포스트 코로나 시대 한중 옌청 산업단지의 발전방안에 관한 연구

Since established in 2017, the Korea-China (Yancheng) Industrial Park has adhered to the development orientation of "first-class development park and first-class industrial landmark", focusing on automobiles, electronic information, new energy equipment, port-based industries, modern service industries and related industries, forming a new pattern of industrial development with smooth circulation. In recent years, facing the impact of COVID-19, the world economy is on the verge of recession, and international trade and investment have also shrunk sharply. Based on the huge changes in the international economic and political environment in the post-epidemic era, China-South Korea economic and trade cooperation lacks new highlights of strategic cooperation. Meanwhile, the investment industry is relatively single. In order to strengthen economic and trade cooperation between China and South Korea in the post-epidemic era, deepen cooperation and innovation with South Korea, and create a new highland for salt-South Korea cooperation seem necessary to promote the integration of industrial chains, explore the model of combining manufacturing and service industries in the digital field, and highly integrate cultural industries and parks. 21세기 초 학자들은 한중 양국 무역관계의 발전 동향 연구에 중점을 두었고 최근 몇 년 동안 점점 더 많은 학자들이 한중 경제무역 협력 연구에 중점을 두기 시작했다. 한국 학자들은 일반적으로 한국과 중국이 지리적 이점이 뚜렷하여 한중 양국이 질서 있는 경쟁을 벌일 수 있으며 동시에 협력을 강화하고 질서 있는 경쟁에서 각자의 경제 발전을 촉진하고 상호 윈윈을 실현하며 여러 수준에서 상생 발전 제안을 제시하였다. 예를 들어 박승찬(2020)은 AEO-MRA 인증 절차를 간소화하고 통관의 어려움을 줄임으로써 무역원활화를 통해 한중 기업에 차별화된 이익을 제공하고 기술 협력 센터 설립을 통해 기술 교류를 확대하고 일정 규모 이상의 혁신 기업에 대해 브랜드를 공동으로 개발하여 관련 산업 기술 육성을 위한 기반을 마련하였다. 일부 영세기업도 기술협력센터를 통해 정기적·제도적 형태의 기술지원을 받을 수 있다고 주장하였다. 중국 학자인 史耀波(2019)는 한중 양국이 각자의 자원우위를 가지고 있고, 한국은 현저한 기술우위와 자금우위를 가지고 있으며, 중국은 원자재와 노동우위를 가지고 있으며, 한중 양국은 상호보완적인 장점을 취하여 서로 윈윈하는 협력모델을 적극적으로 모색할 수 있다고 제안하였다. 한중 옌청 산업단지 혁신발전연구원의 寇铮·殷凤春(2022)은 "14차 5개년 계획" 기간 동안 한중 옌청 산업단지의 고품질 발전 문제에 대해 "산재성"의 심도 있는 융합, 대남 협력 혁신 심화와 해양 발전 전략 등의 대책을 제안했다. 包振山·殷凤春·寇铮(2022)은 아시아 태평양 자유무역지대 건설의 현실 기반, 발전 기회 및 경로를 분석하고 RCEP이 단지 산업 사슬을 확장하고 단지 기업의 전환 및 업그레이드를 촉진하며 단지의 대외 발전과 투자 유치에 미치는 긍정적인 의미를 연구했다. 한중 학자들은 다양한 수준에서 한중 경제·무역 및 협력 개선을 제안했으며, 옌청은 한중 무역의 중요한 부분일 뿐만 아니라 향후 한중 경제 협력의 중요한 지역이다. 3년간의 코로나19 전염병 발생 후 세계 경제는 새로운 봄을 맞이했으며 한국과 중국은 타고난 지리적 이점을 바탕으로 경제 회복의 물결을 따라 국가 간의 경제 결집과 상호 보완을 목표로 지역 내에서 상품의 자유로운 흐름을 촉진해야 한다. 본 논문은 코로나19, 무역마찰, 자원환경 등 여러 요인이 중첩된 배경에서 한중 쌍방의 무역, 투자, 산업협력의 현황과 기존 문제를 분석하고, 포스트 코로나 시대의 한중 경제무역협력의 환경과 협력 상황을 비교 분석하며, 한중 옌청 산업단지의 발전에서 경제무역협력이 직면한 새로운 기회와 새로운 도전에 대응하여 미래 협력의 새로운 방향과 새로운 협력 촉진 대책을 제안하는 것을 목적으로 한다. 연구방법으로는 한국과 중국의 최신 문헌들을 중심으로 한 문헌연구 방법을 취한다.

본 논문은 신용장 사기의 예방방안 및 구제방안에 대하여 검토하였다. 먼저 신용장 사기의 수입상의 예방방안으로는 신용장 전문 인력의 양성, 계약 체결 전 철저한 신용조사, 적합한 무역 계약서의 작성, 철저한 서류 심사를 진행하여야 한다. 수출상의 예방방안으로는 신용장 전문 인력의 양성, 수입상의 신중한 선택, 개설은행에 대한 철저한 신용조사, 신용장 조항의 엄격한 심사가 필요하다. 은행의 예방방안으로는 전문적인 신용장 업무 부서의 설립 및 관리, UCP 600 규칙의 준수 및 은행원의 윤리교육 강화, 신용장 업무 내용 범위에 따른 위험 수준 등급 평가 및 관리, 은행의 위험 예방 및 통제 능력을 강화하여야 한다. 신용장 사기의 구제방안으로는 국제기구의 구제방안과 각국 법률상의 구제방안으로 나눌 수 있다. 먼저 국제기구인 국제상업회의소는 민간단체이고, 신용장의 사기는 UCP 600에서 규율하지 않고 각국의 법률에 맡긴다는 입장을 취하고 있으므로 구제를 기대하기 어려운 것이 현실이다. 따라서 각국 법률상의 구제방안이 필요한데, 대표적인 것이 가처분(금지명령)이다. 신용장 사기가 확실한 경우 법원에 신용장 대금의 금지를 청구하는 가처분을 신청하여야 한다. This paper examines prevention and relief measures for letter of credit fraud. First, measures to prevent letter of credit fraud include training letter of credit experts, conducting a thorough credit investigation before signing a contract, drafting an appropriate trade contract, and conducting a thorough document review. Export preventive measures require training of letter of credit experts, careful selection of importers, thorough credit investigation of the issuing bank, and strict review of letter of credit provisions. The bank’s preventive measures include establishing and managing a specialized letter of credit department, complying with UCP 600 rules and strengthening ethical education for bankers, evaluating and managing risk levels according to the scope of letter of credit work, and strengthening the bank’s risk prevention and control capabilities. Relief measures for letter of credit fraud can be divided into those provided by international organizations and those provided by the laws of each country. First, the International Chamber of Commerce, an international organization, is a private organization and takes the position that letter of credit fraud is not regulated by UCP 600 and is left to the laws of each country, so it is difficult to expect relief. Therefore, relief measures according to the laws of each country are necessary, a representative example being a provisional injunction(injunction). If letter of credit fraud is confirmed, a provisional injunction to prohibit payment of the letter of credit must be filed with the court.
