두 싯다르타 - 헤세의 변형과 깨달음의 의미

Im vorliegenden Aufsatz wird untersucht, wie und mit welcher Intention der Schriftsteller Hesse die Biografie des historischen Gautama Buddha veränderte und den Aspekt der Erleuchtung neu reflektierte. Hesses Modifikationen, an denen Einflüsse aus dem Buddhismus, Hinduismus und Taoismus ebenso abzulesen sind wie Bezugnahmen auf philosophische Positionen Nietzsches und Schopenhauers, kann man im Großen und Ganzen in drei Punkten zusammenfassen. Erstens veränderte der Autor die Lebensstufen Siddharthas und verlegte die Phase der weltlichen Erlebnisse bei Kamala und Kamaswami hinter die Phase der geistlichen Übungen bei den Brahmanen und Samanen. Dadurch erreicht er, dass den individuellen Erlebnissen viel größeres Gewicht gegenüber den geistigen oder geistlichen eingeräumt wird. Gleichzeitig wird im Roman ein exemplarischer Individuationsprozess betont, in dem Hesse zum Ausdruck bringt, dass keinem die Erlösung durch Lehre, sondern nur durch Erleben zuteil wird. Zweitens wird eine Sohn-Episode hinzugefügt, in der die grenzenlose Liebe der Hauptfigur zu ihrem Sohn verdeutlicht wird - was auf die Liebe als der größten Begierde der hiesigen Welt verweist. Im Roman erlernt Siddhartha dabei den Wert des spielerischen Lebens der sogenannten Kindermenschen, der normalen Menschen, schätzen, die er zuvor als wertlos und sinnlos verachtete hatte. Drittens zeigt Siddharthas Erwachen am Fluss das Ideal einer Einheit, in der die Vielheit des Lebens nicht ausgeschlossen, sondern eingeschlossen ist. Gemeinsam liegt diesen Veränderungen zugrunde, dass, anders als bei den altindischen oder buddhistischen Vorlagen, Hesse insbesondere den Erscheinungen und Erlebnissen großes Gewicht einräumt. Insofern stellt die Vollendung Siddharthas bei Hesse nicht eine Lücke im ewigen Kreislaufs von Sansara dar, sondern sie tritt als Ideal der Anerkennung einer pluralen Einheit in Erscheinung. Es handelt sich dabei um Hesses lebenslange Thematisierung der Achtung und des Respekts vor der Vielheit des Lebens.

Legal considerations on the Process of determining the jurisdiction of the reclaimed land under the public waters and the Dispute mediation Choi, Yoon young (Lecturer, University of Seoul , Phd. Law) The procedures for deliberation and resolution of the Central Dispute Mediation Committee are procedures that must be passed in the decision of the local government to which the reclaimed land under the public waters belongs. The system in which the Minister of the Interior and Safety decides the local government to which the landfill site belongs after deliberation and resolution of the Central Dispute Mediation Committee was introduced in the revised Local Autonomy Act on April 1, 2009. This article reviews the overall dispute and decision process of the local government in charge of the landfill site in Nampo District (Busa Tool District) in Chungcheongnam-do, which includes Ungcheon-eup, Jusan-myeon, Seocheon-gun, and Seocheon-gun, Boryeong-si, Chungcheongnam-do. Through this, it was confirmed that the dispute settlement system that can resolve the dispute quickly and fairly so that the right of autonomy is guaranteed with the welfare and stability of the residents as the top priority is valid. The Minister of the Interior and Safety may decide who is responsible for the cost of the landfill site along with a decision on jurisdiction. It seems necessary to estimate that the local government determined as the local government to which the landfill belongs is the cost burden. In addition, The Local Autonomy Act stipulates that a lawsuit may be filed with the Supreme Court against the decision of the Minister of the Interior and Safety on dispute mediation. The litigation on dispute mediation conducted by the Supreme Court is a litigation regarding a decision with disposition, and therefore should be viewed as a subjective litigation. Local governments, which are legal entities with independent legal personality, should be able to contest the dispute resolution decision as a cancellation litigation as stipulated by the Administrative Litigation Act in order to protect their own autonomy. A decision on dispute mediation by the Minister of the Interior and Safety pursuant to a resolution of the Central Dispute Mediation Committee shall be regarded as a disposition subject to an appeal suit. In such a case, the Supreme Court must recognize the appeal against the dispute mediation decision itself. 공유수면 매립지 관할 결정 과정과 분쟁조정에 관한 법적 고찰 「공유수면 관리 및 매립에 관한 법률」에 따른 매립지가 속할 지방자치단체는 지방자치법 제5조 제4항 내지 제11항에 따라 행정안전부장관이 지방자치단체중앙분쟁조정위원회(이하 중앙분쟁조정위원회로 부르기로 한다)의 심의‧의결에 따라 결정한다. 중앙분쟁조정위원회의 심의‧의결 절차는 매립지가 속할 지방자치단체의 결정에 있어서 반드시 거쳐야 하는 절차이다. 매립지가 속할 지방자치단체를 행정안전부장관이 중앙분쟁조정위원회의 심의‧의결을 거쳐 결정하는 제도는 2009년 4월 1일에 개정된 지방자치법에 도입되었다. 이 글은 충남 보령시 웅천읍과 주산면, 서천군 서면 일원을 사업구역으로 하는 충청남도 남포지구(부사공구) 매립지의 관할 지방자치단체의 결정 과정 및 분쟁 전반을 검토하였다. 이를 통해 매립지 결정과정과 분쟁조정과정이 단편적인 소송과는 달리 당사자인 지방자치단체의 의견을 최대한 수렴하고 타협점을 도출하는 과정임을 알 수 있었다. 또한 매립지에 대한 지방자치단체간의 분쟁을 주민의 복리와 안정을 최우선으로 자치권이 보장되도록 신속하고 공정하게 해결할 수 있는 분쟁조정제도는 타당성을 갖는다는 점을 확인하였다. 행정안전부장관은 관할결정과 함께 매립지 비용부담자를 결정할 수 있는데, 매립지 귀속 지방자치단체 결정에 의하여 관할권을 유리하게 가지는 것만으로도 법상‧사실상 이익을 누리게 된다는 점, 특정 매립사무가 국가사무인지 또는 자치사무인의 구별이 언제나 쉬운 일은 아니라는 점을 고려하여, 매립지 귀속 자치단체로 결정된 지방자치단체가 일단 비용부담자로 추정하는 것도 검토할 필요가 있다. 분쟁조정제도는 행정안전부장관의 결정에 대하여 대법원에 소송을 제기함으로써 불복할 수 있는 가능성도 열어두고 있다. 대법원에서 행해지는 불복 소송은 자치권을 갖는 지방자치단체가 처분성을 갖는 분쟁조정결정에 관한 소송이므로 객관적 소송인 기관소송이 아니라 주관적 소송으로 봐야 한다. 중앙분쟁조정위원회의 의결에 따른 행정안전부장관의 분쟁조정결정은 사안에 따라 항고소송의 대상인 처분에 해당하므로, 이러한 경우에 대법원은 분쟁조정결정 자체에 대한 항고소송을 인정하여야 한다. 다시 말해. 독자적인 법인격을 갖는 법주체인 지방자치단체는 자신의 고유한 자치권의 보호를 위해 행정소송법이 정하는 바에 따라 분쟁조정결정을 취소소송으로 다툴 수 있어야 한다. 다만, 경우에 따라 헌법재판소에 권한쟁의심판, 헌법소원을 제기할 수 있는 방안도 필요할 것으로 보인다. 주제어 지방자치단체중앙분쟁조정위원회, 공유수면매립지, 매립지 관할결정, 분쟁조정, 항고소송, 자치권

사회복지적 관점의 성년후견제 도입 의미와 과제

The purpose of this study is to discuss the necessity and the plan of the guardian system with a focus on the social welfare. In Korea, incompetence system under the current civil law is rigid since it can provide two types. they are incompetent and quasi-incompetent. Among possible problems in the aged society, this paper will research the issues concerning social welfare, guardianship. Under such circumstances, this paper aims to review the guardianship system and problems to prevent and suggest some improvements. This study, first, reviewed the problems of current legal system in quasi-incompetence, incompetence, and guardianship system. Second, a guardianship system needs to coordinate legal protection in the property and affairs with social welfare services. Third, it pointed out an adult guardianship system in foreign countries and discussed the introduction and the solution of the system in Korea. In the respects, the guardianship law system in Korea is especially for the disabled and the senior it seems to be one of social welfare service. 성년후견제도는 정신적인 장애 등으로 인하여 판단능력이 불충분한 사람의 재산관리와 신상보호에 관한 제도라 할 수 있지만, 동시에 시민사회 관계를 규율하는 민법상의 제도이면서 더 나아가 사회복지제도 라는 측면이 있다. 성년후견제는 본래 사적인 법적 관계를 규율하는 민법상의 제도이지만, 복지의 영역과도 깊은 관련을 가지고 있어, 일정한 공적 개입과 사회복지계의 관심이 요구된다. 성년후견제는 장애인복지와 인권측면에서 오랫동안 열망해 온 법적 지원 제도로서, 2011년 2월 18일 국회 본 회의에서 금치산 및 한정치산 제도 대신 성년후견제를 도입하는 민법 개정안이 통과되어서 2013년 7월에 시행을 앞두게 되었다. 이에 본 논문은 성년후견제도 도입의 의미와 성공적인 제도 정착을 위한 과제에 대해 사회복지적 관점에서 접근하였다. 성년후견인의 전문성과 관련하여, 성년후견인 양성교육 및 보수교육을 담당할 수 있는 전담기관이 필요하다. 예를 들어, 사회복지사협회 및 사회복지교육협의회, 법무사협회, 기타법인 등을 지정하여 관련된 성년후견인 교육 실시 및 자격 부여가 필요할 것이다. 특히 장애와 노인영역 등 사회복지서비스 일선의 현장 전문가로 알려진 사회복지사에 대한 성년후견제도 보수교육과 전문 양성교육이 요구된다. 본 연구 결과는 우리나라 성년후견제 도입 시행에 따른 의미와 향후 준비과제 적용을 위한 기초 자료로 이용될 것으로 기대한다.

In der Diskussion u¨ber die Gattung des Romans ist die Frage nach dem Individuum und der Indiviudalit¨at von Relevant. In der vorliegenden Arbeit sind $quot;gestaltete Individuen$quot; das Hauptanliegen. Dabei wird das Verha¨ltnis des Protagonisten zu seiner Umgebung, Konftikt und Verso¨hnung, analysiert. Diese werden in den Hegelschen Thesen zum Roman besonders deutlich herausgearbeitet und gelten all Grundmuster ftir den Roman des 19. Jhs.. Zuerst wird untersucht, ob Hegels Ausfu¨hrungen zum Roman auf seinen sozialgeschichtlichen Einsichten basierende, notwendige Schlußfolgerungen sind. Es folgt ein Vergleich mit den spa¨teren Theoretikern des 19. Jhs., Karl Rosenkranz und Friedrich Theodor Vischer. Letztere schließen sich zwar an Hegel an; hinsichtlich der Individualita¨tsproblematik entsteht jedoch eine betra¨htliche Diskrepanz. Das Individuum tritt dabei immer mehr zuru¨ck. Dies zeigt, daß der positive Anspruch des Romans als literarisches Genre mit der Entwicklung der realen bu¨rgerlichen Gesellschaft in Konflikt gera¨t.

Self-healing electronic platform using hydrogel/liquid metal composite

Hydrogel and liquid metal have been emerging as promising candidates for self-healing electronics. Here, a simple fabrication procedure of custom-designed hydrogel-liquid metal composite and its application are demonstrated. Due to their mechanical compatibility, liquid metal is used as electric filler in hydrogel. Hydrogel pattern filled with liquid metal is designed by 3D printed molds. To improve lifetime of hydrogel in ambient condition, several kinds of protective coatings are applied on hydrogel surface. Finally, the hydrogel-liquid metal composite is utilized as self-healable electrodes for customizable multi modular sensors and biosignal detection. The demonstrated hydrogel-liquid metal composite provides an opportunity to realize practical advance in self-healable electronics.

21세기의 새로운 지식, 기술, 능력의 요구에 따라서 새롭게 강조되고 있는 인식론적 프레임(Epistemic Frame)을 컴퓨터를 통해서 학습할 수 있는 교육프로그램에 대한 관심이 높아지고 있다. 그러나 인식론적 프레임의 이론적 모형은 컴 퓨터를 활용한 교육프로그램에 적합하게 적용하기에는 아직 미비하며, 이를 교육할 수 있는 교육프로그램을 설계하기 위한 디자인이 거의 제시되지 않았다. 또한 교육프로그램을 통하여 학습한 내용을 평가할 수 있는 측정이론 혹은 학습분석에 대 한 고찰이 거의 없다. 본 연구는인식론적 프레임의 개념을 학습할 수 있는 컴퓨터를 활용한 교육프로그램의 디지인의 핵심 적 요소를 제시함을 목적으로 하고 교육프로그램을 통하여 학습한 내용을 측정 및 평가할 수 있는 측정이론(학습분석)의 방법을 탐색한다. 이는 추후 컴퓨터를 활용하여 인식론적 프레임 학습과 이를 평가할 수 있는 통합적 교육프로그램 개발을 위한 방법론으로 활용될 것으로 기대된다. There is a growing interest in computer based learning system that can learn a new concept of epistemic frames in response to the demands of 21st century Skills. However, there is little research on the theoretical models for the epistemic frames applicable in the changing educational environment and the measurement theories (Psychometric theory, Learning Analytics) that can be evaluated. Therefore, in this study, we propose the core elements of the learning system prototype that can educate the epistemic frames in the practical community. Furthermore, this study explores and suggests an appropriate psychometric measurement theory (learning analytics) that allows us to measure, infer, and evaluate a learner.
