국문 초록 (Abstract)

판례는 선택적으로 병합청구 된 각 청구권에 대하여 소송물로서의 독자성과 상호경합을 인정하고 있다. 그 결과 법원이 원고에게 가장 유리한 어느 한 청구권을 선택하여 인용한다고 하더라도 그 인용된 급부가 원고의 청구 범위에 미치지 못할 때에는 나머지 병합청구 전부에 대하여 심리·판단할 것을 요구하고 있다. 이와 같은 결론은 선택적 병합제도의 본질적 특성과 제도적 장점을 훼손할 수 있다. 선택적 병합청구의 제도적 장점을 살리려면 원고가 청구취지에서 구하고 있는 급부 자체에 중점을 두고법원은 가장 유리한 청구를 기초로 판결하도록 의무화하고, 그것으로써 나머지 병합청구에 대한 심리·판단이 함께 이루어졌다고 보는 것이 타당하다. 원고가 선택적 병합청구를 하고 있더라도 법원의 석명권행사를 통하여 예비적 청구로 변경하도록 하는 것도 필요하다.

다국어 초록 (Multilingual Abstract)

In case of selective consolidation of claims, the precedent of Korean Supreme Court acknowledges independence and mutual coexistence about each claim as subject matter of litigation. As a result, even if the court select and allow the most favorable one of those claims to the plaintiff, the court should hear and decide residual consolidation of claims all, in case allowed payment is not sufficient to the amounts of the plaintiff. These conclusion might damage essential property and merit of selective consolidation of claims. In order to bring the merit of selective consolidation of claims to life, it is necessary to make mandatory to adjudicate on the basis of the most favorable claim. By doing so, hearing and decision could come to a close about residual consolidation of claims. In conclusion, this result is helpful to solve problem at one try.
