학교폭력예방 및 대책에 관한 법률에서의 학교폭력예방교육의 문제점과 개선방안

본 논문의 연구목적은 학교폭력예방 및 대책에 관한 법률에서 밝히고 있는 것처럼 입법취지에서 벗어난 예방교육의 문제점이 무엇인지를 찾아보고 그 개선방안을 마련하는데 있다. 구체적으로는 예방교육의 내용상의 문제점과 시행과정에서 그 내용의 불분명성과 해석상의 논란이 될 수 있는 문제와 타당성에 의문이 있는 것들에 대하여 논의와 검토과정을 거쳐 개선방안을 마련하는데 있다. 그동안 정부와 시민단체, 지역사회와 학교에서 학교폭력예방을 위한 다양한 노력에도 불구하고 학교폭력예방 및 대책에 관한 법률 제정과 함께 그 법률의 시행과정에서 교육적 관점, 피해자와 가해자에 대한 조치, 학교폭력의 특수성 등을 고려한 예방과 대책이 좋은 평가를 얻지 못하고 있다. 학교폭력예방교육의 실제를 검토해 본 결과, 첫째, 학교폭력예방 및 법률의 입법취지에 입각한 예방교육의 문제점과 책무성이 강화될 필요성이 있다. 둘째, 청소년 범죄예방을 위한 청소년관련법의 보완과 개정이 요구되고 있다. 셋째, 청소년의 윤리의식을 강화할 필요성이 있다. 넷째, 학교에 설치된 자치위원회는 학교폭력예방과 대책방안을 위하여 전문성과 공정성, 사법적인 권위에 따른 그 실효성을 강화할 필요가 있다. 현실적으로 자치위원회는 예방과 예방을 위한 조치만을 다루고 실제 발생된 학교폭력사건에 대한 처리는 자치위원회가 아닌 시군구 지역단위에 설치된 위원회에서 담당하도록 하는 것이 바람직하다. The purpose of this study is to find out the problems of preventive education which is out of the legislative intent and to prepare the improvement plans, as clarified in the Act on prevention and countermeasures for school violence. Specifically, it is to prepare the improvement plans through discussions and review process about subjects such as problem in content of preventive education, ambiguity of the content in process on enforcement, problem that may be controversial in interpretation, and things are doubtful about validity. Despite various efforts for prevention on school violence between government, civic organizations, local communities, and schools in the meantime, they are not well evaluated even in the enactment of the Act on prevention and countermeasures for school violence and prevention and countermeasures that take account of educational perspectives, measures toward victims and offenders, and specificity of school violence in process of enforcement. As a result of examining the reality of preventive education for school violence, first, it is necessary to strengthen the problems and accountability of preventive education based on the school violence prevention and the legislative intent of the Act. Second, the supplementation and reform of juvenile laws have been required to prevent juvenile delinquency. Third, there is a need to reinforce ethics of adolescents. Fourth, the self-governing committees established in the schools need to strengthen the effectiveness according to professionalism, fairness, and judicial authority for school violence prevention and its countermeasure plans. In reality, it is desirable that the self-governing committees deal only with prevention and measures for prevention, and the actual incidents of school violence should be handled by the committees established at local and regional level.

청소년의 가정폭력 노출경험이 의사소통능력을 매개로 학교폭력 가해행동에 미치는 영향

본 연구의 목적은 가정폭력 노출경험과 의사소통능력이 학교폭력 가해행동에 미치는 영향을 규명하고 가정폭력 노출경험과 학교폭력 가해행동의 관계에서 의사소통능력의 매개효과를 검증하는 것이다. 이와 같은 연구목적을 달성하기 위하여 다음과 같은 연구문제를 설정하였다.(1)가정폭력 노출경험은 학교폭력 가해행동에 어떠한 영향을 미치는가, (2)가정폭력 노출경험은 의사소통능력에 어떠한 영향을 미치는가, (3) 의사소통능력은 학교폭력 가해행동에 어떠한 영향을 미치는가, (4)의사소통능력은 가정폭력 노출경험과 학교폭력 가해행동의 관계를 매개하는가이다.수집된 자료는 SPSS 22.0를 이용하여 조사도구의 타당도와 신뢰도분석,t-test와 ANOVA, 회귀분석, 다중회귀분석에 의해 매개효과 검증, 소벨테스트(sobel test)를 실시하여 매개효과 유의성을 검증하며, 결과와 결론은 다음과 같다.첫째, 부모 간 폭력목격경험 중 언어적·정서적 폭력과 학교폭력가해의 관계에서 의사소통능력이 매개효과를 가지는 것으로 확인되었다. 부부간의 갈등이 생겼을 때 기능적인 의사소통을 통해서 갈등을 해결할 수 있도록 부부 간 의 사소통 향상프로그램이 필요하다. 둘째, 자녀의 폭력피해경험 중 언어적·정서적 폭력에 있어서 청소년들이 둔감화 되어 있거나 일상화 되어 있지 않나 하는 우려를 하게 된다. 이러한 결과를 통하여 청소년의 언어생활과 생활습관 및 인성교육 등 실천적 프로그램이 필요하다. The purpose of this study is to determine the influence of experience exposed to domestic violence and communication skills on school violence behavior and to verify mediating effects of communication skills between experience of domestic violence and communication skills. To achieve the purpose of this study, the followings are the research problems.(1) What influence does experience of domestic violence have on school violence behavior? (2) What influence does experience of domestic violence have on communication skills? (3) What influence does communication skills have on school violence behavior? (4) Does communication skill mediate relationship between experience of domestic violence and school violence behavior? The collected data was verified through validity of research tools,reliability analysis, t-test, AVOVA, regression analysis, and multiple regression analysis using SPSS 22.0 and examined significance of mediating effects by taking Sobel test. The results and the conclusions are as follows.First of all, the communication skills of those who witnessed the violence between their parents have the mediating effects in relationship of verbal,emotional violence, and school violence. The communication enhancement program is needed to resolve conflict between couples through a functional communication. Second, the children’s experience of violence is concerned as verbal and emotional violence between adolescents is being desensitized and generalized. Through these results, the practical programs such as language life, lifestyle of adolescents and personality education are necessary.
