        数字抗疫中的个人信息保护研究

        The rapid development of digital anti-epidemic technology has made the anti-epidemic work reach the scheduling of “one game of chess in the whole country”, and the health management department can “saturate tracking” of potentially dangerous groups, realize regional risk assessment based on individual profiles and on-demand distribution of scarce medical supplies, but there are also information protection issues such as privacy protection, excessive information collection, and user-side privilege plundering. The application and promotion of digital anti-epidemic technology needs to take into account the balance between the consolidation of anti-epidemic effects and the protection of personal information. The implementation of digital anti-epidemic technology is essentially the restriction of public power on private rights. Its legitimacy is not only based on the value choice of prioritizing public health security and public life and health, but also should limit public power within the principle of proportionality. In response to the above problems, this paper attempts to explore three aspects: The first is to construct the application rules of digital anti-epidemic technology; the second is to build a funnel-type personal information protection model; the third is to regulate the black-box operations of user-side privilege plunder, so as to realize the protection of personal information for epidemic prevention and control. 数字抗疫技术的快速发展,使得抗疫工作达到了“全国一盘棋”的调度,卫生管理部门对潜在危险人群能够“饱和式追踪”,实现基于个体侧写的区域风险评估和稀缺医疗物资的按需分配,但也产生了诸如隐私保护、过度信息采集、用户端权限掠夺等信息保护问题。数字抗疫技术的应用与推广需兼顾抗疫成效巩固和个人信息保护之间的平衡。数字抗疫技术的推行本质是公权力对私权利的限制,其正当性不仅建立在优先维护公共卫生安全、公众生命健康的价值选择之上,还应将公权力限制在合乎比例原则程度之内。针对上述问题,本文试图从三个方面进行探索:一是构建数字抗疫技术的应用规则;二是构建漏斗型个人信息保护模型;三是规制用户端权限掠夺的各黑箱操作,从而实现疫情防控的个人信息保护。
