        일본의 최고재판관 국민심사제와 그 시사점

        The trial proceedings should be open to the public, and the opportunities for the public to positively and actively participate in such proceedings should be expanded Also, the establishment of principles of law interpretation (the grounds for justices’ judge and its preposition) should reflect civic societies` diverse values, and accordingly amended and changed In South Korea, compared with the legislative branch and the administrative branch, characterized by weaker democratic legitimacy, the judicial branch should be reinforced with such values Japanese Constitution provides the National Review for Judges of Supreme Court (Japanese Constitution Article 79 Sections 2, 3, and 4) Under this system, if, appointed by the cabinet, the judge of Supreme Court, may be put to direct national vote, they will be fired when the disapproval vote reaches a majority of the votes cast This system is designed to grant, by the principle of the sovereignty of the people, democratic legitimacy to the judicial agency This paper examines Japanese National Review for Judges of Supreme Court in which the people, through direct voting, participate in the composition of the Supreme Court, in a bid to find a new clue to reforming the composition of Korean Constitutional Court with vulnerable democratic legitimacy
