가족을 매개로 한 범죄의 세대전이는 범죄가 특정 가족에 집중되는 현상을 야기하는 주된 원인이 되고, 또한 범죄의 원인 및 예방에 있어서 가족의 중요성을 호소력 있게 보여주는 현상이다. 본 연구에서는 외국의 경험적 연구에서 반복적으로 확인되고 있는, 가족을 통한 범죄의 대물림 현상에 주목하여 이에 대한 이론적 설명과 경험적 검증을 시도하고 있다. 먼저, 부모와 자녀 사이의 전이 현상에 대해 외국의 선행연구에서 밝혀진 범죄전이 실태를 기술하고, 또한 이에 대한 인과적 설명을 시도한 연구들을 검토하였다. 선행연구 검토 결과, 부모자녀 간 범죄의 세대전이는 논란의 여지가 없이 경험적으로 반복 확인되고 있으나 이에 대한 이론적 설명은 아직 만족할 만한 수준에 이르지 못하고 있다. 따라서, 여기서는 이 현상에 대해 유력한 설명논리를 제공하고 있는 자기통제이론(self-control theory)의 시각에서 분석틀을 만들고, 이에 대한 경험적 검증을 시도하였다. 자기통제이론에서는 가족을 통한 범죄 전이 현상을, 자기통제력이 낮은 부모의 경우 자녀를 효과적으로 양육하지 못하고 이로 인해 자녀의 자기통제력을 형성하지 못한 결과로 설명한다. 범죄성이 직접적으로 전이된 결과라기보다는 부모의 낮은 자기통제력이 자녀양육을 통해 자녀의 낮은 자기통제력으로 세대 간 간접 전이된 결과라는 것이다. 이 주장을 경험적으로 검증한 결과, 자기통제력이 낮은 부모(즉, 범죄성이 강한 부모)는 자녀를 효과적으로 양육하지 못하고 그 결과 자녀도 자기통제력이 낮은 것으로 밝혀져, 자기통제이론이 범죄성의 세대전이 현상에도 적용될 수 있는 것으로 나타났다. 자기통제력이 낮은 부모, 즉 범죄성이 강한 부모는 자녀에 대한 애착, 감독을 적절하게 하지 못하고, 그 결과로 자녀의 자기통제력의 낮게 나타났다. 즉, 자녀양육을 매개로 하여 자기통제력의 세대 간 전이가 발생하고 있다. 매개변수로 애착과 감독은 유의한 설명력을 보였으나, 처벌의 적정성은 유의한 영향을 미치지 못하는 것으로 분석되었다. By applying Gottfredson / Hirschi`s general theory of crime(1991), this study tries to explore the mechanism of intergenerational transmission of criminality. The general theory of crime implies that the intergenerational transmission of criminality is the result of inappropriate child-rearing by their parents. To test this familial intergenerational transmission of criminality, existing data set collected from a questionnaire which was administered to 820 middle and high school students in the Seoul metro area were analyzed. Analyses using structural equation models on the process of intergenerational transmission of criminality show that parents with lower self-control tended to have poor child-rearing, and the effect of parental self-control on child`s self-control mediated through child-rearing yielded evidence in support of the self-control theory. Parents with lower levels of self-control were found to engage in inappropriate child-rearing practices, especially lower levels of attachment and low parental supervision. In addition, children with low attachment to and low supervision from their parents showed low levels of self-control. However, parental punishment did not have any significant effect on child`s self-control. These results show that attachment and supervision are the critical conduit of the intergenerational transmission of criminality. This study is expected to make some meaningful contributions to the area of criminology, in that the process of the intergenerational transmission of criminality was investigated empirically. In addition, the results of this study renders evidence to the plausibility of explaining crime an criminality based on the self-control theory.
