제4차 산업혁명기술을 기반으로 하는 지능정보사회는 사회 전영역에서 초연결화와 초지능화로 인해 자동화가 보편화된 미래사회이다. 지금까지 검토된 연구에 의하면, 지능정보사회 진입에 따라 위험이 되는 범죄는 무인운송수단, 첨단 로봇공학, 블록체인, 비트코인, 인공지능, 유전공학, 인공생물학, 나노기술, 3D 및 바이오 프린팅, 뇌과학, 가상현실 등 제4차 산업혁명기술을 악용한 첨단범죄이다. 또한 지능정보사회에서 초연결화와 초지능화를 악용한 해킹, 사이버테러, 사이버공격, 사생활 침해 및 감시, 사이버 괴롭힘과 스토킹 등 사이버범죄가 문제가 될 것이다. 그러나 일부 범죄자가 기술을 악용한 것보다 사회적 피해는 기술의 역기능으로 인해 누구나 범죄자나 범죄피해자가 되는 것이다. 역사상 가장 짧은 시간 동안 기술이 보급되어 대중화되었다. 기술을 사용하지 않는 사람을 찾기 힘들고, 오히려 사이버공간의 익명성과 탈억제 효과로 부작용과 함께 과도하거나 부절적할 사용이 문제가 되고 있다. 이제 기술을 사용하는 여부보다 인터넷, 스마트폰과 같은 기술이 현실 공간에서 적절하게 올바르게 사용할 수 있는지가 중요한 사회가 되어가고 있다. 범죄자들은 인터넷웹검색, 애플리케이션, 소셜네트워크서비스 등 다양한 방식으로 불법 웹툰, 저작권, 도박, 마약, 성매매, 테러 등 불법 정보를 생성하여, 불특정 다수에게 노출 기회와 근접성이 급증하게 되었다. 노출된 특정인들은 범죄의 고객이 되어 데이터베이스에 저장되어 범죄에 악용되고 있는 것이 현실이다. 죽, 누구나 범죄 정보에 노출되어 현실 세상에서 생물학적, 심리학적, 사회학적 문제가 없음에도 불구하고 기술사용의 문제로 인해 살인, 강간, 강도, 방화, 절도 등 강력 범죄에 연루되기도 한다. 디지털 성범죄와 같이 누구나 기술사용의 문제로 범죄피해자가 되기도 한다. 기술의 역기능에 대한 범죄정책은 규제보다 우선시 되는 기술 개발정책, 사생활침해, 차단에 대한 우회 기술, 첨단 기술의 악용, 물리적 단속의 한계, 사이버공간의 특성으로 인한 국내법 적용의 어려움, 국제공조의 어려움, 경찰력의 한계 등으로 한계에 직면하였다. 따라서 다가오는 지능정보사회의 범죄를 대비하기 위해서는 기술의 역기능에 대비한 정책을 중심으로, 범죄에 대한 인식 전환, 범죄패러다임 전환, 기술 사용정도에 대한 정확한 조사, 기술 사용자 중심의 대책, 디지털세대에 맞는 대책, 사이버범죄학과 기술범죄학의 확대, 범죄발생이론에서 기술사용학적 접근의 고려 등이 필요하다. Intelligence society that was based on 4th industrial revolution technology was said to be future society owing to connection and intelligence in the society. Crimes threatening the society made use of unattended transportation, state-of-the-art robot engineering, block chain, bit coin, artificial intelligence, genetic engineering, synthetic biology, nano technology, 3D and bio printing, neuro-science and virtual reality and other 4th industrial revolution technology. In intelligence society, connection and intelligence could be used to do hacking and to commit cyber terror, and to do cyber attack, and to infringe upon private life and supervise, and to do cyber bully and stocking. Everyone could be criminal and/or victim by technology's dysfunction. Technology had been distributed and popular for a short time. Discovering of the one who did not make use of technology was difficult, and cyber space was anonymous to make use excessively and improperly. Internet and smartphone should be used properly and correctly. Criminals produced illegal information of webtoon, copyright, gambling, drug, prostitution and terror by Internet retrieval, application to disclose to many persons and to get access. The disclosed could be target of the crime to build database and to make use for the crime. Everyone could get access to criminal information and to be involved in murder, rape, burglar, arson and robbery and others despite no problem of biology, psychology and sociology. As digital sexual crime does, so everyone can be victim because of use of technology. Criminal policy of dysfunction of technology included technical development policy rather than regulation, infringement upon private life, detour technology of blocking, abuse of state-of-the-art technology, limitation on physical control, difficulty of application of local law, difficulty of international cooperation and limitation on police power. In intelligence information society, change of cognition of the crime, conversion of crime paradigm, investigation into use of the technology, user oriented measure, ways of digital generation, cyber criminology and expansion of technical criminology, and approach of use of technology.
