공공건설공사와 관련된 국가계약법은 비록 국가기관이 집행해야 할 계약의 절차, 방법 등 내부규정에 불과하므로 사법에 해당한다는 법리가 강하다는 법리가 오히려 이러한 분위기가 분쟁을 부추 길 수 있다. 그러므로 공공기관이 공기연장 등에 대한 계약지침을 자체적으로 마련시 불가피한 경우를 제외하고 국가계약관련 법규를 벗어나지 않도록 하여야 하고 법규내의 상호 모순 또는 불분명한 사항에 대한 처리방법을 명확히 하여 분쟁발생을 최소화 할 필요가 있다. 공기연장시 간접노무비의 실비정산은 계약당사자가 뿐만 아니라 하도급자가 사용한 간접노무량도 실비에 포함하여 정산하는 것이 합리적인 것으로 판단되므로 공사계약일반조건 등의 실비 지급기준에 하도급 사용분도 포함되는 것임을 명확히 명시할 필요가 있다. 그리고 설계변경으로 인한 공기연장시 간접노무비가 중복 지급될 가능성이 높으므로 공기연장분에 대한 간접노무비는 이에 소요된 실비가 설계변경으로 인해 증액된 간접노무비를 초과할 경우에만 지급하는 방식 등으로 개선하고 이에 합당하게 공사계약일반조건 조건도 보완할 필요가 있다. The law of national contract is strongly legal as it is only internal regulation such as procedures and methods of contract that are to be carried out by national institutions. But This situation could escalate the conflict. When a public institution prepares its own contract guidelines for the extension of the construction deadline, it shall ensure that they do not deviate from the national contract related laws except in inevitable cases. It is deemed reasonable to settle the actual cost of indirect labor when the construction period is extended, including the amount of indirect labor used by the subcontractor in the actual cost. And it is likely that the indirect labor cost will be paid twice when the construction period is extended due to the design change. Therefore, it is desirable that the indirect labor cost for the extension of the construction period be raised only if the expense exceeds the indirect labor cost received by the design change.
