본 연구는 2004년 제정된 주민투표법을 중심으로 그 제도적 가치와 문제점, 그리고 주민투표제도의 도입 전후에 몇 차례 실시 된 주민투표사례를 통하여 주민투표제토의 운영상의 문제점을 살펴보고 주민투표제도가 바람직하게 운영될 수 있기 위한 방안을 제시하였다. 주민투표제도는 지방자치제도가 제대로 운영되기 위한 가장 중요한 주민참여제도 중의 하나로서 중요한 의의를 가지지만 잘못 운영되는 경우에는 오히려 지방자치의 장애물로 전락될 수도 있음을 사례로 통하여 관찰할 수 있었다. 지방자치제도가 정착화되면 주민투표제도의 중요성이 더욱 증가할 것임은 틀림없지만 본 연구는 주민투표제도가 정착하기엔 아직 많은 문제점이 있다는 것을 발견하였다. 정보부족으로 인한 주민의 비합리적 선택은 혼란을 증폭시키거나 중앙정부와 지방정부, 지방정부와 지방정부간, 지역주민과 주민간의 갈등을 더욱 심화 시킬 수 있다는 점에서 앞으로 불합리한 법적, 제도적 문제점들은 계속적으로 수정·보완되어야 할 것이다. The purpose of this study was to suggest the proper improvement plans to operate referendum system through the analysis of referendum cases after the passage of referendum law of 2004. Referendum is one of the most important citizen participation system for the proper operation of local autonomy system. However, this study found it hinders rather than help local autonomy if system is operated inappropriately. The importance of referendum system will increase as local autonomy becomes more stabilized, but this study found there still remain many problems the local autonomy to be stabilized. In the respect that irrational selection of the citizens from the lack of proper information can either lead or deepen confusion or conflict between the central government and local governments, among the local governments, and among the local residents, there needs a constant amendment and supplement of irrational legal and institutional problems.
