인터넷 “본인확인제” 조항에 대한 헌법재판소의 위헌결정 연구: 2010헌마47, 252(병합) 결정을 중심으로

인터넷 실명제가 게시판 이용자의 표현의 자유를 사전에 제한하여 의사표현을 위축시키고 그 결과 헌법으로 보호되는 표현까지도 억제함으로써 민주주의의 근간을 이루는 자유로운 여론 형성을 방해하여 청구인의 표현의 자유, 개인정보자기결정권, 언론의 자유 등 기본권을 침해한다는 것이 헌재 결정의 요지이다. 본 연구는 인터넷 ``본인확인제``에 대한 헌법재판소의 위헌결정이 갖는 온라인 표현의 자유 측면에서의 함의를 분석하고자 한다. 구체적으로 인터넷 실명제에 대한 헌재의 결정을 포함하여 헌재가 어떠한 기준을 적용하여 위헌결정에 이르렀는지 살펴보고, 이를 바탕으로 온라인상에서의 표현의 자유에 미치게 될 영향을 연구한다. 익명표현은 국가권력이나 다수의 의견에 대한 비판적 사상이나 의견을 보복의 두려움 없이 표현할 수 있게 하는 표현의 자유의 핵심이다. 실명제가 온라인상의 익명표현으로 인한 폐해를 줄이고자 하는 정당한 목적을 갖고 있다 하더라도 익명표현의 기회를 제한하는 것은, 헌재의 결정에서 볼 수 있는 것처럼, 과잉금지 원칙을 위반하여 헌법상 용인될 수 없다. Korean Constitutional Court ruled that the real-name policy severely chills users` constitutional rights of freedom of expression by forcing them to give up their right to speech anonymously. The Court further said that anonymous expression is guaranteed under the constitutional right of freedom of expression. The policy not only hinders the building of public opinions but also infringes individual`s right to control their personal information, the Court added. The article analyzes the Constitutional Court`s decision and draws a meaning of the ruling with the perspective of online freedom of expression. Particularly, it studies the rationale behind the ruling by examining the standards the Court applied. The study finally attempts to measure the influence of the decision to online freedom of expression in general. As the essence of freedom of expression, anonymous expression allows individuals, especially political minorities, to express critical opinions or thoughts against state power or majority opinions. Even though the real-name policy has a legitimate purpose to reduce harmful consequences in cyberspace steamed from anonymity, the restriction to express anonymously is substantially overbroad and therefore is unconstitutional.
