조선 후기 영광 동래정씨의 분산수호와 갈등 ― 영광 동래정씨 산송 사례를 중심으로 ―

산송은 분산을 수호하는 과정에서 수호권이 대립함에 따라 발생한 분쟁이었으며, 그 구체적인 형태는 偸葬 및 禁葬 문제를 중심으로 표출되었다. 시기적으로는 16∼17세기를 전후로 등장하여 18∼19세기에 이르면 사회 전반에 광범위하게 확산되면서 성행했다. 조상의 분묘를 수호하는 양반 사대부가라면 산송을 겪지 않은 집이 없을 정도로 조선 후기 사회를 휩쓸었다. 16세기 말 영광으로 낙남하여 정착한 동래정씨 가문 역시 이러한 시대적 상황을 잘 보여주고 있다. 영광에 세거하고 있는 동래정씨는 竹窓 鄭弘衍(1565∼1639)이라는 인물을 입향조로 모시고 있는 가문이다. 가문을 유지하고 성장시켜 나가기 위해 거주하고 있는 인근 지역에 장두산을 종산으로 형성하여 부계 중심의 종족질서에 따라 분산을 수호해 왔다. 그 과정에서 동래정씨 또한 사회적 변화와 맞물려 잦은 산송과 여러 분쟁에 휘말리게 되었고, 원지에 있는 분산수호가 이러한 분쟁을 증대시키는 결과를 초래하기도 하였다. 그러나 동래정씨는 종법질서와 유교적 이념에 따라 분산을 수호하고 가문을 지키려고 하였다. 이러한 역사적 사실은 동래정씨 가문 소장 고문서 자료에 잘 나타나 있다. 현전하는 동래정씨 소장자료 가운데 산송 및 분쟁과 관련된 사례 55점을 분석해 보았다. 분묘를 수호하는 과정에서 발생한 산송, 위토 분쟁, 묘역의 침탈, 기타 지산사 운영 관련 면역 요청 사례가 포함되어 있었다. 이를 묘지 소송과 갈등, 위토와 묘지기 분쟁, 선조의 실전 묘 찾기와 수호 등 세 가지 유형으로 구분하여 살펴보았다. 동래정씨의 분산수호는 세거지 인근에 위치한 영광의 근지분산과 상주의 원지분산 수호 사례를 함께 엿볼 수 있었다. 그리고 분산을 수호하는 과정에서 여러 가지 사회적 갈등이 어떠한 모습으로 나타났으며 문제가 발생할 때마다 어떻게 대응해 나갔는지에 대해 살펴볼 수 있었다. Sansong, a lawsuit on graveyard, was a dispute from the confrontation of protection right in the course to protect the mountain with graveyard, which was exposed mainly in the matters of secret burial and forbidden burial. It was emerged from the 16<sup>th</sup> to 17<sup>th</sup> century, prevailing in the 18<sup>th</sup> to 19<sup>th</sup> century throughout the society. Sansong was very common in the late Joseon that most of Yang Ban families had experienced to protect the graveyards for ancestors. Dongrae Jung’s family settled in Youngkwang in the late 16<sup>th</sup> century showed the situation of the times well. DongraeJung’s family in Youngkwang was a family to serve Jukchang Jung Hong Yun (1565∼1639) as the first ancestor. To maintain and grow the family, they developed Jangdu mountain near their residence as a family graveyard mountain, protecting it according to the paternal line-oriented family order. Meanwhile, Dongrae Jung’s family experienced multiple times of lawsuits on the graveyard and protection of mountain with graveyard in the original place caused to enhance these disputes. However, Dongrae Jung’s family tried to protect their mountain with graveyard and family according to their family order and Confucian ideology. These historical background was shown in the old documents held by Dongrae Jung’s family.

This is a study on Haeyu document and Haeyu procedure of the Local Governor based on the existing Haeyu documents of the late Joseon period. For the purpose, we have selected complete cases, both in form and content, among more than 100 existing Haeyu documents and identified the form and content of each document. Based on these analyses, we examined how the Haeyu documents were prepared in form and in content. We divided Haeyu procedure of the Local Governor into 5 stages and considered the Haeyu process. Through this study, we were able to confirm that Haeyu documents of the Local Governor during the late Joseon period were handled as a part of document administration in a system that was intended to manage local finance efficiently and to implement responsible administration of bureaucracy on the national level.
조선시대 왕세자문서와 국왕문서의 비교 연구 - 명령문서와 보고문서를 중심으로 -

This paper, by analyzing the orders issued by the crown prince and the documents submitted to the crown prince and comparing them with similar documents issued by and submitted to the king, aims to reveal the characteristics of both kinds of documents and recover the writing styles of the crown prince's documents. The crown prince's documents are what the crown prince directly or indirectly issued or received, vividly showing the feature of the heir apparent of the throne. But, given the characteristics of the crown prince's documents, very few have remained, in contrast to the abundant amount of the king's documents. And, as the former was issued in accordance with the writing styles of the latter, there was no separate writing style for the former. Even if the subject who issued or received the documents was clearly 'the crown prince', the crown prince's documents have existed under the category of the king's documents or the court documents, or in scattered condition without any separate category. Thus, the crown prince's documents have not attracted specific attention. Among what can be categorized as the crown prince's documents, order documents issued by the crown prince and report documents submitted by officials to the crown prince can be said to the empirical cases where we can learn how the crown prince's documents and the king's documents are the same and different in the document administrative system in those days. With the remaining documents of both kinds, this study identified that all the documents the crown prince had issued or received were written and used in the system of the king's documents. That is, while the former applied the writing styles used in the king's documents, they were made with specific terms and titles suitable to the crown price. And, there were some differences in the procedure of issuing, delivering, and receiving documents between the two types of documents.

This paper examines the characteristics and value of ancient documents related to Juknok Yoon Hyo-gwan, which were passed down to Haenam Yoon, who lived in Bodong Village in Gangjin. The total number of data is 560 pieces of ancient documents from 362 types, 93 pieces from 86 types, and 12 pieces from 11 types, a total of 665 pieces from 459 types. The main data is related to Juknok Yoon Hyo-gwan, who served as a civil servant for King Jeongjo and Sunjo, and the rest is related to direct descendants and family management after Yoon Hyo-gwan. The documents from ancient documents, which account for the largest number among them, are very meaningful as empirical data produced during Yoon Hyo-gwan's entry into government offices and his subsequent activities in government offices. In addition, it can be said to be significant in that there are a number of interpersonal data that contain information on various daily lives that appear in the process as well as Yoon Hyo-gwan's personal or social network. In addition, it can be divided into Yeongwol, Chungcheong-do, Jangrakchon, and Gangjin Bodong Village, and it is meaningful in that it provides a glimpse of Yoon Hyo-gwan's life in each region and space and various stories contained in it. In addition, it is even more meaningful because it provides a glimpse of the history and life of the Haenam Yoon family about the compilation of the world and genealogy, funeral culture such as Yoon Hyo-gwan's father's statue and wife's funeral, family members, exemption from miscellaneous duties, and cemetery litigation. The old book data is characterized by the ability to grasp the traces of Yoon Hyo-gwan's study in preparation for the past exams and related examination book data. In addition, various data that Yoon Hyo-gwan referred to in order to fulfill his responsibilities and obligations as a bureaucrat can be identified. It can be said to be very important in that it provides a more specific and empirical glimpse of Yoon Hyo-gwan's life story. 『竹麓遺稿』, a collection of poems written by Yoon Hyo-gwan, is meaningful in that it can grasp not only his major history and life, but also his surroundings and their lives, such as his life, values, ideology and philosophy, and academic competencies. As such, ancient literature materials related to Juknok Yoon Hyo-gwan are of historical value and significance in that they can confirm and understand historical facts of the time. If case studies on major data continue in the future, it is expected that they will contribute greatly to case studies of ancient documents in the Honam region and research on the history of literature and Hyangchon society.
