        국내 법령상의 유사명칭사용 금지에 관한 분석 연구 ―금융분야 마이데이터를 중심으로―

        In 2020, Korea established its own credit information management business under the Credit Information Use and Protection Act (hereinafter referred to as the Credit Information Act) to advance the regulatory system for credit information-related industries as data industries in the financial sector. However, there is a concern about the exclusive use of the term “My Data” that can be commonly used because the “My Data” industry is defined as the same meaning as the credit information management business in the Credit Information Act. In this paper, we analyzed the differences between MyData in major foreign countries and credit information management business in Korea, and analyzed the prohibition of using similar terms in relation to the ‘MyData’ similar terms prohibited under the Credit Information Act, considering the situation in which policies to promote innovation such as creating and utilizing new values of data. 194 out of over 1,500 domestic laws, established “no use of similar names” regulations and a total of 207 “no use of similar names” clauses were found. 207 regulations on the prohibition of the use of similar names were classified into a total of four. As a result of the usage analysis, it was suggested that legislation improvement should be made when the Credit Information Act restricted the use of MyData as a credit information because MyData is not limited to the financial sector.
