신종코로나바이러스감염증(COVID-19, 이하 코로나) 팬데믹 사태가 장기화되면서 완전 종식에 대한 기대는 다소 소원해지고 코로나와 함께하는 일상이라는 이른바 ‘위드(with) 코로나’ 시대가 현실로 다가오고 있다. 전례 없이 빠른 백신 개발과 임삼시험을 거치며 선진국을 중심으로 백신이 생산되고 지구촌 곳곳에 보급되면서 불완전하게나마 일상 복귀가 가시권에 가까워지고 있는 것은 그나마 다행스러운 대목이다. 하지만 이 과정에서도 백신 부작용, 일부 국가에서의 시위와 혼란 등 의학적, 사회적 고민이 많아지고 있는데 그중에서도 특히 선진국과 개발도상국(이하 개도국) 간 백신 수급에서의 불평 등 문제 등 국가별 코로나 대응 의료체계, 범국가적 디지털 헬스케어 협력 필요성의 대두와 같은 보건분야의 통상 쟁점들에 대한 연구 필요성이 제고되고 있다. 코로나 사태 초기부터 전 세계적으로 마스크 수출입 문제 등 의료 물품 수급 문제와 국가들의 봉쇄령(lockdown)조치로 인한 항공·여행 산업 타격 문제가 대두됐고, 이로 인해 유통 서비스의 중요성이 제고되고 노동제도 정비 필요성 또한 강조되면서 다양한 논의들이 진행되고 있다. 본 연구는 전술한 것과 같이 포스트 코로나, ‘위드 코로나’ 시대를 준비하는 차원에서 미래의 보건 분야 통상 쟁점들을 검토하고자 한다. 구체적으로 코로나 백신과 치료제에 대한 수출규제, 특허권의 일시적 유예, 디지털 헬스케어 등 서비스 무역 분야를 통상법과 정책적 관점에서 분석하고 시사점을 모색한다. As the COVID-19 endlessly continues to be parasitic in the global community, the expectation for the complete end of the pandemic is rather renounced but now turned into better preparing for the society where coexist with the virus. While it is very fortunate that some developed countries unprecedentedly succeed in clinical testing, developing and distributing vaccines to fight against, on the other hand, the fact should not be underestimated or disregarded that many still have to suffer from the inequality problem in the supplement of the vaccines at this point in time. After some other earlier problems like the shortage in the supply of facial masks are relatively better manageable today, it is more important to study in advance about the possible trade-related public health issues to rise in the Post-COVID-19 Era. This study, therefore, pays closer attention and investigates those issues. They are about the possibility and legitimacy of the export restriction and temporary waiver of the intellectual property rights both for the vaccines and treatments against the COVID-19 virus. Then, it proceeds to search for some policy implications regarding the digital healthcare which will likely play a greater role in the future pandemic situation.

The U.S. semiconductor strategies, framed within the context of national security, are significantly impacting not only the U.S. market but also the entire international trading system. Notable examples include export controls on semiconductor exports to China, guardrail provisions in the CHIPS Act, and restrictions on outbound investments related to advanced technologies. Ultimately, these strategies aim to achieve a shared objective of fortifying the domestic supply chain and accomplishing decoupling from China. The U.S. semiconductor industrial policy is anticipated to further cement its long-standing dominant position in the semiconductor industry and enhance its market share worldwide. Additionally, these measures are employed as a weaponized trade policy in the U.S.- China technological competition, influencing not just China but also other countries trade policy directions. Presently, these measures are raising concerns about potential violations of the multilateral trade norms of the WTO and FTAs, but strict regulation is challenging due to the non-economic value ascribed to national security. Consequently, the unilateral industrial policy of the U.S. is expected to ultimately fuel a trend toward de-regularization in the international community in the future. Given South Koreas heavy reliance on specific countries, notably China, within the global supply chain, and considering that the domestic semiconductor market lacks the substantial influence required to impact other nations, it is imperative to adopt a distinct approach from that of the U.S., considering the unique market conditions and specific industrial development goals of the Korean semiconductor industry.
