범죄피해자 심리지원의 실태 및 개선방안 = Current State and Improvement Measures of Psychological Support for Crime Victims

국문 초록 (Abstract)

최근 2024년 4월 아파트 층간 소음갈등으로 10대 이웃이 50대 주민에게 흉기에 찔려 중상을 입고 트라우마에 시달리고 있다는 충격적인 보도가 있었다. 이처럼 강력범죄로 인하여 피해자들이 겪는 정신적·심리적 충격은 상상 이상이라서 이에 대한 대응이 필요하다. 물론 범죄피해자보호법이 제정시행되고 있어 물적 지원·심리지원을 하고 있지만 피해자의 인권차원에서 적극적대응이 필요한 시점이다. 그동안 우리나라의 사법체계는 피의자·피고인의 인권보장에 치우친 나머지 피해자의 인권은 소홀했었다. 이 논문의 목적은 범죄피해자지원의 모습을 살펴보고 특히 심리지원의 현 모습을 진단하여, 범죄피해자심리지원제도의 문제점과 개선방안을 모색함에 있다.
범죄피해자지원제도의 현황, 선행연구분석과 실태진단을 통해 범죄피해자심리지원의 문제점과 그 개선방안을 제시하면 다음과 같다. 첫째, 법정책적 개선방안(인식전환, 심리지원중심, 법개정안), 둘째, 제도개선방안(전문성강화, 센터의 역할강화, 피해자입장에서 지원, 비대면 상담대비), 셋째, 경찰 심리시스템의 계속발전 등이 필요하다는 것이다.

Recently, in April 2024, there was a shocking report about a teenager being stabbed by a neighbor in his 50s due to inter-floor noise conflict in an apartment complex, resulting in serious injuries and traumatic distress. The psychological shock experienced by victims of violent crimes like this is beyond imagination, necessitating a response. While the Crime Victim Protection Act is being enforced, providing financial and psychological support, it's time for proactive measures from the perspective of victims' human rights. Historically, the judicial system in Korea has prioritized the rights of suspects and defendants, often neglecting the needs of the victims. The purpose of this paper is to examine the current state of support for crime victims, particularly in terms of psychological support, and explore the problems of the crime victim psychological support system and seek improvement measures.
Based on an analysis of the current state of the crime victim support system, previous research, and factual diagnosis, discussions were conducted on the problems and improvement measures of psychological support for crime victims. As a result, the following conclusions were reached: Firstly, there is a need for legal policy improvements, including shifting perceptions, focusing on psychological support, and proposing legislative amendments. Secondly, institutional improvement measures, such as enhancing professionalism, strengthening the role of centers, providing support from the victim's perspective, and preparing for remote counseling, are necessary. Thirdly, the continued development of the police's psychological system is essential.
