자치경찰위원회의 정치적 중립성 확보 및 민주적 통제 방안 - 개정 경찰법을 중심으로 -

The purpose of this study is to consider examination of democratic legitimacy for municipal committee, ensuring political neutrality and democratic control of municipal committee after general revision of Police Act(‘The Act on Organizational system of National police and autonomous police’) which has enforced autonomous police system. Municipal police committee which was founded as vital organ of korean municipal police system has democratic legitimacy of collegiate administrative agency as affiliated organization for governor of local government, is ensured political neutrality legally. Municipal committee considers and decides policing affairs of local police and is ensured political neutrality e.g. duty of political neutrality, prohibition of power abuse, security of tenure and status. But the scheme of political neutrality’s qurantee is required because imbalance of the authority distribution which includes intervention of national police, absence of authority of direct command supervision to police officer and so on. In the meanwhile, to ensure democratic control over municipal police committee as much as political neutrality, there are acts, e.g. the right of recommendation for municipal police committee and authority of request for reconsideration and system of cotrol system e.g.. administration inspection. But additional democratic is required including element of police control so revision is needed e.g. to strengthen authority of local assembly, resident participation, organization. 본 연구의 목적은 기존의 경찰법이 「국가경찰과 자치경찰의 조직 및 운영에 관 한 법률」로 전부개정됨에 따라 대한민국의 자치경찰제도 도입 및 시행에 따른 자 치경찰위원회의 민주적 정당성 검토, 정치적 중립성 보장 및 민주적 통제 방안의 확보에 관한 고찰이다. 자치경찰제 도입 및 시행과 더불어 한국형 자치경찰제의 가장 중추기관으로서 신설된 자치경찰위원회는 시도지사 소속의 합의제 행정기관으로서 민주적 정당 성을 가지며, 정치적 중립성이 법적·제도적으로 보장된다. 자치경찰위원회는 자 치경찰사무를 심의·의결하는 역할을 담당하고, 자치경찰위원회의 위원의 정치적 중립의무와 권한남용금지, 임기 및 신분 보장 등 정치적 중립성이 보장되어 있다. 그러나 이에 비해 자치경찰위원회가 가지는 권한에 대해 국가경찰이 개입할 가능 성이 높고, 시도경찰청장 등 경찰공무원을 직접적으로 지휘·감독할 수 없는 등 권 한배분의 불균형을 이루고 있으므로 제도의 미비점을 보완하고 자치경찰위원회의 정치적 중립성을 보장하기 위한 방안이 필요하다. 한편 정치적 중립성이 보장되는 만큼 자치경찰위원회에 대한 민주적 통제도 역시 확보되어야 하는바, 개정 경찰법에서는 자치경찰위원회의 추천권, 시도지사 의 재의요구권 등이 규정되어 있고, 지방자치법에서는 행정감사제도 등 기본적인 통제 시스템은 갖추고 있다. 그러나 경찰통제의 기본요소를 포함하는 민주적 통제 방안이 추가로 요청되므로, 지방의회의 권한 강화, 지역주민의 참여 보장, 합의기 구 등 입법 개선이 필요하다.

Schools must pave the way for a brighter future for maladjusted youth, providing them with the support they need to overcome emotional challenges and reach their full potential both academically and in their personal lives.

한국형 자치경찰제에 관한 법률적 검토 : 개정 경찰법 입법발의안과 시행법률의 비교 분석을 중심으로

본 연구는 최근 시행된 ｢국가경찰과 자치경찰의 조직 및 운영에 관한 법률｣에 관한 것으로 개정안과 시행법률의 비교를 통해 일원적 모델인 한국형 자치경찰제에 대한 법적 검토 및 문제점에 대한 고찰을 목적으로 한다. 경찰법이 2021년 1월부터 ｢국가경찰과 자치경찰의 조직 및 운영에 관한 법률｣로 전면개정 및 시행됨에 따라 일원적 자치경찰제가 도입되었다. 코로나19에 따른 예산문제로 본래의 이원적 자치경찰제를 대체하는 일원적 자치경찰제는 경찰조직은 기존과 같이 유지하되, 경찰사무를 국가경찰사무, 수사경찰사무, 자치경찰사무로 구분하고, 각 사무를 국가경찰위원회, 국가수사본부, 시도자치경찰위원회가 지휘 및 감독하는 것을 골자로 하고 있다. 이원화 모델에서 시급하게 일원화 모델로 바뀌어 발의된 후, 유관기관들은 개정안에 대한 해석의 차이와 상이한 요구사항이 드러났다. 발의 이후 개최된 국회 토론회에서는 경찰청과 시도지사협의회, 학계 그리고 직장대표협의회에서 각자의 입장에서 논의하였고, 시행법률에 일부 반영되었다. 시행법률은 자치분권적 측면에서 미흡한 점이 많고, 자치경찰제의 요소가 명확히 드러나지 않는다. 이에 경찰사무분장의 유연성 강화, 수사심의위원회 설치 등 법적 제도적 개선방안을 제시하였다. In this study, I will examine the legal issues and problems of the autonomous police system, comparing amendments and enforcement of the law in The Act on Organizational System of National Police and Autonomous Police (General Revision of Police Act). Since January 2021, the initary autonomous police system has been implemented, and the Police Act has been enforced by general revision. The initary autonomous police system that substitutes a dualistic system requires that the organization of police is maintained and their business is divided into national business, autonomous business, and investigation, commanded and supervised by the National Police Committee, Autonomous Police Committee, and National Office of Investigation. National Police Agency and Governors Association of Korea have differently interpreted the general revision of the Police Act and each requirement following the bill proposal for the change from a dualistic to a unitary autonomous police system. Subsequently, the NPO, the GAOK, police and the Police Labor Union have discussed these issues at the Conference at National Assembly, and its contents is reflected in the enforced Police Act. Enforcement of the Police Act is inadequate for municipal control and does not demonstrate the characteristics of autonomy. Therefore, I present a legal and institutional improvement plan that includes reinforcing police resource distribution and an Investigation Deliberation Commission.

Set in constant increase and period current of lively technical development of railroad use and construction of cable stayed bridge railway bridge, one of bridge form of most suitable that think side police officer and the material enemy of bridge that use long rail, is increasing laying stress on the foreign countries. Main tower fixing department of this cable stayed bridge is consisted of main tower flange that support bearing plate, bay ring plate bearing plate, support end rib and diaphragm etc, as stress transmission mechanic that tensility of cable socket into normal force of main tower, and is used this time. These structural elements is very complex the structure and direction of load delivered from socket specially calbe particularly be different, and need FEM analysis that use Thick Shell element for suitable arrangement of mutual stress flowing grasping and absence that follow hereupon because all of the each support plate angle that suport this differ.
