K-뷰티산업 발전을 위한 법제도 개선방안 연구 = A Research on Improving the Legal System Environment for the Development of the K-beauty Industry

국문 초록 (Abstract)

뷰티산업의 산업적 중요성, 특히 제조업 중심의 우리 경제가 수출 부진이나, 성장세 둔화를 나타내고 있는 가운데 부가가치가 상대적으로 높고 일자리 창출효과도 높은 뷰티산업에 대한 학문적 관심도도 당연히 높아지는 것은 자연스러운 현상으로 보인다. 이러한 이유로 뷰티산업의 경쟁력과 발전 방향을 모색하는 다양한 연구들이 선행되어 왔고, 이러한 연구들은 뷰티산업의 내용과 분야, 범위 구분을 포함해서, 종사자 및 매출액 분석을 통한 성장 가능성 분석과 방향성 제시, 세계적 트렌드 변화에 대한 분석과 대응방향 제시 등 다양한 내용들이 축적되고 있다. 뷰티산업에 대한 다양한 연구들이 진행되고 있지만, 아쉬운 점은 뷰티산업이 국내외적으로 더욱 성장하는데 있어서 필요한 법제도 및 환경에 대한 분석과 이에 대한 개선 방안을 연구한 문헌이나 논문은 그리 많지 않다는 것이다.뷰티산업이 산업적 측면에서 중요성이 각인되고 있는 현시점에서, 하나의 산업 트렌드나 문화적 현상으로서 특정 산업군이 좀 더 발전하기 위해서는 해당 산업에 대한 규제나 진흥을 위한 법제도 환경이 무엇인지, 문제점은 무엇이고 개선방안을 무엇인지에 대한 연구가 매우 중요하다. 따라서 본 연구는 뷰티산업을 둘러싼 우리나라의 법체계와 주요내용, 뷰티산업 발전을 위한 국가 및 지자체의 기본 계획들과 이를 둘러싼 법제도 환경의 현실과 문제점을 살펴보고, 우리나라 뷰티산업 발전을 좀더 발전시키기 위한 법제도 개선 방향을 도출해보고자 했다. 우선 우리나라 지자체들의 뷰티산업 관련 조례들이 어떤 내용을 담고 있는지 간략하게 분석했다.뷰티산업 관련 현행 법제와 각 지자체 조례를 간략하게 살펴본 결과 뷰티산업 영업권 보장, 헤어디자이너 등 뷰티산업 종사자의 권익 보호, 서비스 과정 중에 발생할 수 있는 사고에 대한 소비자 보호방안 등에 있 어서 입법적 보완이 필요한 점을 확인할 수 있었다.지금까지 살펴본 뷰티산업 발전을 위한 선행연구 검토, 지자체 조례 및 해외사례 검토를 통해서 도출한 뷰티산업 발전을 위한 법제도·환경 개선 방향을 정리하면 다음과 같다.첫째, 한국의 뷰티서비스는 외국에서도 인정받는 기술 경쟁력을 갖추고 있어 세계적으로 성장하기 위해서는 국가적 차원의 체계적인 육성 방안이 필요하다. 둘째, 뷰티산업 및 서비스의 지속적인 성장을 뒷받침하고, 고객들에게 선진화된 서비스의 제공과 뷰티 디자이너들에게 직업에 대한 열정을 가지게 하고, 뷰티산업의 성장을 위해서는 이른바 「뷰티산업 진흥에 관한 법률」의 제정이 필수적이다.빠르게 성장하고 있는 소위 K-뷰티산업이 지속성을 가지고 더욱 발전하기 위해서는 국가적 차원의 통일된 지원 근거와 내용이 규정되어 있는 모법으로서의 기본법 제정이 필요하다. 해당 법률에는 뷰티산업 전반에 대한 개념 정의는 물론, 해당 분야에 대한 국가적 지원 책무를 명확히 하고, 지자체 지원 근거를 규정해서 지자체가 국비 등의 지원을 통해서 지자체별 뷰티산업의 특성에 맞는 발전전략과 이행을 할 수 있도록 해야 할 것이다.또한 뷰티산업 종사자와 서비스 이용자들 사이에서 발생할 수 있는 다양한 분쟁을 사전예 예방, 조정, 중재하는 시스템을 갖추는 것도 우리나라의 뷰티산업 발전을 더욱 촉진하는데 도움이 될 것으로 보인다.

The industrial importance of the beauty industry, especially as our manufacturing-centered economy is showing sluggish exports or slowing growth, it seems natural that academic interest in the beauty industry, which has relatively high added value and a high job creation effect, is increasing.For this reason, various studies have been conducted to explore the
competitiveness and development direction of the beauty industry. These studies are accumulating a variety of contents, including classification of the content, field, and scope of the beauty industry, analysis of growth potential and presentation of direction through analysis of employees and sales, and analysis of global trend changes and present-ation of response directions.
Although various studies on the beauty industry are in progress, the unfortunate thing is that there are not many literature or papers that study the analysis of the legal system and environment and ways to improve them, which are necessary for the beauty industry to grow further domestically and internationally.
At a time when the importance of the beauty industry is recognized in the industrial aspect, in order for a specific industry to develop further as an industrial trend or cultural phenomenon, it is necessary to determine the legal environment and improvement measures for regulation and promotion of the industry.
Therefore, this study examines Korea's legal system and main contents surrounding the beauty industry, the basic plans of the national
and local governments for the development of the beauty industry, and the reality and problems of the surrounding legal system environment, and aims to further develop the beauty industry in Korea. We attempted to derive directions for improving the legal system.
First, we briefly analyzed what the beauty industry-related ordinances of local governments in Korea contain. Most local governments establish basic plans related to the beauty industry, and stipulate that it is their duty to support human resources training, fact-finding surveys, and product and brand development as support areas for the beauty industry.
Local governments such as Gyeonggi-do and North Chungcheong Province establish beauty industry promotion centers or support centers within their jurisdictions to establish a support system for responsibilities such as support of local governments stipulated in ordinances through support organizations that act on behalf of local governments fo
r the development of the beauty industry.
However, the unfortunate thing is that in a situation where there is no integrated model for the development of the beauty industry, the local government ordinances of each metropolitan city and province have slightly different characteristics depending on the industrial structure and status of the relevant local government and the pledges or will of the local government head at the time of ordinance enactment, but most of them The point was that it was uniformly defined with similar content.
As a result of a brief review of the current laws and ordinances of each local government related to the beauty industry, legislative supplementation is needed in terms of guaranteeing the beauty industry's goodwill, protecting the rights and interests of beauty industry workers such as hair designers, and consumer protection measures against accidents that may occur during the service process.
The directions for improving the legal system and environment for the development of the beauty industry, derived from a review of previous studies for the development of the beauty industry so far, local government ordinances, and overseas cases, are summarized as follows.
First, Korean beauty services have technological competitiveness that is recognized abroad, so a systematic development plan at the national level is needed to grow globally. Second, to support the continued growth of the beauty industry and services, to provide advanced services to customers and to encourage beauty designers to have a passion for their profession, and to promote the growth of the beauty industry, the so-called “Beauty Industry Promotion Act” must be enacted.
This is essential. In order for the rapidly growing so-called K-beauty industry to develop further with sustainability, it is necessary to enact a basic law as a model law that stipulates the basis and contents of unified support at the national level. The law not only defines the concept of the beauty industry as a whole, but also clarifies the national support responsibilities for the field, and stipulates the basis for local government support, so that local governments implement development strategies tailored to the characteristics of the beauty industry by local government through support such as national funds.
In addition, having a system to prevent, mediate, and mediate various disputes that may arise between beauty industry workers and service users is expected to be helpful in further promoting the development of our country's beauty industry.
