수용자에 대한 징벌론은 역사적으로 응보적 징벌론, 교육적 징벌론, 회복적 징벌론, 복지적 징벌론으로 개념지울 수 있다. 그러나 수용자에 대한 기존의 징벌관련 법령은 아직도 보안중심의 응보적 징벌론과 가해자 중심의 교육적 징벌의 성격에 그치고 있다. 그리고 수용자에 대한 징벌의 개선방안에 대한 기존의 선행연구들은 거의 모두가 징벌제도의 정당성 등 절차적 측면과 징벌제도의 비인간성 등의 인권적 측면에서 접근 해 오고 있어 회복적 징벌론이나 복지적 징벌론을 간과하고 있다. 따라서 여기에서는 기존의 선행 연구들이 간과한 회복적 징벌론을 사견으로 주장하고 회복적 징벌의 한계와 대안으로서 복지적 징벌론을 개선방안으로 제시하고자 한다. 그전에 기존의 논문처럼 징벌제도의 문제점에 대하여는 절차적 측면과 인권적 측면을 운론하기로 한다. I would like to assert originally the new restorative discipline theory which has a connection with restorative justice and social welfare discipline theory which has relevance to social welfare practice technigue which is contray to retribution penal ideology and educational penal ideology approach. There are four kinds of discipline theory in connection : retributive discipline , educational discipline, restorative discipline theory, social welfare discipline theory. But, existing studies and correctional law have approached in the view of the human rights and procedural legitimacy for the discipline system of prisoners which leaves "victim" and "social welfare approach in discipline" out of consideration. Therefore, a good place to start is to assert in the restorative discipline th대ry which is relevant to victim and social welfare discipline theory with social welfare technical approach which existing studies have passed over about it.

한국에서는 성범죄자에 대한 다양한 공익적인 보안처분이 있어 왔으나 그 기저에는 은밀한 포퓰리즘에 기댄 정치사회적인 이익이 은밀하게 내재되어 왔다.그런 맥락에서 2020년 이후 고위험 성범죄자의 출소를 앞두고 주민의 불안이 제기되자 사건에 대한 전통적인 언론과 선정성이 강한 신생 미디어 등에 의한 경쟁적인 자극적인 보도로 국민들의 불안이 과잉 생산되었다. 이에 중앙 정치엘리트집단은 여당과의 정책소통 속에서 2023년에 공익적 정책이란 명분하에 강력한 보안처분인 미국식 제시카법안을 발표하였다. 이는 급조된 중우정치적인 반위헌적인 형사정책으로 정치적 성격이 매우 강하다. 이러한 급조된 정책에 인권단체에서 법적 측면에서 문제점을 제기하자 정책결정권자들은 입법예고안을 수정하여 2024년1월에 정부가 제정안을 내놓았다. 그러나 정부의 수정안도 여전히 이중처벌논란 등의 문제점이 지적되었다. 수정된 정부안의 특징은 고위험성범죄자의 심리치료 등이 제공될 수 있는 규정이 추가되었다. 동시에 관련 법안으로 정부는 화학적 거세법의 내용을 강화하는 개정안도 내놓았다. 그러나 헌법이 금지하는 신체형과 가족형벌의 성격인 화학적 거세법은 헌법과 법치주의에 대한 은밀한 상징폭력적인 가족형벌임에도 언론과 정치권의 무관심속에 그 본질적 문제점은 한국의 외로운 무인도에 여전히 쓸쓸히 방치되어 왔다. 그런데 한국형 제시카 법안의 문제점은 헌법적, 이념적, 행정적, 경제적, 교정학적 측면, 교정복지 측면, 보호복지 측면, 사법복지 측면, 가족복지 측면, 심리적 측면 등에서 비판될 수 있는 성격임에도 비판론은 법적 측면에서만 접근하는 학제적 한계를 보이고 있다. 따라서 본 논문에서는 한국형 제시카법안이 실시된다면 예상되는 문제점으로 심리적 측면들과 과학화와 계량화로 합리하될 수 있는 한국의 보호관료레짐의 경로의존적 한계를 지적하고 보호복지적 관점에서 방안을 독창적 관점으로 제시한다. In Korea, there has been a divere public security measures against increasing sex offenders and sex crimes until 2022. But, underlying divere public security measures has been a political and social interest and secret populism is deeply embedded in the foundation of divere security measures against increasing sex offenders and sex crimes. Therefore, in that context, competitive sensational reporting by korean media and the more sensational new media, etc has overproduced in unrest in the wake of the residents' anxiety which was raised ahead of the release of high-risk sex offenders until 2020. Korean political elite group with communicated with the ruling part announced-in a loud and splendid manne- in the name of public interest policy the strong security measures called the Korean Jessica bill in 2023. But, this bill is an improvised anti-unconstitutional policy and mobocracy based on the punishment populism of public opinion.The bill has a very political character. Therefore, the human rights group raised the issue on the legal side of security measures called the Korean Jessica bill and in response to their criticism. korean policy makers revised the legislative notice and put it forward by the government in January 2024. But, the Government's amendments are still in place is being criticized for double punishment and so on. The feature of the government's amendments of security measures called the Korean Jessica bill in January 2024 is that regulations that can provide psychological treatment for high-risk offenders have been added. The government with related legislation of the government's amendments of security measures called the Korean Jessica bill also proposed an amendment to strengthen the contents of the Chemical Castration Act. Chemical Castration Act, a characteristic of body and family punishment prohibited by the Constitution is secret symbolic violence against the Constitution and the rule of law in South Korea. But, the essential problem of family punishment which is immanent in Korean chemical castration act against the Constitution remains lonely on a lonely uninhabited land in the indifference of the media and political circles. Although it's an anti-unconstitutional personality that can be criticized in terms of psychology, correctional welfare, economic, judicial welfare, protective welfare and family welfare political and sociological aspects ,judicial welfare and so on, criticisms against the Korean Jessica bill by the Ministry of Justice has an interdisciplinary limit that is approached only from the legal aspect and there is diverse criticism in terms of diverse views. Therefore, I provide an original opinion from a protective welfare perspective after pointing out the psychological aspects, which are expected problem if the Korean Jessica Act is implemented after pointing out the path-dependent limitations of korean protective welfare bureaucratic regime which can be rationalized by scientific and quantification.
