대지권사용권 성립 전 토지에 설정된 저당권자의 지위 - 집합건물법 제20조의 해석과 관련하여 -

Under the Korean Civil law land and buildings are considered as separate properties. According to the regulation of the ‘Act on Ownership and Management of Condominium Buildings’ (hereinafter referred to as ‘the Act’), however, a sectional owner’s right to use site shall be in accordance with the disposition for the section for exclusive use and a sectional owner may not dispose of the right to use site for the building, separately from the section for exclusive use. Since the section for exclusive use and the right to use site are treated as an inseparable part of the sectional ownership in a condominium building, the mortgage created over the whole land prior to the establishment of the right to use site, shall technically lapse by the enforcement of the mortgage created on the section for exclusive use later. However, when the successful bidder is granted a special auction sale condition on acquiring the mortgage created over the land, the mortgage shall not lapse, but the section for exclusive use and the right to use site shall be separated. In such a case, provided that there is an implied agreement that any correlation between the ratio of the area for exclusive use and the specified section for exclusive use is established due to the publicity, the sectional owner who used a site without the right to use it, shall be bound to return it as unjust enrichment to the person who acquired the ratio of the site for the building. Meanwhile, a prior mortgagee may sell the mortgaged immovable by auction to obtain satisfaction for his claim. In such a case, the creation of a legal superficies for the sectional owner depends on whether the building exists at the time of the creation of the mortgage over the land. 우리 민법은 토지와 건물을 별개의 부동산으로 다루고 있으나 집합건물법 제20조는 ‘대지사용권은 전유부분의 처분에 따르고, 전유부분과 분리하여 대지사용권을 처분할 수 없다’고 규정하고 있다. 이처럼 집합건물에서 전유부분과 대지사용권이 일체불가분으로 다루어지기 때문에 대지사용권이 성립되기 전에 토지 전체에 먼저 설정된 저당권은 나중에 설정된 전유부분 저당권의 실행으로 소멸하는 것이 원칙이다. 이 경우 토지 저당권자는 전유부분의 대지지분에 해당하는 경매대가에서 우선배당을 받을 수 있다. 다만 매수인이 토지 저당권을 인수한다는 특별매각조건이 부가되면 토지 저당권은 소멸하지 않고 전유부분과 대지사용권이 분리될 수 있다. 이 경우 대지지분이 특정 전유부분의 대지권에 해당된다는 것이 충분히 공시되어 상호관련성을 유지하기로 하는 묵시적 합의가 되었다면 대지사용권 없이 대지를 사용한 구분건물소유자는 대지 공유지분을 취득한 사람에게 부당이득을 반환할 의무가 있다. 한편 선순위 토지 저당권자는 자신의 저당권에 기하여 먼저 담보권 실행의 경매신청을 할 수 있다. 그 결과 전유부분과 대지사용권의 일체불가분성이 깨지고 분리된다. 경매절차에서 토지를 취득한 매수인은 전유부분의 소유자에게 구분건물의 철거청구 또는 부당이득반환청구를 할 수 있고 구분소유권 매도청구를 할 수도 있다. 이 때 구분소유자를 위한 법정지상권이 성립하는지 여부는 토지 저당권설정 당시 건물이 존재하였는지 여부에 따라 달라진다.

This report is the result of the basic geologic investigation for the purpose of preparing the long-term development program of the U-jeon Consolidated Coal kline. The Consolidated Coal Mine is located at Gujeol-ri, Wangsan-myeon, Myeongju-gun, and Yucheon-ri, Bug-myeon, Jeongseon-gun, Gan-gweon Province (128$^{\circ}$ 43′10.4"-128$^{\circ}$ 46′10. 4"of east long-ititude, 37$^{\circ}$ 30′-37$^{\circ}$ 33′ of north latitude). This region, the western part of Taebaek mountain range, shows a ragged mountinous feature. Formations of the Pyeongan System of Paleozoic Era are distribu ted in the region with the surrounding Great Limestone Series of Joseon System which covers the south-eastern part of the region. The Pyeongan System is divided into four formations, namely, the Hongjeom, the Sadong, the Gobang and the Hongam, in ascending order. The sadong Formation intercalates several coal beds, and two coal beds out of them are minable. The coal beds are variable in thickness, having the repeated swelled or poket and the pinched parts, which suggest all intense disturbance caused by folding. The heat value of the coal is 5, 500cal. on the average. The total amount of coal reserves of the U-jeon consolidated Coal Mine is estimated at about thirty million metric tons.

Although the weak A antigen in Korean were reported by Won and Lee in 1960, no literature is available on the weak B antigen up to present time. Author found 5 cases of B_(2) antigens, 2 cases of B_(2) group among 19,666 cases of B group (0.01%) and 3 cases of AB_(2) group among 9,814 cases of AB group(0.03%), and one case of AB_(x) antigen in Korean during last 5 years in Seoul. Various tests to prove serological difference between normal B cell and B_(2) cell were done and summerized as follow. 1. It was observed that some antisera of weak agglutination titer react with normal B cells not with B_(2) cells. 2. A significant difference in avidity times was noted between normal B cells and B_(2) cells with antisera of weak agglutination titers. 3. A significant difference in hemagglutination inhibiton titers was observed between normal B cells and B_(2) cells. 4. No significant difference in agglutination inhibition test were noted between normal B cells and B, cells with B and B_(2) saliva respectively. 5. The results of cross matching immunization experiments with rabbits indicated that different antigen did not exist among B and B_(2) cells. 6. B_(2) cells reacted strongly with rabbit serum immunized with human 0 cells though titration score were lower than normal B cells. 7. The first case of AB_(x) blood group was found in Korea and studied serologically. AB_(x) serum had normal Anti-B but no anti-A. The titer of AB_(x) serum were 2 to 8 units against normal B celIs. On the other hand, AB_(x) cells were weakly agglutinated only 3 out of 30 A group sera, but reacted 5 out of 30 0 group sera. Elution test were positive in 2 anti-B sera among 10 cases, but were positive in 4 anti-AB sera among 10 cases.
