        There are many overseas market research methods that exporting companies are using. Overseas market research methods is classified into a direct methods(direct visit research, use of overseas branch, use of domestic economic and trade informations, use of overseas economic and trade information, use of economic and trade informations of foreign public organization in Korea, representation of trade show and exhibition) and indirect methods(request of professional overseas market research organization). Outcomes of market research are the grasp of demand, competitiveness, distribution channel, risk and buyer for their product. Therefore, this paper is a study on the outcome of each direct market research method that exporting companies located in the area of Taegu and Kyeongbuk are using by way of a survey.

      • 무역기업의 전자적 FSC시스템의 문제점과 활성화 방안

        본 논문은 전자무역결제시스템으로써 연구되어왔던 Tradecard, Bolero, Identrus를 무역기업의 전자적 FSC(Financial Supply Chain; 금융공급체인)시스템의 관점에서 재정의하고, 무역기업이 이러한 전자적 FSC시스템을 도입하는 경우 발생하는 비용절감 및 프로세스 효율증대 등의 기대효과에 대해 살펴보고, 현재 서비스 되고 있는 전자무역결제시스템들을 전자적 FSC 시스템으로서의 효율성을 살펴본 후, 이러한 연구를 바탕으로 현재 우리나라 무역 환경적 측면과 각 시스템 측면에서의 문제점 및 그에 따르는 개선방안을 제시해 무역기업의 전자적 FSC 시스템의 활성화방안을 제시하고 있다.

        위조상품이 거래된 온라인 오픈마켓 운영자의 상표권 침해 책임에 관한 사례 연구

        온라인 오픈마켓에서 위조상품 거래는 다양한 형태의 지식재산권(상표권, 저작권, 특허권 등)을 침해하게 된다. 현재 전세계적으로 유명브랜드의 제조업체들이 자사 유명 브랜드 제품의 위조상품이 온라인 오픈마켓에서 유통됨으로 상표권 침해나 부정경쟁행위로 인하여 심각한 손실을 입고 있다고 주장하면서 온라인 오픈마켓 서비스 운영자들을 피고로 여러 국가들의 법원에 많은 소송을 제기하여 최근 판결들이 내려지고 있는데, 국가의 법원에 따라서 그리고 일국 내의 동일법원에서도 다른 판결들이 내려지고 있는 현실이다. 따라서 본 연구는 온라인 오픈마켓에서 위조상품의 거래와 관련하여 그러한 오픈마켓 운영자들은 상표권 침해나 부정경쟁행위 그리고 불법행위의 책임을 부담할 수 있는데, 최근의 각국 법원들의 판례들을 비교분석하고, 결론으로써 법률적 쟁점에 대한 견해를 제시하고 또한 온라인 오픈마켓의 운영자에 대한 시사점을 제시하고 있다. Now, many a counterfeit goods have been transacted on Online Open Market. This have caused litigations of the trademark right infringement brought by owners of famous brands against Online Open Market Service Providers as an electronic commerce intermediary distributor(ECID). Online Open Market Service Providers can have legal liabilities of trademark right infringement or illegal act. In recent months, courts in the U.S., Korea and Europe have handed down rulings on the issue of Online Open Market Service Provider’s liability for the sale of counterfeit goods via its on-line marketplace. By the way, the decisions in these cases have placed different liabilities on Online Open Market Service Providers from country to country. So, this paper is to research comparatively on recent case-law in U.S., Korea, France, Belgium and Germany and find different points between them, and give some suggestions for Online Open Market Service Providers to protect for themselves from litigations of trademark right infringement.

        전제주의적 법전통의 기원과 법치주의

        Accepting the eastern christianity from the Byzantine Empire, the medieval Russia imported the Roman law as a part of the byzantine cultural heritages. The aim of this paper is to elucidate the influence that the imported Roman law had on legal developments of the medieval Russia. Separate legal norms of the "Corpus iuris civilis", the most important source of the Roman law in the Byzantine Empire, were translated into the Church-Slavic and imported through church organizations which had been the main import channel of the byzantine culture at that time. In secular customary laws of Russia such as the "Russkaia Pravda" or princely statutes one could discern legal norms that might be influenced by the Roman law imported from Byzantium. These include norms concerning privileges of the church and related to the jurisdiction of church courts. i.e. church income, crimes against the church, marriage, inheritance etc. It is a widespread view that the imported Roman law exerted a certain influence on legal developments of the medieval Russia. There exist, however, skeptic opinions which insist on the non-applicability of the church-slavic Roman law, Combined with the eastern christianity the imported Roman law was understood as "sacred" and therefore could not be applied to actual legal decisions. This was the distinct pattern of legal developments in comparison with the "reception of the Roman Law" in the medieval Western Europe. In the Western Europe of the 11./12. centuries the "dualism" of canonical and secular legal systems based on the newly established social and political pluralism after the "Investiturstreit" (1075-1122) required a rationalization and systematization of the law. The reception of the Roman law which could splendidly meet this request facilitated the development of the "rule of law" in the Western Europe. On the contrary, the medieval Russia which had been isolated from the historical events in the Roman Catholic world and had inherited the despotic "Caesaro-Papism" from the Byzantine Empire developed only an autocratic legal tradition incompatible with the "rule of law".

        우리나라에 있어서 중소기업에 대한 무역금융으로서 국제팩토링의 발전방안에 관한 연구

          For many companies, selling in an international market place is the ultimate challenge. One of the greatest problems facing exporters is the increasing insistence by importers that trade be conducted on open account terms. This often means that payment is received many weeks or even months after delivery. Unsurprisingly, many organisations find that giving buyers credit in this way can cause severe cash flow problems. Further problems can arise if the importer delays payment beyond originally agreed terms or makes no payment at all because of financial failure.<BR>  In particular, many SMEs find it difficult to finance their production cycle, since after goods are delivered most buyers demand 30 to 90 days to pay. Therefore, International factoring for SME has been developing very rapidly in the world trade financing markets. Functions of international factoring as trade financing is a comprehensive financial service that includes credit protection, accounts receivable bookkeeping, collection services and financing. Factoring can be a powerful tool in providing financing to high-risk, informationally opaque sellers. International factoring is very helpful for international exporters to get competitiveness in the world markets.<BR>  In Korea, a few banks are operating international factoring. But International factoring in Korea could not play a key roll as general trade supporting service. So, This study is to suggest importances of international factoring development for trade development and to investigate real operation situations and problems by way of interviews with operators in banks that are operating international factoring and suggest development strategies for international factoring in Korea.

        영미법상 물품매매계약에서 인도기간에 대한 연구

        Contracts for sale of goods have many terms and conditions. However, all terms and conditions do not have the same consequences when they are violated. In the creation of a contract, time of delivery or shipment may be fixed or not fixed as agreed between the parties to the contract. CISG or national laws have a little bit of difference in the legal principles or regulations on time of delivery in contract for the sale of goods. Therefore, this study is to research the nature of terms of time of delivery (shipment), actual time of delivery according to interpretation principles in various cases of contract and other issues in Anglo-American law. Also this study provides some important points that traders of goods should be wary of as suggested by the research results.

          Now, export situations of korean SMEs are in the face of difficulties. Therefore, SMEs should take many kinds of measures to improve overseas marketing strategies, including ways to search foreign buyer, as well as to strengthen competitiveness of goods and services. It has appeared that in the overseas marketing strategies, Korean SMEs have considered that one of the most difficult export processes has been searching foreign buyer in targeted overseas markets. Korean SMEs have been using many ways for searching foreign buyer. And world market circumstances are changing very fast. Therefore, investigations and assessments on ways for searching foreign buyer taken by korean SMEs should be reconsidered. Therefore, this paper is to analyse survey questionnaire which is made for assessment on ways for searching foreign buyer and to suggest their implications for improvement of ways for searching foreign buyer of korean SMEs.
