The rural development policies and projects in Korea has been implemented with various related acts. For instance, these acts include Framework Act on the National Land, National Land Planning Utilization Act, Special Act on Balanced National Development, etc, enacted by each of adminstration. However, there are some limitations to encourage the variety of rural development policies due to duplication and overlapping between the relevant acts. Nowadays, the fields of rural development have been evolved and integrated not only by agricultural infrastructures but also in various fields such as multi-functional industry including rural tourism, green care, and cultural welfare, etc. Therefore, the current legal system may not effectively accept and support in various rural development policies and projects at all. This study tried to figure out the necessity of reorganization related legal system through the field survey to planners, residents and analysts regarding the correlation between legal systems and projects. For these reasons, this study tried to find out the problem of current legal system and then, suggested alternative methods related to the legal system for integrated rural development. The scope of the study is as follows; 1)correlation analysis between relevant laws and rural development projects. 2)field survey to figure out the legitimacy and validity for the reorganization of the legal system. At last the result of the research has suggested an alternative method to reorganize the legal system and proposed the new legal system with is good for integrated rural development.

해외 농촌 경관관리제도의 특징과 시사점: 일본, 미국, 독일 사례를 중심으로

The purpose of this study was to derive suggestions of legal system for rural landscape management. For this, rural landscape legal systems being used in Japan, USA and Germany have been selected as analysis objects. The analysis have conducted with perspectives of how related laws, plans, regulations and public project work to manage rural landscapes under their conditions. Based upon the analysis results, improvements for rural landscape management system are suggested as follows: First, it is necessary to develop legal treatments for rural landscape management and those need to be built up in closed connection between related laws. Second, rural landscape management plans need to be linked and complemented. Third, the planning system needs to be implemented in cooperation with the regulatory system. Forth, public sectors are required to support implementation of projects in the level of local governments. Also, varied legal supports need to be accompanied in order to enhance unique values and improve physical environment of rural areas. Finally it is necessary to establish policy directions for consistent rural landscape management. 본 논문은 해외 국가들의 농촌 경관관리 관련 법제도의 특징을 분석하고 시사점을 도출하는 것을 목적으로 한다. 일본, 미국, 독일 3개국의 농촌 경관관리제도를 사례 분석 대상으로 선정하였으며 법체계, 계획제도, 규제제도, 사업제도의 네 가지 측면에서 분석하였다. 분석 결과, 국내 농촌 경관관리 관련 법제도를 개선하기 위한 다섯 가지 시사점을 도출할 수 있었다. 첫째, 국토 및 농업・농촌 관련 법제도와의 긴밀한 연계 속에서 농촌 경관관리 법제도를 운영할 필요가 있다. 둘째, 농촌 경관관리의 방향을 일관성 있게제시하기 위해 관련 계획제도를 연동시켜 활용하고일부 보완하도록 농촌경관 관련 계획제도를 재편할필요가 있다. 셋째, 농촌경관의 체계적 관리를 위해관련 계획이 규제 또는 유도수단으로 작동되어 실행될 수 있도록 제도적 근거를 마련할 필요가 있다. 넷째, 농촌지역의 물리적 환경개선뿐 아니라 고유한 자연적・문화적 가치를 제고할 수 있도록 마을 또는 지역을 단위로 한 통합적 사업 추진 및 지원이 요구된다. 마지막으로, 법제도 개선에 앞서 일관되고 체계적인 농촌 경관관리를 위한 목표 및 정책 방향을 설정할 필요가 있다.
