화학사고시 토양오염 사전관리제도 도입을 위한 국내외 제도 분석 및 시사점

Although a number of chemical accidents have been occurred in South Korea, the effective prevention act for soil contamination has not been established so far. To effectively protect soil contamination from chemical accidents, decision support laws and regulations are absolutely essential. Regarding this situation, this study was aimed at diagnosing problems in current chemical safety management and prevention and response system against chemical accidents through analyzing the domestic and foreign causes of chemical accidents and the accident response procedures and finally suggesting policy measures for solving those problems. In order to clarify management of soil contamination by chemical accident, this study suggests the establishment of chemical accident preparedness, response, and making of local chemical management law and policy. This law needs to be supported by a clear management framework to guide government officials and all other stakeholders in the management of soil contamination by chemical accident.

Land contamination has emerged as a major environmental and land management issue over the last decade. Although the importance of contaminated land management was continuously increased and many developed countries tried to make advanced contaminated land register system, current Korea soil regulations and policies have not been considered yet. This study analyzed existing or developing contaminated land register system from various countries to suggest implications of environmental decision support. Through this study, the introduction of contaminated land management system as creating a new system in Korea needs to considerable review to the following in order to achieve the objective through a effective adoption and operation (1) we need to establish contaminated land register system by providing a proper legal basis before the imposition of data collection, investigation, and management, (2) sufficient examination is required to identify scope of information disclosure and criteria, contents, and subjects of items from contaminated land register system.
토양 반입 부지의 합리적 관리방안 마련을 위한 정책적 고찰

국내에서는 국토개발 목적으로 토양을 반입하고 잔토 및 사토 처리를 위해 토양을 반출하고 있으나, 토양오염에 대한 고려 없이 특정 부지로 토양이 반입되고 있는 실정이다. 이에 본 연구는 토양의 이동으로 인한 오염 확산을 방지하고 오염발생 부지에서의 정화책임을 명확하게 하기 위한 목적으로, 국내 반입토양 관리 현황을 살펴보고 국외 관련 제도를 분석하여 국내에서 토양 반입 부지의 관리체계를 효율적으로 운영하기 위한 방안을 고찰하였다. 본 연구에서는 반입되는 토양의 합리적인 이동 관리체계를 마련하기 위한 방안으로 자율적 규제, 의무적 규제, 단계적 규제를 제안하였다. 향후 국내에서 토양 반입부지에 대한 명확하고 합리적인 관리체계를 성립하기 위해서는 본 연구에서 제안한 것과 같이 현재 토양환경보전법이 가지고 있는 법·제도적 한계점을 개선하여 토양 반입 부지에 대한 규제 및 지침을 빠른 시일 내에 보완해야 할 필요성이 있다. In Korea, soil is being transported in and taken out for the purpose of national land development, but the soil is being moved without consideration of soil contamination. Therefore, this is a policy-focused study of the management system on soil moving. In this study, we analyzed current state of domestic and foreign management and suggested three alternatives for management of soil moving in 1) self-regulation, 2) obligatory regulation, 3) phase-in according to types of regulation. In order to establish a clear and reasonable management system for soil movement in the future, it is necessary to improve the legal and institutional limitations of the current soil environmental law as suggested by this study.

Many improper development action were performed at subsurface environment, because there were not any definition about subsurface environment in Korea. The purpose of this study was to establich a definition on subsurface environment. Subsurface environment could be divided by subsurface natural environment and subsurface living environment. The soil, groundwater, ecosystems, landscapes, underground space (naturally occurred) were included in subsurface natural environment. And space and facilities used by human were classified as subsurface living environment.

Many legislations have been implemented in order to manage the subsurface environment in Korea. However, there was no control tools for managing subsurface environment so effectively. In this study, many laws and regulations were analyzed for extracting Korean subsurface environment management plan. Korean government need to 1) establish the basic paradigm for building the subsurface space, 2) establish the clear subsurface environment management systems, 3) establish the regulations related with subsurface space compensation, 4) prepare the human health and ecosystem related legislations.
