노인교통범죄는 사소한 질서위반 행위에서부터 타인의 생명과 신체에 대한 중대한 침해행위로까지 그 피해가 특정개인에 국한되기보다 장소와 시간 그리고 불특정다수의 전 사회구성원을 대상으로 발생될 수 있다는 점에서 노인교통범죄 피해가 매우 심각한 수위까지 도달하였다. 그 결과 노인교통사고의 발생으로 노인교통범죄가 심각한 사회적 문제로 대두되고 있다. 노인교통사고범죄는 운전자 - 자동차 - 도로 개념을 중심으로 인간이 운전하는 것을 전제로 하고 있는데 이것을 어떻게 노인교통범죄자 즉 교통약자 중심의 규제방식으로 전환시킬 것인가가 중요한 노인교통범죄의 해결방안 문제로 귀결된다. 나아가 노인은 육체적, 심리적, 사회적, 경제적으로 젊은이들과 다른 특성을 갖고 삶을 영위한다. 노인이 피해자든 범죄자든 일반 평균인과는 다르다는 점을 이해하고 수사나 재판절차가 진행되어야 할 것이다. 그렇게 함으로서 범행동기, 과정, 결과 및 향후 발생되는 부작용이나 회복에 있어 적정한 사법절차가 진행될 수 있고, 노인교통범죄자들의 처우나 사법복지가 제대로 구현될 수 있다. 이를 위해 노인교통범죄와 관련된 공식통계자료를 중심으로 한 노인교통범죄 발생 실태 및 교통범죄추이 분석을 통해 나타난 노인교통범죄의 급증현상에 대한 효과적인 교통범죄예방과 실질적인 처우, 나아가 노인교통범죄에 대한 접근방식의 실효성을 높이기 위한 노인교통범죄방지 대책방안으로서 형사정책적, 사법복지적, 노인교통복지적, 노인교통공학적 그리고 융복합적연구 측면에서 대책방안을 모색하려는 데 있다. By doing so, proper judicial procedures can be carried out in terms of motive, process, outcome and future adverse effects or recovery, and protection and justice welfare of elderly traffic criminals can be implemented properly. The purpose of this study is to investigate the previous researches related to the elderly traffic crime and to investigate the effect of traffic crime on elderly traffic crime, In order to increase the effectiveness of the approach to the crime of elderly people, it is necessary to provide practical measures and measures to prevent the elderly traffic crime.

빠르게 진행되고 있는 고령화 현상은 지금 한국사회에서 많은 문제점을 발생시키고 있다. 최근에는 범죄의 발생 수 보다 범죄유형의 다양화, 폭력성과 대담성을 보여주고 있어 심각한 사회문제로 인식되고 있다. 이러한 범죄의 원인으로는 특히 경제적 빈곤과 함께 사회로 부터의 소외감, 가족간의 불화, 노년의 정서적 변화 등 심리적 원인이 주된 요인으로 작용하고 있다. 이 연구에서 살펴본 노인범죄의 특징은 첫째, 노인범죄가 점점 고령화되어가고 71세 이상의 고고령자의 범죄비율이 높아지고 있다. 둘째, 노인범죄가 생계형범죄를 벗어나 살인, 강도, 방화 등과 같이 강력범죄의 형태로 빠르게 증가하고 있다. 셋째, 경제적 요인에 의한 재산범죄가 지속적으로 증가하고 특히 절도범죄의 경우 대체로 은퇴나 실직과 같은 경제적 빈곤이 원인이 되어 생계형, 생활비마련, 부에 대한 욕심 등이 노인으로 하여금 박탈감을 증대시키며, 쉽게 범죄의 충동을 일으키게 된다. 우리가 지금까지 청소년범죄에 대하여 관심을 가지고 대응방안을 마련하였듯이 고령화 사회에서는 노인문제 즉 노인범죄의 독자성, 특이성을 인정하여 노인범죄자에 대한 지속적인 관심을 가지고 형사사법적 대책방안을 마련해야 할 것이다. 나아가 노인에 관한 형사 특별법을 마련하여 노인의 경우에도 분명 일반성인과 다른 신체적ㆍ심리적ㆍ사회적ㆍ성적 환경에 처해 있다. 그러나 우리나라의 현행 형사사법 절차는 일반 성인과 조금도 다름없이 처리되고 있는 것이 현실이다. 따라서 필요성이 부각되는 이 시기에 일반 성인범과 다른 별도의 처리절차를 거치도록 할 필요성이 있다고 본다. The greying society in Korea going on rapidly more than advanced countries brings about many problems. In the year 2000, Korea became an aging society, with 7% of its population being comprised of elderly citizens over 65 years old. It is forecasted that by the year 2026, the percentage will increase to over 20%, making the country a super aged society. Preliminary research has shown that decreased physical, mental, and social functions and low crime rates. Recently, type is diversified and is realized by serious social problem because is showing violence and daring. The family systems with specially economical poverty as cause of this old man crime be in discord, sentimentalize change etc.. psychological cause in old age is pointing. According to findings an analysis of this study, First, average age of elderly criminals is increasing continuously. In contrast to the stable or decreasing crime rates of other age groups, the rate of criminals who are seventy one years old or older is increasing. Second, elderly crime is no longer limited to crime for survival and livelihood, and is becoming increasingly violent with rapid rise in crimes such as homicide, robbery and arson. Third, property crimes increase. Crimes of larceny increase at a high ration in the offenses of criminal laws. It means that the appearance of elderly crimes is caused by poverty factor and economy factors. We will have to be interested about old man crime on aging society and ready confrontation plan as we were interested about juvenile delinquency until the latest and readied confrontation plan and Criminal Justice viewpoint.

오늘날 한국의 노인들은 의학 및 영양의 발전으로 점점 더 많고 빠르게 평균수명이 높아져 가고 있다. 더불어 노인성범죄의 발생건수도 또한 평균수명이 증가 한 만큼 점점 증가하는 추세이다. 사회가 급속히 고령화하면서 노인성범죄도 발생빈도가 늘어나고 있을 뿐만 아니라 그 심각성이 기존 성인 성범죄와 차별하여 대응할 근거가 없을 정도로 심화되고 있어 새로운 인식과 범죄학적 측면에서의 접근이 필요한 시점이다. 노인성범죄는 여러 원인 중 심리적, 정신적, 사회적 원인에 의해 성범죄가 발생한다고 하였다. 따라서 본 연구에서는 노인성범죄의 실태를 통계자료 중심으로 파악하고 이렇게 도출된 통계자료를 근거하여 노인성범죄의 경향을 살펴보고자 한다. 궁극적으로 노인들은 적절한 여가활동을 통하여 노후의 고독감 및 무위고를 해소하고 삶에 대한 새로운 의미를 부여하여야 한다. 이를 위하여 노인복지시설을 확충하고 노인 전문가를 배치하여 함은 물론이고 다양한 자원봉사활동을 통한 사회참여를 유도하여야 할 것이다. In recent years the older persons in Korea are living longer than ever before and in greater numbers than elderly sex offenses previously experienced with advances in medical research, nutrition, and health care. The society is aging rapidly, the occurrence rate of their sex offenses is not only going up, but also it severity is getting worse to the extend that there is no need to differentiate their offenses form those of different age groups in tackling them. So its about time to have new recognition and forensic approach toward it. Previous research suggests that elderly sex offenses is various caused by psychological, spiritual, and sociological factors. In the vein, this study examines the reality of elderly sex offenses using various official and academic statistical data, and the current trends of elderly sex offenses based on these data analysis Old mans must solved loneliness after string through suitable recreation and sense of isolation and give new meaning about life ultimately. It may have to of course, and drive social activities through various voluntary service that must expand welfare facilities for this and post expert.
