지하공간 활용의 권리보완을 위한 제도적 개선에 관한 연구 - 한계심도 초과 토지를 중심으로 -

도시화 및 산업화가 발달하면서 한정된 토지를 입체적으로 이용하고자 하는 필요성이 점점 대두되고 있다. 특히 수도권의 교통난을 해소하기 위하여 경기도가 GTX(Great Train Express, 광역급행철도) 건설계획을 발표하면서 이에 따른 지하공간 활용논의가 활발해지고 있다. 현행 지하공간 보상은 "도시철도 건설을 위한 지하부분 토지의 사용에 따른 보상기준에 관한 조례"에 의한 보상기준에 의거하여 산정하고 있으나, 입체적 권리에 대하여 완전한 권리보호가 어려운 점이 있다. 이에 본 연구에서는 토지소유권이 미치는 지하공간의 효력범위를 설정하는 구분지상권 및 사용재결 이용 현황을 검토하고 지하공간 활용에 따른 보상기준에 관한 쟁점을 분석하여 지하공간 활용의 권리보완을 위한 개선방안을 제시하였다. As urbanization and industrialization develops, the necessity of utilizing scarce land in three dimensions is raising. The issue of utilizing underground space is being actively discussed particularly when Geyeonggi-do announced GTX(Great Train Express) construction plan which aims to relieve traffic congestion in metropolitan areas. The current regulation on compensation of underground space is based on "Regulations on compensation standard complied by using underground space for construction of urban railway" but it is difficult for covering the whole rights to protect a three-dimensional right. In this context, the study is to propose the improvement plans of land right's problem and compensation issues to utilization of underground space for the right complementary. To do this, the study reviews the use situation of the classification surface right and using adjudication which defines the effect scope of underground space extending land ownership. As well as it analyzes issues about compensation standard for utilizing of underground space.

지적분야 NCS 개선에 관한 연구

현 정부는 국가직무능력표준(NCS)을 국정과제로 채택하고 학벌과 자격중심의 사회에서 능력중심 사회로 변모를 꾀하고 있다. 현행 지적분야의 NCS는 측량, 공간정보구축과 함께 분류체계상 세분류에 속해 있어 지적행정, 지적측량, 국토조사 등 다양한 내용들을 다루기는 한계가 있다. 이에 본 연구는 지적분야의 NCS에 대한 현황 파악 및 문제점을 검토하고 그에 대한 개선방안으로 현행 국가직무능력표준 분류체계 개선, 지적분야 산업체와의 연계를 통한 실습모델 도입, NCS의 수준별 능력단위 및 능력단위 요소를 기반으로 하는 교과과정 개발, NCS 개발진과 학습모듈 집필진의 일원화 등 개선방안을 제시하였다. The Korean government strives to transform the society from one that stresses academic and qualification to one that stresses individual competencies. National Competency Standards(NCS) has been adopted to this end. However, NCS classifies cadastre into a group with survey and spatial information collection. Such classification limits cadastre to encompass cadastral administration, cadastral survey, geospatial survey, etc. This study reviews current status and implications of NCS, and proposes few solutions: improvement of classification system, introduction of cadastral industry cooperation model, curriculum development based on competency level, unification between NCS developer and learning module writing group, etc.

지적분야 과정평가모형 구축에 관한 연구

The current government strives to train those supposed to drive the national economy, and bridge the gap between qualification and industrial sites through competency-based qualification systems, not the educational background. In this regards, the government is planning to adopt the course evaluation qualification system. The course evaluation qualification system, on a basis of the NCS, is a system to qualify certain people completing the education and training fulling a specific requirement for a national technical qualification in case they meet the internally and externally assessed criteria. This can be seen as an attempt to practically link between job training and qualifications. The NCS model and learning module in the cadastral field are already utilized as the training and eduction in the specialized school and colleges. However, the current national technical qualification system is considered as a main system because the course evaluation qualification system has not been introduced yet. This study analyzed the process of the course evaluation qualification system, and conducted a survey to solicit feedback on introduction of course evaluation qualification system, Besides, the NCS evaluation model is presented in order for the introduction of course evaluation qualification system in the cadastral fields. 현 정부는 미래 국가 경쟁을 이끌어 나갈 인재를 양성하고 학벌이 아닌 능력중심의 자격제도 개편을 통하여 자격과 산업현장을 일치시키려는 노력을 하고 있으며, 그 일환으로 과정평가형 자격제도 도입을 추진하고 있다. 과정평가형 자격제도는 국가직무능력표준(NCS)에 기반하여 일정 요건을 충족하는 교육 훈련과정을 이수하고 내,외부 평가를 거쳐 합격기준에 해당하는 경우, 국가기술자격을 부여하는 제도로 직업교육과 자격을 본격적으로 연계하기 위한 시도라고 할 수 있다. 지적분야의 NCS 및 학습모듈은 이미 특성화고등학교 및 전문대학에서 교육 훈련에 활용되고 있으나, 지적분야와 관련하여서는 아직까지 과정평가형 자격제도가 도입되지 않아 현행 국가기술자격검정을 통하여 자격을 취득할 수밖에 없는 실정이다. 본 연구는 과정평가형 자격제도를 면밀히 분석하고, 지적분야 과정평가형 자격제도 도입에 대한 의견을 수렴하기 위하여 설문조사를 실시하였으며, 과정평가형 자격제도 도입을 위한 NCS 평가모형을 제시하였다.

지적분야 과정평가형 자격제도 개선에 관한 연구

The government is operating a course evaluation-type qualification system for the purpose of overcoming the limitations of the test-type qualification system and cultivating talents with practical skills applicable to related industries. However, there is a part that does not match the purpose of the course evaluation qualification system by educating competency units in the field of surveying rather than the field of cadastral field in the education and training course of the course evaluation qualification. Therefore, this study closely analyzed the course evaluation qualification system in the cadastral field and suggested improvement plans accordingly. First, NCS in the cadastral field has not been supplemented or developed since its development in 2014, and there are many parts that do not conform to the current laws, so supplementary development is necessary. Second, It was proposed to improve the optional competency unit in the field of surveying to the NCS competency unit in the cadastral field. In addition, if the 12 competency units of the current NCS in the cadastral field are designated as essential competency units and education and training are operated, it will be possible to foster working-level talents with sufficient competency at the cadastral engineer level. However, for practical system operation and application, supplementation and development of NCS in the cadastral field, which is used for education and training of the course evaluation qualification system, must be preceded. 정부는 검정형 자격제도의 한계를 극복하고 관련 산업계에 적용가능한 실무능력 인재 양성을 목적으로 과정평가형 자격제도를 운영하고 있으며, 지적분야도 지적산업기사 등급의 과정평가형 자격제도를 운영중에 있다. 그러나 과정평가형자격의 교육훈련과정에 지적분야가 아닌 측량분야의 능력단위를 교육함으로서 과정평가형 자격제도의 취지와 맞지 않는 부분이 있다. 따라서 본 연구는 지적분야의 과정평가형 자격제도를 면밀히 분석하고 그에 따른 개선방안을 제시하였다. 첫째, 지적분야의 NCS는 2014년 개발이후 별다른 보완·개발이 이루어지지 않아 현행 법령과 맞지 않는 부분이 다수 존재하므로 이에 대한 보완개발이 필요하며, 둘째, 현행 지적분야 과정평가형 자격제도에 활용하고 있는 측량분야의 선택능력단위를 지적분야의 NCS 능력단위로 개선할 것을 제안하였다. 또한 현행 지적분야의 NCS의 12개 능력단위를 필수능력단위로 지정하고 교육·훈련을 운영한다면 충분히 지적기사 등급의 역량을 갖춘 실무인재를 양성할 수 있을 것이므로 지적기사 등급의 과정평가형 자격제도 도입을 제안하였다. 그러나 실질적인 제도운영 및 적용을 위해서는 과정평가형 자격제도 교육·훈련에 활용되고 있는 지적분야 NCS의 보완·개발이 반드시 선행되어야 할 것이다.
