 대한제국법인 「保安法」과 「형법」의 騷擾罪 를 적용하여 처벌하였다. 주모자인 김연일에게는 법정최고형인 징역 10년에 처하는 등 엄격히 처벌하였고, 재판도 신속히 하였다. 이는 항쟁주도층과 제주도민을 격리시키려는 일본의 의도이었다. 조선총독부는 관련당사자를 적법절차를 준수하면서 처리하였다. 그러나 식민지조선의 형사법의 근간을 이룬 「조선형사령」은 인권보장의 핵심적 내용은 누락된 외견적인 것이었다. 일본의 대대적인 탄압에도 불구하고 김연일 등 주동자는 즉시 체포되지 않은 채 상당기간 동안 제주도에 은신할 수 있었다. 법정사 항일운동이 특정종교집단만의 운동이 아닌 제주주민 전체의 지지를 받았음을 반증한다.

To restore the sovereignty of Korea and expel the Japanese from Jeju-Island, Kim Yeonyil(김연일), the head priest of Beopjeong-Temple, protested against Imperial Japan, but it had failed At October 1918 in Jeju-Island. The General Japanese Government in Colonial Korea applied The Act for Peace-Keeping(보안법) and Sedition in Penal Code against the participants of Independence Movement. He sentenced Kim Yeonyil to 10-years imprisonment the most heavy punishment in law and the trials concerning the participants of Independence Movement were very fast. In order to separate leading group of Independence Movement from people in Jeju-Island. The General Japanese Government in Korea did so. He handled them observing the principles and laws, regulations. So he protected human rights obviously, but the truth is not. The criminal Act in Colonial Korea which was fundamental, had not contained protecting human rights. Nevertheless the General Japanese Government in Korea pressured heavily, Kim Yeonyil and leaders were not arrested for long time owing to being helped by people in Jeju-Island, it means that protest in Beopjeong-Temple was Independence Movement.
