기부채납은 행정행위의 부관으로 부과되는 기부채납과 행정청의 반대급부가 있는 기부 채납으로 분류된다. 이 두 가지 유형의 기부채납은 기부채납자의 의사에 따라 행정청이 그 목적물의 소유권을 취득하는 형태로 나타나지만 실제적으로는 이에 반대급부로 행정청의 허가가 발령되거나 해당목적물의 사용권을 취득하는 등의 일정한 대가성을 전제로 하는 것이다. 기부채납 행위는 계약의 형태로 이루어지고 있으나 이에 대한 민사법적 측면의 검토는 이루어지고 있지 않다. 판례도 기부채납 상의 대가성은 인정하지 않고 기부채납의 법적 성질을 증여로 보고 있다. 본문에서는 분류된 기부채납의 유형에 따라 그 법적 성질을 검토하고 그에 따른 효과에 대하여 고찰하였다. 행정행위의 부관으로 부과되는 기부채납은 행정청과 기부채납자가 서로에게 부담의 의무를 지는 부담부 증여로, 행정청의 반대급부가 있는 기부채납은 기부채납자가 일의 완성으로 목적물을 건축하여 행정청에게 소유권을 이전하는 것으로 인도하고 행정청은 이에 대한 보수로서 목적물의 사용권을 지급하는 도급계약의 유형으로 보아야 한다. 그러나 기부채납 계약의 당사자가 사인과 행정청이라는 점, 행정행위의 부관으로 부과되는 기부채납의 경우는 기부채납의 목적물이 공공의 이익을 위한 사회기반시설이라는 점, 행정청의 반대급부가 있는 기부채납의 경우는 기부채납의 목적물이 건축물이라는 점 등의 특수성을 인정하여야 할 것이다. 이러한 점을 감안하여 기부채납의 특수성에 따라 그 효과를 고찰하였다. 기부채납은 지방자치단체의 공유재산 확충에 큰 역할을 하고 있다. 이전에는 행정행위의 부관으로 부과되는 기부채납이 주를 이루었으나 요즘은 행정청의 반대급부가 있는 기부채납이 점점 늘어나고 있는 추세이다. 기부채납의 증가에 따라 그에 대한 분쟁도 많아지고 있다. 이러한 분쟁의 해결을 위해서는 기부채납의 특수성을 인정하여 새로운 계약의 형태로 법제화하여야 할 것이다. In addition, The precedent takes the character of the contribution acceptance be a donation without value characteristics. In the body, depending on the type of classified contributed acceptance review the legal nature and effects were studied accordingly. I consider that, The contributed acceptance imposed by the form of nebenbestimmung of administrative actions is conditional donation, The contributed acceptance with return consideration should be recognized as the type of contracts since donors acquire the usufruct just after the construction of the facilities and administrative agency receives the ownership about the those. However, there are the points to be specially considered. The first, contracting parties at contributed acceptance are administrative agency and private person, The second, the facilities of contributed acceptance imposed by the nebenbestimmung could be use infrastructure for the public interests. The third, the facilities of contributed acceptance with return consideration are structure. Given the specificity of these consideration depending upon the contributed acceptance examined. The contributed acceptane has greatly contributed to expand the property of the local government. In past days, the contributed acceptane as government restricted policy provide most of it, but nowadays the contributed acceptane with return service is on the increase, As contributed acceptane increases, the dispute of it grow, It is necessary to study of civil law review on contributed acceptane for resolve the dispute about it.

The real rights are the exclusive rights. therefore, it is necessary to recognize the existence of right by the third party with a special method or system. It is the system of real estate registration that mankind has devised as the method of public notification like that. nevertheless current the state of real estate as the subject of right actually depends on the entry alone in cadaster, forest land ledger and house ledger. Genernally the public notification system of real estate means two kinds of part. One is a sort of registers such as cadaster, forest land ledger and house ledger which represent physical and tangible part, and the other is the system of registration which represent physical and tangible part such as proprietary right and the changing relation of right. Proceeding to the high level of industrial society, however, current society show variety of changes in which government notifies on real estate is connected not only with legal and factual relations, but also with all sorts of regulative laws. These changes are thought to be the result from legistrative measures for harmonizing the protection of privative property right with the promotion of social welfare which radically become influential in contemporary state. There are some problems in the system of the real estate management in the case that government notifies in public ledger to the same real estate is substantially inconsistent with its present condition, since government notifies to the same real estate is restricted by the different competent authorities as well as by the law enacted by different aims of. This thesis has two main objectives. first, it provides the problems of the cadaster and the register due to application forms respectively. second, thesis reviews response on solving the problems as a simplification. 물권은 배타적 지배권이다. 따라서 물권에 대한 거래의 안전과 신속을 확보하기 위해서는 물권공시제도의 확립이 필요하다. 이러한 공시제도의 일종으로서 부동산을 공시하는 제도가 부동산등기제도이다. 부동산등기제도란 국가기관이 소정의 절차를 밟아서 등기부라고 불리는 공적장부에 부동산에 관한 일정한 권리관계를 기재하는 것이다. 그런데 등 기제도가 그 본래의 기능을 다하려면 무엇보다도 등기의 객체인 토지를 특정할 필요가 있다. 즉 토지의 유형적, 물리적 측면의 실체관계의 공시가 필요하게 된다. 이러한 실체관계의 공시제도가 지적제도로서 토지의 물리적, 유형적 측면의 실체관계가 지적공부상의 기록과 부합하게 하는 것을 목적으로 한다. 우리나라의 토지공시제도는 이와 같이 등기제도와 지적제도로 분류할 수 있다. 그러나 지적과 등기는 각각 토지표시사항, 즉 물권객체와 소유권 및 기타 권리인 물권주체를 공시하는 상호의존관계에 있고 지적공부와 등기부의 상당부분이 중복등록 되고 있으며 관장기관도 각기 다른 법률 체계 하에 안전행정부와 사법부에서 별도 처리한다. 따라서 등기의 불일치 사항이 생기고 국민적 불편과 부담, 행정적 낭비 등 많은 문제가 야기된다. 그러므로 본문에서는 토지공시제도의 이중화로 인한 공시사항의 중복과 공부상의 내용과 실체상의 내용의 불부합을 방지하기 위하여 대장과 등기를 일원화 하는 방안을 강구하는 것을 목적으로 하고 있다. 이를 위하여 우리나라의 토지공시제도를 검토하여 대장과 등기의 이원화되어 있는 토지공시제도의 문제점과 그 해결방안을 제시하고자 한다.
