최근 보호관찰소의 이전과 관련된 성남사건을 계기로 교정시설 유치 현황이 지역 내 갈등요인으로 작용하고 있다. 일부 지역에서 사이버보호관찰소로 홈페이지를 운영하고 있는데 그 기능은 제한적이다. 인터넷을 통한 교육자료 제공 등 제3의 공간으로 활용되고 있는 실정이다. 이는 보호관찰의 보충적 역할로서의 기능으로 건물은 그대로 두고 실시하는 것으로 인원, 예산측면 등에서는 오히려 비효율적 정책이다. 대체기능으로서의 정책개발이 필요한 부분이다. 이와 관련, 법조타운 내 교정시설을 병설하기 위해서는 도시재생 사업과 연계하여 운영하는 방안이 모색되어야 할 것이다. 이에 학계와 실무부서에서 공동의 학술 세미나 형태로 홍보전략이 보강되어야 하며 현행 온라인 민원시스템의 연계방안의 개선이 필요한 것으로 판단된다. 현행 온라인 민원신청을 통한 보호관찰 신고는 법적인 효력이 없으며 보호관찰신고 신청후 지정받은 출석일에 당해 보호관찰소에 출석하여 보호관찰 신고서에 서명하여야만 신고를 인정하고 있다. 온라인보호관찰소가 활성화 되면 대상자는 석방심사 과정에서 모든 형식적 · 행정적인 절차를 거치기 때문에 보호관찰소를 방문할 이유가 없으며, 이들이 방문이 없는 보호관찰소를 더 이상 유지할 필요가 없고 기존의 행정절차는 모두 법조타운으로 이관하여 행정의 효율성을 제고할 수 있는 방안이다. 구체적 방안으로 지자체별로 법조타운을 건설하여 조직체를 집중 운영함으로써 혁신적인 제도개혁이 이루어질 것이다. 일부 교도소는 민영교도소를 도입, 운영하고 보호관찰소는 융 · 복합 기술을 응용한 온라인 보호관찰소로 전환하여 시행하면 기대효과는 의외로 높아질 것이다. 지역별로 법조타운이 들어서면 수사초기부터 재판, 형집행의 모든 단계에서 외부노출을 최소화할 수 있고 범인의 도주 우려를 차단할 수 있을 것이다. 결과적으로 기존의 오프라인 보호관찰소의 운영은 축소하는 대신 보호관찰관을 보조하는 인원을 확충하여 대상자를 좀 더 세밀하게 접촉할 수 있는 온라인제도를 정착할 필요가 있는 방안을 제시하고자 한다. 특히 최근의 법조타운 형성 등으로 경제적 효과를 창출하는데 대해 정확히 이해하는 것이 필요하다. 향후 대상자들의 인권보호는 물론 보호관찰 보조요원의 양성 등으로 직업창출에도 이바지 하게 될 것이다. 이러한 점에서 그 중요성이 크다고 볼 수 있으므로 온라인 보호관찰소의 운영방안에 대해 이해하는 것은 의미 있는 연구이다.
