In the past, the direction of urban development took the form of large-scale demolition, but the limitations of large-scale redevelopment have become evident. Urban renewal projects since the 2000s have changed to small-scale urban development. However, design guidline. and stable standards for small-scale projects have not yet been achieved. Accordingly, this study analyzed urban redevelopment project cases and examined the differences according to changes in infrastructure and industrial facilities. Based on this analysis, we propose changes in industry and infrastructure for more effective urban development.

현행 도시및주거환경정비법상 재개발ㆍ재건축조합설립추진위원회와 조합의 운영에 관한 一考察

재개발ㆍ재건축조합설립추진위원회 및 조합의 운영은 재개발ㆍ재건축사업을 시행하는 전 과정을 통하여 법ㆍ제도 측면에서 가장 중요하다고 본다. 그 근거법인 도시정비법의 주요 내용을 중심으로 그 운영, 그에 따른 쟁점과 중요한 의미를 지니는 최근의 대법원 및 주요하급심 판례를 검토하여 보면 그 핵심은 구역주민의 권익침해와 직접 관련된 것으로 추진위원회 위원 또는 조합 임원의 자의적이고 위압적 운영과 관련된 절차적 하자가 대부분이다. 실제 관련 실무상 쟁점으로부터 도출되는 문제점은 근원적으로 현행 법ㆍ제도적 시스템의 불완전성 내지 불비로부터 초래되고 있음을 알 수 있다. 따라서 이러한 취약점이 전제되고 있어서 추진위원회 또는 조합의 전(全)운영과정 중 특히, 이권과 관련된 많은 부분에서 조합임원 등 일부 실력자에 의한 불법ㆍ비리가 양산되고 있는 것이다. 주지하다시피 주거환경정비가 시급한 구역은 대체로 저소득층이 밀집된 지역이고, 사업의 시행자체가 구역주민의 재산권ㆍ생존권 등 권익과 직접적인 관련성을 가지므로 이해관계가 매우 복잡ㆍ다양하여 갈등과 대립이 첨예하여 분쟁이 빈번하게 발생하고 있다. 이는 추진위원장, 위원 또는 조합장, 임원의 실무진이 주어진 책무에 대하여 신뢰성과 공정성을 토대로 하여 그 운영의 묘미를 제대로 살리지 못하는 데에서도 기인하는 것이다. 결국 현행법 규정과 제도로는 현실을 반영하여 적용하여 운용하는데 있어 한계가 있고, 당초에 도시정비법의 공익적 목적에 부응하는 합리적이고 투명ㆍ공정한 조합운영은 더 이상 기대하기 어렵다. 근본적으로 어떠한 명책이 나오든지 간에 그것을 운영하는 주체의 올바른 가치관과 업무수행 전 과정을 통해 사회적 정당성을 지향하는 합목적성ㆍ법적합성이 요구된다. 더불어 토지등소유자ㆍ조합원은 재개발ㆍ재건축사업에 대한 불신을 없애고 사업진행 상황에 대하여 능동적ㆍ주도적으로 참여하는 것이 중요하다. 또한 추진위원회 위원 및 조합 임원은 주어진 책무를 성실ㆍ투명하게 수행하여야 하고, 그에 따른 결과는 수시로 공개하여 주민의 의견을 적극적으로 수렴하는 자세가 필요하다. 아울러 현시점에서 이를 뒷받침 해줄 수 있는 법ㆍ제도적 시스템 보완이 시급하다. 그리고 시장ㆍ군수ㆍ구청장은 관할구역내의 정비 사업이 지역사회발전에 크게 이바지하는 점을 간과하지 말아야 할 것이며, 구체적으로는 전문전담팀을 편성하는 등 공정한 감시자로서 법에 따른 관리ㆍ감독을 철저히 하여야 비로소 성공적인 공익사업이 될 것이다. It is important to review the procedures focusing on the legislation of urban rehabilitation as the adjective law for the ground. It is natural that the flaw under the procedure is the main content generally in the issues concerned. And, it is meaningful to analyze, review, and construct the content of the precedents, by the Supreme Court and lower courts, which may have important meaning, introducing the cases of recent precedents in this paper. There are many cases that the head and executives of the association do not show their credibility and fairness in executing the work, even though the roles of the chairman and members of promotion committee and the head and executives of the association are very important. In addition, it is often observed that the members of general meeting of the association, the highest resolution organization, is uninterested and, on the contrary, some members cannot present their opinion or execute their rights since they have no professional or legal knowledge to judge the situation of the project. All the issues until now would be solved by executing the system at a time. As optimistic prospect is earlier, the outcome of the system execution would be observed. Even if any policy is presented, justice, fitness of the purpose, and legal suitability are necessary for right values and the work process by the operation party. Finally, the mayor, the head of county or district should supervise and monitor the project completely with positive concern by organizing professional team to make successful rehabilitation work, not disregarding the point that the rehabilitation work is to contribute to the development of communities in the region.
