        1. Now land use is extended to the subsurface room as well as room above the surface of the ground. Especially three-dimensional use of the land for the public work is increasing but law and system are not well established which can correspond to the virtual change in subsurface and air room use. Thus civil petition occurs and this blocks the proceeding of the public work. 2. If the registration for the semi-eternal use of subsurfacd and air room is possible by the nation-development right, the public work will proceed well, the right-relation of land owners will be transparent and the strife in the thansaction of real estate will decrease.

      • 國有財産의 問題點과 改善方案에 관한 硏究

        Our current management law system of the national property was using the law system used colonial period of Japan until the law of national property was revised in 1976. At that time, the law system of the national property was emphasized only on the function selling the national property in order to meet the lack of public revenue. Form 1977 the government set up the plan to manage the national property limited selling the national land, and emphasized the policy for keeping and preserving it. After 1994, the government has expanding the function for use the national property as they have organized the special account for the management of national land, and accepted the trust system to developed the national land. The basic system improvement only in the point of view of the management, plan, and development is asked. With environmental matters rising in 21st century, we need to haute the ability to understand the national property as the environmental source. In this point, the revision about the management system will be accomplished through long period.

      • 수도권 토지이용의 문제점과 개선방안

        The problematic of land use of metropolitan area is suddenly happen to tendency of urbanization in 1960 years. Namely, concentration of population and industry was formed because of leaned upon land use of metropolitan area. This urban problem caused to not only unbalanced development of land space, but also traffic congestion, insufficiency of house problem and real estate, rise of the price of land, environmental pollution, insufficiency of park and green area and crime etc. To keep away these problems was established law of improvement plan of the Metropolitan area. Through this law was regulated land use of metropolitan area. But intensification of regulation of metropolitan area is not advisable through this law. I think, that the supply of the land of city use consequently is increased. That causes to a drop in land expense of the enterprise, and through this way we can raise international competitiveness. With this in mind, it is desirable to use the policy of relaxing of restrictions of land use, for example, policy of use zone, policy of regulation of concentration of metropolitan area and greenbelt etc.

        都市開發法에 의한 換地處分의 問題點과 改善方案

        City Development and Land Readjustment Project was a product of a desire which saw in the project means for improving utilization value of the land under a circumstance of recognizing the need for control over the land from standpoint of public laws for better and systematic utilization of the land to have solution of urban problems following industrialization of the nation. Therefore in this treatise the disposal of replotting for public use has been analysed in terms of its system, implementation and operation in connection with guarantee of private property right because this project is built upon a premise of public restriction of private property right through expropriations etc. For the treatment of the problems as above, this thesis is composed of the sixth chapters as following. The first chapter deals with the necessity, purpose and content of this thesis to survey the disposal of replotting for public use. The second chapter inquire into the characteristics of the disposal of replotting. The third chapter involves the suggestion of the problems about the disposal of replotting for public use and the seek for their improvement. The fourth chapter is a conclusion. The solution okf the problems, there should be sufficient reflex of their opinion as land owners complete themselves the project as much as possible, and the government should try tko stabilize land reduction rate through the financing support. And the operating surplus of the project is distributed to land owners again or reinvested in project land. Accordingly the disposal of replotting for public use should not be treated merely as improving supply of land for housing in urban area it should become a system which assumes a role in policy as well.

        독일 사회적기업 특징 고찰과 시사점

        본 연구는 독일 사회적기업의 특징을 고찰하고 이를 바탕으로 우리나라 사회적기업이 나아가야할 시사점을 제시하고자하였다. 독일사회적기업에대한사례고찰을통해법적ž제도적인부문의특징은다음과같다. 첫째, 독일의 사회적기업은 사회적기업에게 일정한 권한을 부여하는 준공식적인 지위를 갖고 있다는 것이다 둘째, 독일의사회적기업은기업의법적형태는다양한형태로설립과운영이보장되고있다는것이다. 셋째,사 회적기업의 주된 활동은 정규 노동시장 진입이 어려움에 놓여 있는 배제된 집단을 위한 일자리 창출과 노동시 장진입을주된목적을두고있다는것이다. 본연구를통해독일사회적기업의고찰을통해나타난고용정책적 측면에서 특징은 다음과 같다. 첫째, 실업자를흡수하는 대안을 수립하여 노동시장으로 실업자를 유입시키는역 할을 수행하게 하고 있다는 것이다. 둘째, 미숙련의 장기실업자를 위한 재교육과 이를 통해 이들을 노동시장으 로의유입을촉진하기위한사회적기업의창업에초점을두고있다는것이다. 본 연구를 바탕으로 다음과 같은 시사점을 제시하고 하였다. 첫째, 우리나라 사회적기업의 자생력을 확보할 수 있는 법적ž제도적 정비가 요구된다고 할 수 있다. 둘째, 우리나라 사회적기업은 다른사업영역과의채널공 유와이를통한협력적네트워크구축이요구되어진다고판단된다.
