The Paradigm Shift in Global Financial Regulation

정보혁명으로 인한 새로운 금융기법의 개발과 금융상품의 등장과 함께 금융기관의 대형화와 겸업화는 국내 및 국제 금융시장구조의 대대적인 변화를 가져왔다. 또한 국가간 역내 금융시장의 통합과 금융시장의 세계화로 국내외 금융기관의감독 및 규제를 위한 통일적인 국제기준의 필요성 증대로 국제협약이 확립되어 시행되고 있다. 그러나 현행 국제규제 및 기준은 규제의 효율성만을 중시한 결과, 기준의 표준화를 강조한 나머지 개별적인 금융시장의 특수성을 반영하고 있지않다는 비판이 제기되고 있다. 특히 현행 금융감독 및 규제관련 국제협약의 수립 또한 일부 선진국주도로 이루어져 협약주도국이외의 국가들은 공식적으로 중요한 정책결정에 참여하지 못하는 등 협약제정과정상 민주적 적법성의 결여도 비판을 받고 있다. 또한 새롭고 복잡한 금융기법의 개발과 금융시장의 세계화로 인한 개별국가의 금융감독 및 규제의 한계때문에 금융기관의 사(적)규제와 함께 국내 및 국제 금융감독기관과 금융기관의 공동협력의 필요성이 증대되고 있다. 아울러 국가간 지역통합에 따른 역내 통화 및 금융협력의 강화도 강조되고 있다. 따라서 본논문은 금융시장의 세계화와 금융기법의 혁신으로 인한 금융시장구조의 혁명적인 변화에 적절히 대응할 수 있는 금융기관의 감독 및 규제방안을 모색하고자 하였다.

Global Convergence of Financial Standards

Notably, the near collapse of the world's financial system three years ago has prompted a fundamental reassessment of the industry. The biggest casualty of the crisis may have been the idea that financial markets are inherently self-regulating and best left to their own devices. After decades of deregulation in most countries, finance is entering a new age of regulation. In this unprecedented financial environment the soft law approach should be taken seriously to promote regulatory harmonization and reduce the risk of instability related to weak regulations and to regulatory arbitrage despite the worldwide spread of soft regulatory convergence. In line with the analysis above, this paper attempts to examine the ongoing process of global financial convergence. To begin with, this paper explores the main features of international financial regulatory process of setting standards as soft law. Then, it discusses the pros and cons of the soft law approach to financial regulatory harmonization. Finally, this paper concludes in addressing the future of global financial convergence and drawing from a few suggestions which may be of some use to those involved in restructuring financial governance at national, regional and global levels.

R22를 사용하는 멀티에어컨 시스템을 위한 시뮬레이션 프로그램

In this study, the computer program called Multi_Cycle, which simulates the steady-state performance(COP, capacity, power consumption and etc.) of multi-airconditioning systems using R22, was developed. In order to validate the simulation program, a series of case studies were carried out. The Multi_Cycle consists of several subroutines for simulating indoor units, outdoor unit, compressor, and expansion devices, and for estimating the thermodynamic and transport properties of the refrigerants and moist air. It would appear to be advantageous to use the Multi_Cycle for a performance analysis when considering various kinds of refrigerants and the complex operating conditions of each unit making up the multi-airconditioner cycle. Moreover, the Multi_Cycle would seem to be useful tool in optimizing a multi-airconditioning system and establishing economical and efficient operating conditions in the multi-airconditioner cycle. In the present study, the Multi_Cycle was programmed with Digital Visual Fortran for the main simulation code and Visual Basic for the graphic user interface.

기내난동은 항공기 승객이 운항시 지켜야할 규칙을 지키지 않거나 기장과 객실 승무원의 업무를 방 해하는 것으로 항공기 안전을 저해하는 요소이다. 국제항공운송협회(IATA)의 발표자료에 의하면 기내 난동행위는 급격하게 증가하고 있는 추세이다. 항공사 발표자료와 뉴스보도, 국토해양부의 보도자료 등 을 통하여 기내난동 현황과 원인을 분석하고, 현장에서 우리나라 법률 및 항공사별 규제가 어떻게 적 용되는지 알아본다. 또한 1963년 국제민간항공기구(ICAO)에 의해 채택된 동경협약의 개정작업 진행정 도를 확인하고 현실적으로 어떻게 대응되는지 확인해본다. 마지막으로 개정된 동경협약에 따라 우리나 라 항공안전 및 보안에 관한 법률에 대한 개정에 대한 논의도 이루어지길 기대해본다.

Intudies order to validate the simulation program, a series of case were carried out.The results of the simulation showed a good agreement with calorimeter test resultsof the actual multi-airconditioning systems using R410A.

In Search of the New Paradigm for Global Financial Governance

As evidenced in the global financial crisis of the late 1990s, the world’s financial regulatory authorities have not succeeded in keeping pace with the financial innovation. The ongoing global financial crisis revealed fundamental weakness in the structure of financial regulation. The crises have shifted the focus in global and domestic policy debates back to the notion of market failure and government failure separately and integrally. In this regard, this paper attempts to answer the question of what should be the appropriate responses to global financial integration, and thus provide a new paradigm for global financial governance. Finally, this paper will draw from a few suggestions which may be of some use to those involved in restructuring regional financial governance in East Asia.
