지역무역협정이 WTO 긴급수입제한조치 협정상의 병행주의 적용에 미치는 영향 - 한-미, 한-캐나다 세이프가드 조치 분쟁사건을 중심으로 -

보호무역주의는 수입산 물품으로부터 국내산업을 보호하며 무역수지를 정상화하고자 하는 목적을 가지고 있다. 특히 선진국들은 관세인상으로 인한 교역상대국의 반발을 회피하면서도 국내산업 보호라는 목적을 달성하기 위해 반덤핑관세 및 상계관세부과와 긴급수입제한조치(이하, ‘세이프가드 조치’라 함)와 같은 무역구제조치를 시행한다. 특히 최근에는 선진국이 수입품에 세이프가드 조치를 발동하는 사례가 늘어났다. 본고는 미국이 2018년 2월 7일 수입산 가정용 세탁기에 발동한 세이프가드 조치와 캐나다가 2019년 5월 13일 철강제품에 발동한 세이프가드 조치를 분석하였다. 특히, 두 세이프가드 조치 사건은 한국이 FTA를 체결한 후 처음으로 세이프가드 조사를 받은 사례라는 점을 주목하여 FTA의 세이프가드 조항이 WTO 세이프가드 협정 하에서 어떻게 적용되는지를 중점적으로 분석하였다. 본고는 지역무역협정과 WTO 세이프가드 협정의 관계에 관한 ‘병행주의’의 논의가 어떻게 이루어져왔는지 살펴본 후 미국과 캐나다의 국내법이 세이프가드 조치와 FTA의 적용을 어떻게 규정하고 있는지 알아보았다. 이를 바탕으로 두 사건에서 NAFTA, 한-미 FTA, 한-캐나다 FTA가 어떻게 적용되었는지 비교하였다. 미국과 캐나다의 세이프가드 조치 사건을 분석한 결과 세이프가드 조사 당국이 WTO 분쟁해결기구가 병행주의에 관해서 지적한 점을 상당부분 반영한 것으로 나타났다. 미국 무역위원회와 캐나다 무역위원회는 FTA 세이프가드 규정을 따르면서, 병행주의에 관한 WTO 분쟁해결기구의 결정을 반영하여 세이프가드 조치에서 제외되는 수출국에 대해서 세이프가드 조사를 시행하였다. 나아가 보고서에 이에 대한 상세한 설명을 포함하였다. 위 분석에 근거하여 본고는 FTA의 세이프가드 규정을 활용하여 세이프가드 조치를 예방할 수 있다는 시사점을 도출하였다. 두 사건에서 미국과 캐나다의 무역위원회는 한국과 체결한 FTA의 세이프가드 조항을 근거로 한국산 수입품에 대해서는 세이프가드 조치를 제외했다. 이는 FTA의 세이프가드 조항은 한국에 대한 세이프가드 조치를 세이프가드 조사 단계에서 방지하는 역할을 할 수 있음 보여준다. 한편, 한국이 기체결한 FTA 중에는 한-미 FTA와 한-캐나다 FTA의 세이프가드 조항과 유사한 규정이 없는 FTA에 다수 존재한다. 본고는 향후 한국이 FTA 체결이나 FTA 개정을 논의할 때 세이프가드 규정을 추가하여 세이프가드 조치에 대응해야 함을 역설했다. 마지막으로 법정책적으로 세이프가드 조치 발동국의 국내산업 및 소비자들과 연계하여 세이프가드 조치에 대응해야함을 제시했다. 국내산업을 보호하고자 하는 무역구제조치가 과도하게 시행될 경우 이는 오히려 발동국 기업이 신규 고용을 주저하게끔 하거나 소비자 이익을 감소시키는 방향으로 작용할 수 있다. 이러한 점을 충분히 활용하여 무역구제조치를 부과한 정부를 압박하는 협상수단으로 사용하는 방안을 고려하여야 한다. The US-China Trade War is one of the most notable issues that protectionism which gives priority to the protection of domestic industries and reduction of trade deficit has ruled international trade. However, WTO members hesitate to increase tariff rates to restrict imports from other WTO members due to expected strong opposition and countermeasures. Instead, WTO members prefer to exercise trade remedies to take remedial measures against imports which are causing material injury to the domestic industry; Anti-dumping duties, countervailing duties, and safeguard measures. On 7 February 2018, the U.S. government applied safeguard measures on imports of the large residential washer, and on 13 May 2019, the Canadian government applied safeguard measures on imports of certain steel products. Korea is a respondent party in both cases. Especially, both cases examined whether the Safeguards Clauses of FTA could be applied to exclude Korea from safeguard measures. This paper analyses those two cases to answer the question “how FTA affect to the safeguard investigation and safeguard measures?”. The relationship between WTO Agreement of Safeguards and FTA has been discussed in the view of ‘Parallelism’ since WTO Dispute Settlement Body used the term to prevent WTO members from the application of FTA Safeguard Clauses arbitrary. This paper figures out the three implications after analyzing the above two cases. First, Safeguard Clauses of FTA play a role to protect the exporting country from the application of safeguard measures. In the two cases, Korea was excluded from both safeguard measures based on Safeguard Clauses of FTA. Second, when the government signs FTA, it has to consider to include Safeguard Clauses. Moreover, since some of Korea’s signed FTAs omit these Safeguard Clauses, the Korean government needs to revise the FTA Safeguard Chapter. For the last, the construction of links through exporters, domestic industries, and consumers enables to relieve the cost and the burden of the exporting country by settling the dispute during consultations before establishing the panel.
