상사중재는 분쟁을 해결하는 중요한 수단이고, 상사중재의 사법감독은 상사 중재제도의 공정성의 필요한 보장이다. 과학적이고 합리적인 사법감독은 상사 중재가 분쟁을 해결할 수 있는 관건적인 요건이다. 중국 현행의 상사중재 사법감도제도의 법률근거는 민사소송법과 중재법인데 두 법률에서 정한 내용이 달라 사법감독의 역할을 저해하고 있다. 상사중재판정의 사법감독을 보완해야 하고 일원화 감독체제를 구축해야 한다. 국내와 섭외중재에 대한 사법감독을 통일해야 하고 절차적인 사항에 대한 감독을 강조하며 ``중재판정의 취소``에 대 한 감독방식을 보완해야 한다. Commercial arbitration is an essential part of dispute settlement process. Judicial supervision in commercial arbitration functions to ensure the impartiality during the process. A structured and proper judicial supervision system is deemed to be a core component to improve the level of arbitration``s effectiveness in settling disputes. However, the current supervision system is conducted under both Civil Procedure Law and Arbitration Law whereby the legislations/regulations are different and not unified. This issue has influenced the effectiveness of supervision. Therefore, the judicial supervision system in commercial arbitration needs to be improved to ensure the system is regulated under a unified environment, especially for judicial supervision in domestic and international arbitration. Further, a supervision system can be established focusing on monitoring procedure process and avoid "In execution of Judgment".
