중재방식으로 의료분쟁을 해결함에 있어 중국의 의료분쟁 다원적 해결시스템을 완비하기 위하여, 중재를 통한 의료분쟁에 대한 심도 있는 연구가 필요하다. 중국의 의료분재 해결시스템 건립에 있어 어려운 문제는 의료분쟁중재의 중재가능성 여부 문제와 의료분쟁중재의 형태를 어떻게 하느냐이다. 한편, 중국은 의료분쟁해결에 있어 중재에 의한 방식으로 임의중재형식을 채택하고 있다. 즉, 중국의 중재시스템이 의료분쟁중재의 실무에서나, 일부 지방정부에서 의료분쟁중재의 입법은 모두 의료분쟁의 중재가능성에 대한 입법을 갖추고 있다. 이에 중재법의 개정에 있어 이러한 사항이 고려되어야 하는데, 만약 이러한 사항, 즉, 의료분쟁해결에 대한 중재시스템을 고려하지 않으면, 자원낭비라는 현실적 상황이 발생하게 된다. 그러므로 중재법 개정에 있어 현재의 의료중재시스템을 충분히 고려할 필요가 있을 것이다. 의료분쟁에 있어 고도의 전문성과 복잡성을 고려하여 의료분쟁중재정의 구성방식에 있어서도 합의정 형식을 하여야 할 것이다. 하지만, 당사자가 단독중재정을 협의한 경우에는 이를 존중할 필요도 있을 것이다. 이에 본 연구에서는 중국의 의료분쟁해결에 있어 중재시스템의 현황과 문제점을 고려하여, 외국입법과 비교 및 검토하였다. The settlement of the medial disputes by arbitration is the significant exploration in improving the ADR of medial disputes in our country. The arbitrability and the mode of medical disputes to arbitration are the difficulties in the settlement mechanism of medial disputes. Both practices and the legislation in certain regions indicate the arbitrability of medical disputes. Voluntary arbitration should be adopted to construct the arbitrational mechanism of medical disputes. Considering current states of the great difficulty in revising the arbitration law and the enormous waste in arbitrational resource, we should apply current arbitrational mechanism to resolve the medial disputes. Seeing that the highly professional and complexity in medical disputes, unless the sole arbitrator is the common choice by parries, the collegiate bench should be taken in the composition of the arbitration tribunal.

Comparing the curricula designs, teacher trainings and comprehensive qualities at home and abroad, the study analyzes the problems in Chinese tourism vocational education and consequently puts forward some suggestions and strategies to improve Chinese tourism vocational education.

反诘语气副词在汉韩两种语言中都是比较特殊的一类,句法位置灵活,语义虚灵,因此是对外汉语教学和韩国语教学的难点之一。本文以中韩两国学生为考察对象,对其在使用汉韩反诘语气副词情况进行了问卷调查,并从句法和语义两个角度考察了汉韩反诘语气副词的偏误情况。句法分布偏误有句首错序偏误和句中错序偏误,句法组合偏误有语气词错用偏误和助动词错用偏误,语义偏误有反诘义理解偏误和现实与非现实义理解偏误。其中句法组合的偏误率最高,这是因为汉韩两种语言的差异在反诘语气副词组合特征上体现得最多,学生受到母语的影响产生诸多的偏误,这部分是汉韩反诘语气副词教学的重点和难点,对偏误率高的个别反诘语气副词需要进行针对性教学。 Rhetorical modal adverbs are a special kind in both Chinese and Korean languages. They have flexible syntactic positions and empty sematic meanings. Therefore, they are one of the difficulties in teaching Chinese as a foreign language and Korean language. Taking Chinese and Korean students as the research object, this paper makes a questionnaire survey on the use of Chinese and Korean rhetorical modal adverbs, and analyses the errors of Chinese and Korean rhetorical modal adverbs from the perspective of syntax and semantics. The syntactic distribution errors include the wrong ordering at the beginning and middle of the sentence. The syntactic combination errors include the misuse of modal particles and auxiliary verbs. The semantic errors include the misunderstanding of rhetorical meaning and the misunderstanding of realistic and non-realistic meaning. Among these, the error rate of syntactic combination is the highest. This is because the differences between Chinese and Korean are reflected most in the combination characteristics of rhetorical modal adverbs. Students are influenced by their mother tongue and have many errors. This part is the key and difficult point in the teaching of rhetorical modal adverbs. It is necessary to carry out targeted teaching for individual rhetorical modal adverbs with high error rate.
