한류의 시발점이 텔레비전의 콘텐츠였음에도 불구하고 이에 대한 저작권 인식은 미약하다. 때문에 최근 FIFA와한국방송협회가 월드컵 경기의 퍼블릭뷰잉에 대한 이용료를 요구하면서 촉발된 논란으로 방송재현권에 대한 관심이증폭되고 있는 것은 오히려 다행스러운 일이다. 그러나 방송재현은 우리 법상 ‘공연’에 포섭되어 별도의 특수성이 인정되지 않는바 이는 여러 가지 문제점을 내포한다. 스포츠중계의 권리는 원칙적으로 주최자가 정관 • 계약 등에 의해 취득한다. 선수도 저작인접권으로 보호받을 가능성이 열려 있으며, 방송사업자 역시 공중전달권을 향유하는 경우가 있다. 이들 권리관계는 프랑스의 스포츠법, 브라질의 스타디움권과 같이 개별국가에서 입법적으로 해결되기도 하며, 국제적인 협약을 통해 획정되기도 한다.권리자들의 방송재현에 대해 통제권은 지적재산권의 공공성 ■ 사회기속성에 따라 일정한 제한이 있는바, 대표적으로 비영리 목적의 공연을 들 수 있다. 제한범위의 적용은 국가별로 차이를 보이지만, 우리의 현실은 요건을 충족하기가 매우 어려워 서울광장의 월드컵 응원은 물론, 작은 식당에서 텔레비전을 켜놓는 행위 역시 일일이 관련 권리자들에게 허락을 받아야 한다는 결론에 이르게 된다. 방송재현에 대해 독일, 프랑스, 미국, 스위스 등의 입법례를 참고하여 우리나라도 공연권으로부터 독립된 규정의 신설을 검토해야 할 것이다. 가정 유사범위의 이용에 대해서는 영리성에 관계없이 권리를 제한하고 법정허락을 도입하면서 단일화된 보상창구를 마련하여, 방송재현을 원하는 자는 누구나 용이하게 정당한 이용자가 될 수 있는 시스템이 구축되길 제언한다. Although the starting point of Hallyu(Korean wave) is the contents of the television, the recognition of copyright for those is fragile. Thus, it is rather fortunate that the increase on the right to perform through television signal from the controversy caused by recent demand for public viewing of World Cup games of FIFA and Korean Broadcasters Association. It involves several problems that performing through television signal belongs to performance according the wording in Korean Copyright Act and the Act has not recognized the special character of it. The right to broadcast sports is acquired by promoters statute or contract in principle. It can be possible for athletes to be protected by neighboring rights ; broadcasters can also posses the making available-right. This concern of the rights can be solved legislatively in some countries like the Sports Law in France and the Right of Stadium in Brazil, or demarcated by the international agreements. The copyright owner s absolute right to perform through television signal should be limited by the public interest, the most renowned example of which is the nonprofit performances. Though the applications of the limits differ from country to country, the requisite is hardly satisfied in our current situation and finally the conclusion is that we must get permission of the right owner who may concern, from the street cheering in Seoul Plaza to a television in a shabby pub. Therefore, we suggest building of the system that help those who want to perform through television signal be the justifiable user easily. This system can be built on the basis of followings : firstly, establishment of separate regulations on performing through television signal independent from the performance right, referring legislation examples of Germany, France, United States and Switzerland, and secondly, introduction of compulsory license or of unified system of collecting royalties.
