주택경매시장에서 낙찰가율을 변동시키는 여러 요인을 2011년부터 2015년까지 최근 5년간의 자료를 대상으로 분석하여 향후 부동산경매시장에 참여시 고려해야 할 요소를 제시하고, 주택경매투자자의 합리적인 의사결정을 통하여 투자 수익률을 높이고 주택경매의 안전성을 확보하는데 그 목적이 있다. 2011년부터 2015년까지의 낙찰가율의 추이를 보면 주택의 용도에 따라 최근 낙찰가율이 100%를 넘는 현상도 보이고 있어 경매가 저렴하다는 일반적인 생각을 바꾸게 하는 시점이다. 또한 국민들이 이해할 수 있는 주택정책의 수립도 매우 중요한 요소라고 할 수 있다. 정부는 주택정책이 주택가격에 미치는 영향을 예측하지 못한 것 같으며. 시행 전 충분한 시뮬레이션을 걸쳐 주택정책의 효과성을 여러 가지 측면에서 비교 분석하여 주택정책의 효과를 예측하여야 하는데 전혀 이런 절차를 거치지 않고 있다. 건설업체의 부도율과 폐업 율에 따라 부동산 투자의 흐름도 중요한 결정적인 요인이 될 수 있기 때문에 신중히 고려해야 할 것이며, 건설업체가 부도가 나는 것은 수주금액이 감소하기 때문이다. 수익이 감소되면 점차 경영악화로 연결되어 부도가 발생하게 되고, 그것으로 인하여 건설업체의 부동산 담보물건이 경매시장에 유입되어 경매 낙찰가율을 변화시키는 원인이 된다는 것을 알 수 있다. The purpose of this research is to suggest several elements to be considered in case of participating in the real estate auction in the future by analyzing and arranging several factors varying a successful bid price rate in the house auction, and to raise the return on investment through reasonable decision-making of housing auction investors. When viewing the change of the successful bid price rate from 2007 to 2010, the successful bid price rate is showing a phenomenon exceeding 100% according to usage of housing, so it is a point of time that general thoughts that the auction is cheap should be changed. In addition, it can be said that the establishment of housing policies that people can understand is a very important element as well. It seems that the Government didn t predict response of a people on housing policies, so it should predict the effect of housing policies by comparatively analyzing effectiveness of housing policies through sufficient simulation before its enforcement in several aspects, but it didn t go through these procedures at all. Because the flow of real estate investment according to a default rate and business cessation rate of construction companies could also become an important decisive factor, it should be considered prudently, and the default of construction companies is because its contract amount decreases. If the revenues decreases, it is gradually connected to business aggravation, so the default gets to occur, and then it can be known that as the real estate s collateral goods of construction companies are flown into the auction market, it gets to change the auction s successful bid price rate.

이혼가정이 늘어나면서 미성년 자녀의 복리에 관한 문제는 단순히 미성년자녀의 부모의 문제가 아니라 사회적 문제로 대두되었다. 이혼이라는 당사자간의 계약의 해소의 법적측면과 더불어 미성년자의 양육문제가 가족법의 중요한 과제가 되었다. 2007년 민법 개정의 주요한 법 개정 목적이 부부가 이혼 시 최우선 고려해야 할 사항으로 미성년 자녀의 복리에 관한 문제라고 규정하고 있다는 점은 이를 잘 반영하는 것이라고 할 것이다. 이처럼 이혼에 있어 미성년자녀의 처리문제에 대한 사회적 인식은 높아지고 있으나 현실적 상황은 법적 인식조차 따라 오지 못하고 있다. 미성년자에 대한 양육은 미성년자가 인간으로서 살아갈 수 있도록 기본적 생존권을 보장해야 한다는 것 뿐만 아니라 사회의 구성원으로서 자랄 수 있도록 교육받고 독립적 경제능력을 갖출 수 있도록 배려되어야 한다는 점을 의미한다. 이혼가정에서 미성년자녀의 양육문제를 단순히 이혼시 발생한 채권의 이행확보문제로 접근한다면 이혼가정내 미성년자녀가 합리적 사회구성원으로 성장하는가에 중점을 두기보다는 국가가 미성년자녀의 양육책임을 이혼한 부모에서 귀속시키고 책임을 면책하려하는 것이다. 따라서 본 연구에서는 이혼가정을 위한 양육제도를 미성년자녀의 복리와 사회화라는 목적에서 적정화하고 효율화할 수 있는 방안을 찾고자 하였다. 근래 이혼 후 미성년자녀의 양육을 보장하기 위해 양육비지급과 관련한 문제가 제기되었지만 양육비지급보장만으로 이혼 가정의 미성년자녀 양육이 보장될 수 있다는 사고는 아이들에게 의식주라는 생존적 배려만 해주면 된다는 비인간적 사고가 내재되어 있다. 선진국의 경우 이혼은 배우자관계의 종결만 의미할 뿐 부모관계의 종결을 의미하는 것이 아니므로 공동양육이라는 제도를 도입하여 부모 모두와의 적절한 관계를 유지하도록 하고 있다. 양육비와 관련하여서도 지급강제과 실현되기까지 생존의 배려가 불가능하다는 점에서 국가에 의한 사전지급과 사후추심제도를 고려할 필요가 있다. 또한 양육비지급이후 양육비사용의 적절성을 확보하기 위하여 양육비사용에 대한 확인요구를 인정하여야 하고 비도덕적 양육자변경을 위한 합리적 절차개선이 필요하다. 이러한 업무수행을 법원이 모두 행하는 것이 현실적으로 불가능하므로 종합적인 양육보조기관을 설치할 필요가 있다고 본다. As the number of divorced families increased, the problem of welfare of the minors has resurfaced as not merely a parental problem but a social issue. Divorce, in legal terms of marriage contract annulation and parenting of the minors have become an important task of family law. This well reflects the main purpose of revised civil law in 2007, which prioritizes the welfare for the underage when one gets divorced. The social recognition of processing problems of children is growing but the status quo does not even come along with legal recognition. Nurturing the minors means not only guaranteeing their basic rights to live as human-beings, but also caring their education and economic ability as they could become an independent member of a society. Approaching this problem of child upbringing of divorce simply on division of wealth, the nation could be seen as only trying to exempt parental responsibility for a parent, rather than focusing on child`s development to become a rational social member. Therefore, this study suggests a reasonable and efficient solution of parenting policy of divorced family for the purpose of welfare and socialization of the minors. Recently, after the divorce, the issues on child rearing expenses were brought up but supporting only on child rearing expenses inheres inhumane thinking that child upbringing is only up to provide food, clothing and shelter. In many developed countries, divorce means only the end of marital status and parents take corporate responsibility for the upbringing of their children. Because, it is difficult to provide the basics for the children before the necessary financial support, the nation should implement the pre-financial aid policy, and consider to re-collect the payments afterlife. Furthermore, it is essential to verify such expenses to secure their propriety. The improvement for the system to prevent immoral rearer alteration is also needed. The court is nearly impossible to take care of all these duties. Thus, setting up the communal childcare auxiliary agency is definitely necessary.
